{"id":191458,"date":"2026-04-09T22:33:09","date_gmt":"2026-04-09T22:33:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/191458\/"},"modified":"2026-04-09T22:33:09","modified_gmt":"2026-04-09T22:33:09","slug":"trump-admin-cant-halt-millions-in-nyc-school-funding-over-transgender-policy-judge","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/191458\/","title":{"rendered":"Trump admin can&#8217;t halt millions in NYC school funding over transgender policy: judge"},"content":{"rendered":"<p>A Manhattan federal judge has vacated the Trump administration\u2019s move to <a href=\"https:\/\/www.nydailynews.com\/2025\/10\/16\/nyc-public-schools-sue-trump-administration-over-cuts-to-magnet-schools-over-transgender-policy\/\" rel=\"nofollow noopener\" target=\"_blank\">halt magnet school grants to New York City over its policies for transgender students<\/a>.<\/p>\n<p>Judge Arun Subramanian in a <a href=\"https:\/\/news.bloomberglaw.com\/business-and-practice\/judge-nixes-white-house-plan-pulling-nyc-magnet-school-grants\" rel=\"nofollow noopener\" target=\"_blank\">10-page order<\/a> Wednesday said the U.S. Department of Education failed to follow the procedures of Title IX \u2014 the federal civil rights law prohibiting discrimination on the basis of sex \u2014 and that it \u201cstrains credulity\u201d to argue they do not apply in this case.<\/p>\n<p>\u201cIt is undisputed both that defendants did not follow these statutory procedures, and that the procedures would apply if they non-continued the grants because of Title IX violations,\u201d Subramanian wrote.<\/p>\n<p>The judge said the Trump administration\u2019s written back-and-forth with local education officials \u201cmakes clear that the alleged violations were violations of Title IX,\u201d he wrote. \u201cIt thus strains credulity to argue that the DOE\u2019s actions were anything other than an effort to enforce Title IX.\u201d<\/p>\n<p>The Trump administration discontinued tens of millions of dollars in grant funding last fall, alleging <a href=\"https:\/\/www.nydailynews.com\/2025\/09\/18\/mayor-adams-says-he-will-review-nyc-school-bathroom-gender-policy-amid-federal-pressure\/\" rel=\"nofollow noopener\" target=\"_blank\">school policy allowing transgender students to use the bathroom or play on sports teams aligning with their gender identity<\/a> violated federal civil rights law. The grants included $11 million in carryover funds, which were restored earlier in the legal battle, and $36 million in future funds through the end of the grant period.<\/p>\n<p>New York City Public Schools sued the U.S. Education Department over <a href=\"https:\/\/www.nydailynews.com\/2025\/09\/24\/cutbacks-feared-as-trump-holding-back-36m-for-nyc-magnet-schools-over-transgender-policies\/\" rel=\"nofollow noopener\" target=\"_blank\">the loss of those funds<\/a>, accusing the feds of illegally trying to coerce the city into changing its policies.<\/p>\n<p>The Trump administration\u2019s lawyers tried to argue that the grants were discontinued as part of a separate process and therefore did not need to follow the procedures outlined in Title IX, which include interim steps, like a report or a hearing.<\/p>\n<p>While the order represents a victory for the city\u2019s public schools, and Subramanian said the court would be closing the case, the dispute over the system\u2019s gender policy seemed likely to continue.<\/p>\n<p>Subramanian directed the Education Department to make a new determination within 10 days about whether to continue the grants.
