{"id":202440,"date":"2026-04-19T09:34:10","date_gmt":"2026-04-19T09:34:10","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/202440\/"},"modified":"2026-04-19T09:34:10","modified_gmt":"2026-04-19T09:34:10","slug":"fraud-driven-rising-premiums-are-straining-mta-and-nyc-budgets","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/202440\/","title":{"rendered":"Fraud-driven rising premiums are straining MTA and NYC budgets"},"content":{"rendered":"<p style=\"font-weight: 400\">The battle between the Mamdani administration and the City Council to balance the budget has been contentious for one fundamental reason: costs continue to rise faster than revenue, and no one wants to raise taxes or cut programs until all alternatives have been exhausted.<\/p>\n<p style=\"font-weight: 400\">The short-term\u00a0<a href=\"https:\/\/www.nytimes.com\/2026\/03\/25\/nyregion\/mamdani-budget-cuts.html\" target=\"_blank\" rel=\"noopener nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.nytimes.com\/2026\/03\/25\/nyregion\/mamdani-budget-cuts.html&amp;source=gmail&amp;ust=1776368923127000&amp;usg=AOvVaw2jL41Guvp5NqkZasi2xcG0\">spending cuts<\/a> proposed to date are simply not enough to balance the budget anymore \u2014 not even with a <a href=\"https:\/\/subscriber.politicopro.com\/article\/2026\/02\/under-pressure-to-raise-taxes-hochul-sends-more-cash-to-new-york-city-00783239\" target=\"_blank\" rel=\"noopener nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/subscriber.politicopro.com\/article\/2026\/02\/under-pressure-to-raise-taxes-hochul-sends-more-cash-to-new-york-city-00783239&amp;source=gmail&amp;ust=1776368923127000&amp;usg=AOvVaw2vUM7VulyrxW4AGZ4cD-yR\">one-time cash infusion<\/a>\u00a0from Albany. The hard truth is that the city must address the underlying forces that are driving costs up while also finding new sources of revenue.<\/p>\n<p style=\"font-weight: 400\">One long overdue option is to take concrete steps to reduce the epidemic of auto insurance fraud, which effectively serves as a structural tax on mobility for many of the city\u2019s residents.<\/p>\n<p style=\"font-weight: 400\">In New York, staged auto accidents, medical mills, and a lax threshold for awarding payouts are\u00a0<a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=6480978\" target=\"_blank\" rel=\"noopener nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id%3D6480978&amp;source=gmail&amp;ust=1776368923127000&amp;usg=AOvVaw2TRy7CWH5lpQZVNz2mmZ_q\">siphoning money from<\/a> drivers, municipalities, and the MTA alike. The governor has rightly made reining in this out-of-control enterprise <a href=\"https:\/\/www.governor.ny.gov\/news\/money-your-pockets-governor-hochul-highlights-proposals-bring-down-costs-auto-insurance-rates\" target=\"_blank\" rel=\"noopener nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.governor.ny.gov\/news\/money-your-pockets-governor-hochul-highlights-proposals-bring-down-costs-auto-insurance-rates&amp;source=gmail&amp;ust=1776368923127000&amp;usg=AOvVaw3FWwqCs7MHQmgv2zloxpJT\">a top priority in<\/a> the state budget talks, taking on one of Albany\u2019s most entrenched special interests \u2014 the <a href=\"https:\/\/www.lohud.com\/story\/news\/politics\/2026\/03\/30\/why-lawyers-say-ny-car-insurance-reform-bill-could-hurt-crash-victims\/89385391007\/?gnt-cfr=1&amp;gca-cat=p&amp;gca-uir=true&amp;gca-epti=z116152p001750l004450c001750e1157xxv116152d--90--b--90--&amp;gca-ft=224&amp;gca-ds=sophi\" target=\"_blank\" rel=\"noopener nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.lohud.com\/story\/news\/politics\/2026\/03\/30\/why-lawyers-say-ny-car-insurance-reform-bill-could-hurt-crash-victims\/89385391007\/?gnt-cfr%3D1%26gca-cat%3Dp%26gca-uir%3Dtrue%26gca-epti%3Dz116152p001750l004450c001750e1157xxv116152d--90--b--90--%26gca-ft%3D224%26gca-ds%3Dsophi&amp;source=gmail&amp;ust=1776368923127000&amp;usg=AOvVaw1kuHJPsnqYYZF9flEzFxuT\">trial lawyers<\/a> \u2014 with the goal of lowering insurance costs for New Yorkers.<\/p>\n<p style=\"font-weight: 400\">The numbers are staggering. Fraud costs\u00a0<a href=\"https:\/\/archives.fbi.gov\/archives\/news\/stories\/2005\/february\/staged_auto021805\" target=\"_blank\" rel=\"noopener nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archives.fbi.gov\/archives\/news\/stories\/2005\/february\/staged_auto021805&amp;source=gmail&amp;ust=1776368923127000&amp;usg=AOvVaw0u_XxNb9T8eGUcHjnOe4yg\">exceed $20 billion<\/a>\u00a0nationally in organized automobile crashes. In New York, the number of motor vehicle accidents later determined to have been staged for insurance fraud purposes increased\u00a0<a href=\"https:\/\/www.dfs.ny.gov\/reports_and_publications\/press_releases\/pr20260211\" target=\"_blank\" rel=\"noopener nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.dfs.ny.gov\/reports_and_publications\/press_releases\/pr20260211&amp;source=gmail&amp;ust=1776368923127000&amp;usg=AOvVaw0-ycbHwV4MhtcvSlFuzLwv\">80%<\/a> between 2020 and 2025, making it one of the nation\u2019s highest incident states.