{"id":190870,"date":"2026-04-09T13:31:11","date_gmt":"2026-04-09T13:31:11","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/190870\/"},"modified":"2026-04-09T13:31:11","modified_gmt":"2026-04-09T13:31:11","slug":"new-york-latest-state-to-consider-law-on-private-listings","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/190870\/","title":{"rendered":"New York Latest State to Consider Law on Private Listings"},"content":{"rendered":"<p>The battle over private listings has entered New York\u2019s state legislature.\u00a0<\/p>\n<p>State assembly member Michaelle Solages introduced a bill last month that would <a href=\"https:\/\/therealdeal.com\/new-york\/2026\/03\/25\/new-york-state-bill-targets-private-listings\/\" rel=\"nofollow noopener\" target=\"_blank\">prohibit the use of private listings<\/a> unless a seller signs specific written agreements acknowledging the risks of private marketing.<\/p>\n<p>The bill comes as similar policies at the national level from the National Association of Realtors and Zillow have slowly been <a href=\"https:\/\/therealdeal.com\/national\/2025\/03\/25\/nar-to-keep-clear-cooperation-policy-with-a-twist\/\" rel=\"nofollow noopener\" target=\"_blank\">rolled back over the last year<\/a>, and the battle over how listings are marketed has <a href=\"https:\/\/therealdeal.com\/chicago\/2026\/03\/09\/illinois-bill-targets-private-real-estate-listings\/\" rel=\"nofollow noopener\" target=\"_blank\">shifted to local statehouses<\/a>.\u00a0<\/p>\n<p>The bill would require agents to display the listing on a broadly accessible website within one calendar day of signing a listing agreement, a tighter timeline than under NAR and Zillow policies that require listings be uploaded to the Multiple Listing Service within <a href=\"https:\/\/therealdeal.com\/national\/2025\/05\/20\/zillow-targets-private-exclusives-in-listing-standards-update\/\" rel=\"nofollow noopener\" target=\"_blank\">24 hours of public marketing.\u00a0<\/a><\/p>\n<p>Sellers can opt out of publicly marketing by signing an agreement that specifies the seller has a need for privacy or safety, or a disclosure form that explains the \u201crisks and tradeoffs\u201d of private marketing, including reduced visibility to buyers, limited online exposure and fewer offers that might impact price and sale timing. The form also gives the seller the right to change their mind at any time.\u00a0<\/p>\n<p>Solages, who represents a swath of western Long Island, told The Real Deal she was looking at different levers to improve affordability and \u201cprivate listings networks kept coming up\u201d when talking to real estate agents.\u00a0<\/p>\n<p>\u201cWe want an open and competitive and fair process when buying a home,\u201d she said.\u00a0<\/p>\n<p>The bill makes New York the latest in a series of states that have taken up the fight against private listing networks. In March, Washington Gov. Bob Ferguson signed into law the most stringent restriction on private listings, which only allows for sellers to opt out of public marketing for health or safety reasons. Wisconsin also enacted a law with similar provisions to the bill proposed in New York, and state legislatures in Illinois, Hawaii and Connecticut have also introduced similar bills.\u00a0<\/p>\n<p>At the same time, national organizations have taken a step back from policing private listings. Last year, NAR introduced an exception to its <a href=\"https:\/\/therealdeal.com\/national\/2025\/03\/25\/nar-to-keep-clear-cooperation-policy-with-a-twist\/\" rel=\"nofollow noopener\" target=\"_blank\">Clear Cooperation Policy<\/a>, which required listings to be marketed through the MLS within 24 hours of public marketing. Zillow also <a href=\"https:\/\/therealdeal.com\/national\/2026\/03\/22\/compass-drops-zillow-lawsuit\/\" rel=\"nofollow noopener\" target=\"_blank\">scaled back a policy<\/a> it introduced last year that closely mimicked CCP after <a href=\"https:\/\/therealdeal.com\/national\/2026\/03\/25\/zillow-preview-picks-up-20-more-brokerage-partners\/\" rel=\"nofollow noopener\" target=\"_blank\">partnering with dozens of brokerages<\/a> to allow for listings to be displayed directly on its site without being entered into the MLS.\u00a0<\/p>\n<p>New York\u2019s proposed law is agnostic to how listings are marketed, and would only require listings to be uploaded to \u201cat least one publication, platform or website that is broadly accessible to the general public\u201d and agents.\u00a0<\/p>\n<p>That distinction would leave the recent agreements made between brokerages and platforms to display listings that aren\u2019t marketed through the MLS unaffected. <a href=\"https:\/\/therealdeal.com\/national\/2026\/02\/26\/compass-to-syndicate-exclusive-listings-to-redfin\/\" rel=\"nofollow noopener\" target=\"_blank\">Compass and Redfin<\/a> announced the first of those partnerships in February, and were quickly followed by deals announced by Zillow and a number of brokerages, including Keller Williams and HomeServices of America.\u00a0<\/p>\n<p>Instead, the law strikes at listings marketed off any public-facing website, which is a relatively common practice in New York City\u2019s luxury market. \u201cThis is not affordable housing,\u201d said Compass\u2019 Leonard Steinberg, pointing to the success the ultra-luxury new development at <a href=\"https:\/\/therealdeal.com\/magazine\/july-2025\/artie-zeckendorf-profile\/\" rel=\"nofollow noopener\" target=\"_blank\">80 Clarkson<\/a> has had in selling homes for premium prices without putting anything on the public market.\u00a0<\/p>\n<p>But the law, which does not ban private listings but requires disclosures around them, also simply formalizes an industry-standard practice, according to Steinberg. \u201cWe have very clear disclosures with our sellers,\u201d he said of introducing a private listing strategy. \u201cWe give them a vast menu of options. The key is they have a choice.\u201d<\/p>\n<p>Real Estate Board of New York President James Whelan also noted that the legislation is \u201cconsistent with industry standards\u201d established for the Residential Listing Service in a statement.<\/p>\n<p>\u201cPolicymakers are having to step up to do what brokerages should have been doing all along: telling sellers upfront that Private Listings Networks reduce competition and constrain price,\u201d a spokesperson for Brown Harris Stevens said in a statement supporting the bill. \u201cA fair and open marketplace is what\u2019s best for our industry, buyers and sellers, and true price discovery.\u201d<\/p>\n<p>The bill still has a ways to go before it becomes law.
