There is no excuse for this administration to abandon families who rely on SNAP, or food stamps, as a lifeline. The federal government must do its job to protect families.\u201d<\/p>\n<p>The <a href=\"https:\/\/ag.ny.gov\/sites\/default\/files\/court-filings\/commonwealth-of-massachusetts-v-united-states-department-of-agriculture-complaint-2025.pdf\" target=\"_blank\" rel=\"noopener nofollow\">lawsuit<\/a>, filed Tuesday in federal court in Massachusetts, contends that the USDA\u2019s suspension of benefits violates the Food and Nutrition Act and the Administrative Procedure Act. The complaint argues that the agency has access to more than $6 billion in contingency funds that Congress specifically set aside to maintain food assistance during funding lapses, but has \u201cunlawfully refused\u201d to use them.<\/p>\n<p>In New York City alone, 1.8 million residents rely on SNAP to help buy groceries, roughly one in five city dwellers. Statewide, the program supports nearly three million people, including about one million children and more than 600,000 older adults, distributing roughly $650 million in food benefits each month.<\/p>\n<p>The lawsuit seeks an emergency court order requiring the USDA to use available funds to issue November benefits. It also names USDA Secretary Brooke Rollins, the Office of Management and Budget, and its director, Russell Vought as defendants.<\/p>\n<p>The suspension, set to take effect Nov. 1, would mark the first time in SNAP\u2019s 60-year history that monthly benefits are halted during a federal shutdown.\n<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-137806898\" src=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2025\/10\/2025-10-24T155950Z_1148376734_RC2DIHAG4UFK_RTRMADP_3_USA-SHUTDOWN.jpg\" alt=\"\" width=\"700\" height=\"467\" title=\"SNAP benefit crisis: New York joins lawsuit to force Trump administration to fund food assistance amid shutdown 3\"  \/><\/p>\n<p>Joining New York in the lawsuit are the attorneys general of California, Illinois, Massachusetts, New Jersey, Oregon, Washington, and 18 other states, as well as the governors of Kansas, Kentucky, and Pennsylvania.<\/p>\n<p>Gov. Kathy Hochul, who on Monday i<a href=\"https:\/\/www.amny.com\/news\/nyc-residents-snap-cut-off-next-month\/\" target=\"_blank\" rel=\"nofollow noopener\">njected an additional $30 million<\/a> in emergency food assistance funding for pantries statewide, warned that the state is \u201cstaring down a public health crisis\u201d if the emergency funding is not released.<\/p>\n<p>\u201cNew York will not sit idly by when lives are on the line. We\u2019re proud to assist the Office of the Attorney General in joining 24 other states in suing the Trump Administration, demanding the release of emergency funds so families can continue to put food on the table through this government shutdown,\u201d said Hochul.<\/p>\n<p>\u2018A disgrace\u2019\u00a0<\/p>\n<p>USDA Secretary Rollins appeared on <a href=\"https:\/\/x.com\/SecRollins\/status\/1983227266306838688\" target=\"_blank\" rel=\"nofollow\">Fox News<\/a> on Tuesday, claiming that there are no \u2018pots of money\u2019 to fund SNAP while the shutdown continues.<\/p>\n<p>\u201cOne hundred percent unequivocally, USDA does not have the $9.2 billion that it would require,\u201d Sec. Rollins said. \u201cThere are not just pots of $9.2 billion sitting around.\u201d\n<\/p>\n<p>She went on to pivot to a Republican talking point of blaming Democrats for the shutdown, saying \u201cshame on\u201d the blue states, like New York, for pursuing the lawsuit over pressuring their elected officials to vote to reopen the government.<\/p>\n<p>Likewise, a USDA spokesperson blamed Senate Democrats for the impending SNAP funding freeze, describing it as a pivotal moment for Senate Democrats.\n<\/p>\n<p>\u201cContinue to hold out for the Far-Left wing of the party or reopen the government so mothers, babies, and the most vulnerable among us can receive timely WIC and SNAP allotments,\u201d a USDA spokesperson said in a statement to amNewYork.\u00a0<\/p>\n<p><a href=\"https:\/\/www.facebook.com\/senschumer\/videos\/695514523142747\/?rdid=ZTzIJqlzyGGoyGl6#\" target=\"_blank\" rel=\"noopener nofollow\">Earlier Tuesday<\/a>, Senate Minority Leader Chuck Schumer accused the Trump administration of manufacturing the impending hunger crisis for millions, saying the president had ordered the USDA to rip up its own contingency plan in order to get Democrats to fold and pass a \u201cRepublican CR (continuing resolution) that has zero bipartisan input\u201d and does nothing to renew Affordable Care Act tax credits set to expire at the end of the year.<\/p>\n<p>\u201cIsn\u2019t that a disgrace? He is using hungry kids, hungry parents, and hungry veterans as hostages. It\u2019s cruel,\u201d Schumer said. \u201cThere is somewhere around five billion dollars in emergency funds that could be used right now to ensure parents and kids don\u2019t go hungry when SNAP runs out this Saturday.\u201d<\/p>\n<p>\u201cThe USDA said weeks ago that contingency funds were available to fund participant benefits.
