{"id":189642,"date":"2026-04-08T15:12:11","date_gmt":"2026-04-08T15:12:11","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/189642\/"},"modified":"2026-04-08T15:12:11","modified_gmt":"2026-04-08T15:12:11","slug":"dominican-sisters-challenge-new-york-gender-identity-law-in-court","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/189642\/","title":{"rendered":"Dominican Sisters challenge New York gender-identity law in court"},"content":{"rendered":"<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">A group of Catholic religious sisters has taken care of <a href=\"https:\/\/www.youtube.com\/watch?v=zSK8kWdz5LY\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">terminal cancer patients<\/a> free of charge in New York for almost 125 years without a problem.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">Now, state officials are warning the sisters and other nursing home administrators about restricting rooms and bathrooms to one sex and failing to use preferred personal pronouns for patients who identify as transgender. The state is also requiring public postings of an antidiscrimination notice.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The Dominican Sisters of Hawthorne, who operate <a href=\"https:\/\/rosaryhillhome.org\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">Rosary Hill Home<\/a>, a 42-bed facility, have received three letters from the state\u2019s public health agency, including one warning about \u201crefusing to assign a room to a resident other than in accordance with the resident\u2019s gender identity,\u201d \u201cprohibiting a resident from using a restroom available to other persons of the same gender identity,\u201d and \u201cwillfully and repeatedly failing to use a resident\u2019s preferred name or pronouns after being clearly informed of the preferred name or pronouns.\u201d<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The letters took the sisters off guard; a state agency\u2019s <a href=\"https:\/\/health.data.ny.gov\/Health\/Nursing-Home-Profiles-Quality-Data-Beginning-2020\/ivgj-ga38\/about_data\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">website<\/a> shows zero complaints against Rosary Hill Home, located in Hawthorne, a hamlet in the Westchester County town of Mount Pleasant, about 30 miles northeast of Manhattan.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">But complying with the state\u2019s rules is not an option for them, since the directives contradict their Catholic faith, the sisters told the National Catholic Register, the sister partner of EWTN News.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The Catholic Church\u00a0<a href=\"https:\/\/www.vatican.va\/roman_curia\/congregations\/ccatheduc\/documents\/rc_con_ccatheduc_doc_20190202_maschio-e-femmina_en.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">teaches<\/a>\u00a0that sex can\u2019t be changed or separated from gender, although it also says people identifying as transgender\u00a0<a href=\"https:\/\/www.vatican.va\/content\/catechism\/en\/part_three\/section_two\/chapter_two\/article_6\/ii_the_vocation_to_chastity.html?utm_source=chatgpt.com\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">must be<\/a>\u00a0treated with respect and compassion.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">\u201cI think the most important thing is that we are adamant in keeping our Catholic identity. Without that, there\u2019s no purpose for us to do what we\u2019re doing,\u201d Mother Marie Edward, OP, the superior of the religious congregation, told the Register.<\/p>\n<p><img alt=\"Cloudinary Asset\" format=\"auto\" loading=\"lazy\" width=\"636\" height=\"463\" decoding=\"async\" data-nimg=\"1\" class=\"max-w-full h-auto rounded-sm\" style=\"color:transparent;width:100%;height:auto\"  src=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2026\/04\/Hawthorne.1_ygmted.jpg\"\/><\/p>\n<p class=\"text-[14px] text-gray-400 border-b border-gray-300 py-3\">Entrance to the Rosary Hill Home, a 42-bed facility located in Westchester County, about 30 miles northeast of Manhattan in New York. | Credit: \u201cEWTN Pro-Life Weekly\u201d\/Screenshot<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The sisters filed a lawsuit against the state on Monday, claiming the state is violating their rights under the First Amendment of the U.S. Constitution.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The lawsuit, filed in U.S. District Court for the Southern District of New York in White Plains, names as defendants New York Gov. Kathy Hochul and four state administrators in the New York State Department of Health. All are sued in their official capacity.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The complaint claims that the state is violating the sisters\u2019 freedom of speech by requiring them to state a point of view they don\u2019t agree with and their free exercise of religion by requiring them to make statements against their Catholic faith.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The complaint also notes that the state <a href=\"https:\/\/www.nysenate.gov\/legislation\/laws\/PBH\/2801\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">statute<\/a> appears to exempt institutions run by the Church of Christ, Scientist \u2014 it doesn\u2019t apply to those \u201cwhose teachings include reliance on spiritual means through prayer alone for healing\u201d \u2014 which the complaint says violates the Catholic sisters\u2019 religious freedom by favoring one religion over another.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">A spokesman for the governor did not respond to a request for comment by publication of this story.