<\/p>\n<p style=\"font-weight: 400\">Data from the state Department of Financial Services <a href=\"https:\/\/www.dfs.ny.gov\/reports_and_publications\/press_releases\/pr20260211\" target=\"_blank\" rel=\"noopener nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.dfs.ny.gov\/reports_and_publications\/press_releases\/pr20260211&amp;source=gmail&amp;ust=1776368923127000&amp;usg=AOvVaw0-ycbHwV4MhtcvSlFuzLwv\">suggest that<\/a> auto insurance fraud is inflating premiums by nearly 8%, or a difference of more than $300.<\/p>\n<p style=\"font-weight: 400\">New York\u2019s no-fault system, created to speed relief for the genuine victims of auto accidents, has instead made the state a breeding ground for abuse. The law requires insurers to pay qualifying medical claims promptly and without fault determinations. The speed at which the system adjudicates cases benefits deserving victims but also abets fraud. The result is higher premiums for drivers and higher taxes or deficits for cities and the MTA when their liability costs rise.<\/p>\n<p style=\"font-weight: 400\">Data from the state comptroller\u2019s office\u00a0<a href=\"https:\/\/www.osc.ny.gov\/press\/releases\/2025\/09\/dinapoli-announces-latest-fiscal-stress-scores\" target=\"_blank\" rel=\"noopener nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.osc.ny.gov\/press\/releases\/2025\/09\/dinapoli-announces-latest-fiscal-stress-scores&amp;source=gmail&amp;ust=1776368923127000&amp;usg=AOvVaw1QA_v2YLbf767TRVyA-FQO\">show<\/a> municipalities statewide are under increasing fiscal strain, with insurance and liability costs a growing portion of their budgets. New York City bears a disproportionate share of that burden, as does the MTA, whose CEO, Janno Lieber,\u00a0<a href=\"https:\/\/www.nytimes.com\/2026\/03\/13\/nyregion\/ny-hochul-auto-insurance-reform-mta.html\" target=\"_blank\" rel=\"noopener nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.nytimes.com\/2026\/03\/13\/nyregion\/ny-hochul-auto-insurance-reform-mta.html&amp;source=gmail&amp;ust=1776368923127000&amp;usg=AOvVaw3IWGZVgGBPBKy74-3TZMPu\">estimates\u00a0that<\/a> Hochul\u2019s proposed reforms could save the authority some $50 million annually in crash-related litigation funds.<\/p>\n<p style=\"font-weight: 400\">That money could be far better spent on much-needed improvements for the\u00a0<a href=\"https:\/\/www.mta.info\/document\/171141#page=7\" target=\"_blank\" rel=\"noopener nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.mta.info\/document\/171141%23page%3D7&amp;source=gmail&amp;ust=1776368923127000&amp;usg=AOvVaw2VTeSSvqa1W6vyKF4hzf2l\">more than 6 million people<\/a>\u00a0who ride the New York City subways and buses every day. If New York fails to restrain the growth of insurance costs and litigation, any transit-related investment must compete with other priorities, and to keep the status quo it will take service cuts elsewhere or higher taxes.<\/p>\n<p style=\"font-weight: 400\">There is irrefutable evidence that reining in out-of-control litigation costs by cracking down on fraud benefits taxpayers. One year after a wide-ranging tort reform bill\u00a0<a href=\"https:\/\/gov.georgia.gov\/press-releases\/2025-04-21\/gov-kemp-signs-historic-legislation-delivering-commonsense-meaningful\" target=\"_blank\" rel=\"noopener nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/gov.georgia.gov\/press-releases\/2025-04-21\/gov-kemp-signs-historic-legislation-delivering-commonsense-meaningful&amp;source=gmail&amp;ust=1776368923127000&amp;usg=AOvVaw1-FO7cd_TnZdhY5OqWCqeF\">was signed into law<\/a>\u00a0by Georgia Gov. Brian Kemp, the Metropolitan Atlanta Rapid Transit Authority (MARTA)\u00a0<a href=\"https:\/\/protectingamericanconsumers.org\/2026\/04\/15\/tort-reform-is-already-saving-georgia-taxpayers-money-just-ask-marta\/\" target=\"_blank\" rel=\"noopener nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/protectingamericanconsumers.org\/2026\/04\/15\/tort-reform-is-already-saving-georgia-taxpayers-money-just-ask-marta\/&amp;source=gmail&amp;ust=1776368923127000&amp;usg=AOvVaw3EnX3MstgqBLpicTHqZB4v\">reported that<\/a>\u00a0casualty and liability costs decreased by $2.8 million, dropping to $27 million.<\/p>\n<p style=\"font-weight: 400\">Eliminating fraud should not be a partisan issue.
