{"id":206450,"date":"2026-04-22T20:51:38","date_gmt":"2026-04-22T20:51:38","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/206450\/"},"modified":"2026-04-22T20:51:38","modified_gmt":"2026-04-22T20:51:38","slug":"incumbent-queens-assembly-member-heads-to-court-as-signature-fraud-allegations-mount-in-primary-fight","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/206450\/","title":{"rendered":"Incumbent Queens Assembly member heads to court as signature fraud allegations mount in primary fight"},"content":{"rendered":"<p>A bitter ballot fight in a Queens Democratic primary is set to move to court Thursday as incumbent Assembly Member Jenifer Rajkumar faces a court challenge alleging forged signatures were used to secure her place on the June ballot.<\/p>\n<p>A Board of Elections clerks\u2019 review found that Rajkumar submitted 2,558 signatures for the Democratic primary in the 38th Assembly District and retained 1,494 valid signatures after 1,064 were invalidated on ordinary election-law grounds. The threshold for ballot access is 500 signatures.<\/p>\n<p>But the same clerks\u2019 report also said 1,168 forgery objections were \u201cnot ruled upon for lack of jurisdiction,\u201d leaving the central fraud claims unresolved as the dispute heads before a judge.<\/p>\n<p>The <a href=\"https:\/\/iapps.courts.state.ny.us\/nyscef\/DocumentList?docketId=YJCOP_PLUS_tKacMpA7ER_PLUS_iIY2A==&amp;display=all&amp;courtType=Queens%20County%20Supreme%20Court&amp;resultsPageNum=1\" target=\"_blank\" rel=\"noopener nofollow\">court challenge<\/a> came from Rajkumar\u2019s challenger, David Orkin, a member of the New York City chapter of the Democratic Socialists of America, who is seeking to invalidate her designating petition and block her name from appearing on the Democratic primary ballot.<\/p>\n<p>Orkin\u2019s petition alleges that Rajkumar\u2019s filing was invalid for multiple reasons, including insufficient valid signatures, altered dates and witness statements, unregistered or out-of-district signers, and what they describe as multiple forged signatures.<\/p>\n<p>The petition identifies nine specific signatures that it says were forged and argues that the problem extended well beyond those examples. It names seven subscribing witnesses and alleges that fraud permeated the petition pages they handled, which the filing claims account for more than 70% of the submitted signatures.<\/p>\n<p>A Queens Supreme Court judge signed an order to show cause on April 17, allowing the case to proceed on an expedited basis. The order directed the Board of Elections to make related records available and expressly allowed petitioners to submit additional evidence on fraud, forgery, candidate ineligibility, and other alleged illegality.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-137844978\" src=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2026\/04\/Screenshot-2026-04-22-160310.jpg\" alt=\"\" width=\"700\" height=\"454\" title=\"Incumbent Queens Assembly member heads to court as signature fraud allegations mount in primary fight 2\"  \/>DSA member David Orkin is primarying AM Jenifer Rajkumar in the 38th Assembly District. Photo via David4Queens Instagram.<\/p>\n<p>The clash has also produced dueling public statements from the two campaigns.<\/p>\n<p>Rajkumar, in a social media post and in a subsequent campaign statement, accused \u201cthe socialists\u201d of waging a campaign of hate against her and said the clerks\u2019 report showed she had three times the number of signatures needed to qualify. Her campaign called the fraud allegations false and politically motivated. She has represented the district since 2021 and is the first South Asian woman ever elected to the New York State Legislature.<\/p>\n<p>Orkin\u2019s campaign said it found \u201coverwhelming evidence of fraudulent petition signatures\u201d after reviewing Rajkumar\u2019s ballot access petitions and said supporters discovered their names on petition sheets with signatures they said were fake.<\/p>\n<p>After the clerks\u2019 report was issued, the campaign argued that Rajkumar was misleading voters by suggesting the matter had been resolved, saying the Board review addressed technical defects but not fraud.<\/p>\n<p>The clerks\u2019 report shows that the largest categories of invalidated signatures were voters not enrolled in the Democratic Party, voters who were not registered, and voters who lived outside the district.<\/p>\n<p>Even after those invalidations, Rajkumar remained comfortably above the ballot threshold unless the court throws out a substantial number of additional signatures based on the forgery allegations.\n<\/p>\n<p>In a statement, a spokesperson for Rajkumar claimed that the DSA \u201cgot crushed in the field\u201d and was now \u201cembarrassing themselves in court,\u201d calling the case a \u201cfrivolous, bad-faith lawsuit\u201d and \u201ca political setup by DSA.\u201d<\/p>\n<p>The spokesperson argued that the challenge was an effort to \u201cmanufacture a scandal\u201d out of the nine signatures specifically identified in Orkin\u2019s petition out of the more than 2,600 signatures Rajkumar submitted overall, and said voters would reject what the campaign described as desperate tactics.<\/p>\n","protected":false},"excerpt":{"rendered":"A bitter ballot fight in a Queens Democratic primary is set to move to court Thursday as incumbent&hellip;\n","protected":false},"author":2,"featured_media":206451,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[37],"tags":[81863,80693,9,24,63,122,124,123],"class_list":{"0":"post-206450","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-queens","8":"tag-assembly-member-jenifer-rajkumar","9":"tag-david-orkin","10":"tag-new-york","11":"tag-new-york-city","12":"tag-nyc","13":"tag-queens","14":"tag-queens-headlines","15":"tag-queens-news"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/posts\/206450","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/comments?post=206450"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/posts\/206450\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/media\/206451"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/media?parent=206450"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/categories?post=206450"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/tags?post=206450"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