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">Cadence Acquaviva, senior public information officer for the New York State Department of Health, also contacted by the Register, emailed the Register the following statement: \u201cWhile the department does not comment on pending or ongoing litigation, the department is committed to following state law, which provides nursing home residents certain rights protecting against discrimination including, but not limited to, gender identity or expression.\u201d<\/p>\n<p>New York law<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The letters to the sisters from the state\u2019s public health agency stem from a\u00a0<a href=\"https:\/\/assembly.state.ny.us\/leg\/?default_fld=&amp;leg_video=&amp;bn=S01783&amp;term=2023&amp;Floor%26nbspVotes=Y&amp;Text=Y#jump_to_Text\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">statute<\/a> that the New York Legislature passed in 2023 with little fanfare and almost no opposition, known as \u201cThe Long-Term Care Facility Residents\u2019 Bill of Rights for LGBTQIA+ New Yorkers and People Living with HIV.\u201d<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The state Legislature\u2019s website shows no public hearing for the bill that created the law. When it was introduced\u00a0<a href=\"https:\/\/nystateassembly.granicus.com\/player\/clip\/7682?view_id=7&amp;meta_id=212051&amp;redirect=true\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">on the floor<\/a>\u00a0of the lower chamber, the New York State Assembly, in June 2023, the bill drew questions from three Republicans over the course of about 10 minutes, mostly informational and none hostile. Religious liberty did not come up.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The Assembly passed the bill <a href=\"https:\/\/assembly.state.ny.us\/leg\/?default_fld=&amp;leg_video=&amp;bn=S01783&amp;term=2023&amp;Floor%26nbspVotes=Y&amp;Text=Y\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">144-2<\/a>. The New York Senate passed the bill <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2023\/S1783\/amendment\/original\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">55-7<\/a>. Hochul signed the bill into law on Nov. 30, 2023, the eve of <a href=\"https:\/\/www.who.int\/campaigns\/world-aids-day\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">World AIDS Day<\/a>.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">\u201cNew York\u2019s seniors should be able to live their lives with the dignity and respect they deserve, free from discrimination of every kind,\u201d Hochul said, <a href=\"https:\/\/www.governor.ny.gov\/news\/governor-hochul-signs-legislation-protect-rights-seniors-living-hiv-and-members-lgbtqia?utm_source=chatgpt.com\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">according to a press release<\/a> issued by her office at the time. \u201cLGBTQIA + and HIV-positive seniors are among our most vulnerable populations, and today we are taking steps to ensure that all New Yorkers \u2014 regardless of who they are, who they love, or their HIV status \u2014 find safety and support in places where they need it the most. Hate will never have a place in New York.\u201d<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The sisters told the Register they had never heard of the bill until the letters from the state started arriving about two years ago. State officials have not taken steps against the sisters, but the sisters say they\u2019re worried that they will.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">\u201cOver 125 years, as far as they know, they\u2019ve never once had a patient who was wanting to make the gender journey, to transition. And that\u2019s significant, because why are we going through this?\u201d said L. Martin Nussbaum, the sisters\u2019 lawyer and a <a href=\"https:\/\/first-fourteenth.com\/team\/l-martin-nussbaum\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">partner<\/a> with First &amp; Fourteenth, a law firm with an office in Colorado Springs, Colorado, in an interview. \u201cThis law imposed on the Dominican Hawthorne Sisters is a form of gender ideology virtue signaling, to require these sisters to be trained in an ideology entirely contrary to Catholic belief.\u201d<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">\u201cWhy are we doing this? We don\u2019t even have such patients,\u201d Nussbaum said. \u201cIt\u2019s the state requiring these holy nuns to bend the knee to an ideology contrary to their faith.\u201d<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">One letter from the state warned the sisters that their nursing home can\u2019t \u201crestrict a resident\u2019s right to associate with other residents or with visitors, including the right to consensual expression of intimacy or sexual relations, unless the restriction is uniformly applied to all residents in a nondiscriminatory manner.\u201d<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">Rosary Hill Home belongs to the <a href=\"https:\/\/catholicbenefitsassociation.org\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">Catholic Benefits Association<\/a>, which <a href=\"https:\/\/catholicbenefitsassociation.org\/about\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">advocates for<\/a> free exercise of religion rights of members in providing employee benefits. Nussbaum, who represents the association, said the state\u2019s gender-identity requirements are creating a problem where there was none.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">\u201cThe sisters do not want to litigate. They want this resolved, and they want to focus on their ministry,\u201d Nussbaum said.<\/p>\n<p>The congregation<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The\u00a0<a href=\"https:\/\/hawthorne-dominicans.org\/brief-biography\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">Dominican Sisters of Hawthorne<\/a>\u00a0was founded by Mother Mary Alphonsa, who was known as Rose Hawthorne Lathrop (1851\u20131926) before she entered religious life. She was one of three children of the 19th-century novelist Nathaniel Hawthorne, author of\u00a0\u201cThe House of the Seven Gables\u201d\u00a0and\u00a0\u201cThe Scarlet Letter.\u201d<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">Raised Unitarian, Rose converted to Catholicism during the 1890s. In 1896, she opened an apartment on the Lower East Side of Manhattan for patients with incurable cancer.<\/p>\n<p><img alt=\"Cloudinary Asset\" format=\"auto\" loading=\"lazy\" width=\"969\" height=\"636\" decoding=\"async\" data-nimg=\"1\" class=\"max-w-full h-auto rounded-sm\" style=\"color:transparent;width:100%;height:auto\"  src=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2026\/04\/Hawthorne.3_xipdss.jpg\"\/><\/p>\n<p class=\"text-[14px] text-gray-400 border-b border-gray-300 py-3\">The foundress of the Dominican Sisters of Hawthorne, Mother Mary Alphonsa, was the daughter of the renowned 19th-century American writer Nathaniel Hawthorne. | Credit: \u201cEWTN Pro-Life Weekly\u201d\/Screenshot<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">\u201cI set my whole being to endeavor to bring consolation to the cancerous poor,\u201d she later wrote,\u00a0<a href=\"https:\/\/hawthorne-dominicans.org\/brief-biography\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">according to a biography<\/a>\u00a0of her on the congregation\u2019s website.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">She founded a religious congregation in 1900, which opened a nursing home in Hawthorne, New York, in June 1901.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">Pope Francis in March 2024\u00a0<a href=\"https:\/\/hawthorne-dominicans.org\/rose-hawthorne\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">declared her venerable<\/a>, which is two steps below canonization. Her cause needs a miracle to proceed to beatification and another to qualify her to be declared a saint.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The congregation currently has 44 sisters, split between New York and another nursing facility in Atlanta called\u00a0<a href=\"https:\/\/olphhome.org\/about-us\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">Our Lady of Perpetual Help Home<\/a>.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">In the New York facility, about 14 sisters tend to sick patients with the help of lay certified nursing assistants, sisters told the Register.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The home has no limit on the length of stay, and some patients stay for years, sisters told the Register, though the average stay is about two to three months. The vast majority of patients who come to the nursing home die there.<\/p>\n<p>\u2018We\u2019ve given our life to God\u2019<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The New York facility was the subject of an admiring\u00a0<a href=\"https:\/\/www.nytimes.com\/2016\/05\/15\/magazine\/the-sisters-who-treat-the-untreatable.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" class=\"text-red-500 hover-underline-animation-red\">photographic essay and short article<\/a>\u00a0in\u00a0The New York Times Magazine\u00a0in May 2016, spearheaded by a photographer who appreciated the care the sisters had given to her Jewish mother-in-law when she was dying of cancer.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">Mother Marie Edward, who joined the congregation in 1979, told the Register that living their Catholic faith and witnessing to it to others are essential for the sisters, whose work is only partly about taking care of the sick.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">\u201cNursing is a marvelous work in and of itself, but our sisters are, we\u2019re all consecrated, we\u2019ve taken vows, we\u2019ve given our life to God, and certainly prayer is utmost, primary. That we consider a work, and the sisters live a very enclosed life of prayer first, and then it spills over into the care of the patients, so that we are to care for the patients as if they were Christ, the suffering Christ,\u201d she said.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">\u201cAnd to do that, we have to be very strong in our identity as Christians, and to follow the teachings of Christ,\u201d she added. \u201cSo to do something that goes contrary to that, it just wouldn\u2019t work.\u201d<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">The superior general cited John 14:6 as one of the reasons the sisters can\u2019t treat males as if they were females, or vice versa.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">\u201cChrist is the center, and the Eucharist sustains us. But Christ is also, as he said, the way, the truth, and the life. And if he\u2019s the truth, then we cannot practice what we do, incorporating something that is an untruth,\u201d she explained.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">\u201cAnd it is an untruth to say that a male should go into a female patient\u2019s room. You\u2019re just trying to contort things, for whatever reason. So we have to stand by the truth of what has been taught to us in the natural law. It is not to be changed,\u201d Mother Marie Edward said.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">\u201cFor us, this is what sustains us,\u201d added Sister Stella Mary, the superior of Rosary Hill Home, who joined in 2006.<\/p>\n<p class=\"text-[18px] md:text-[20px] first-of-type:mt-5 mt-[16px] lg:mt-[28px] leading-[28px] md:leading-8 normal \">\u201cThis is our strength.
