New York City<\/a> Mayor Zohran Mamdani on Friday announced an offensive to protect homeowners from the rising tide of fraud<\/a>: the creation of the city\u2019s first-ever Office of Deed Theft Prevention<\/a> and an immediate six-month moratorium on tax lien sales. The move aims to halt the loss of generational wealth in neighborhoods<\/a> most at risk.<\/p>\n

His announcement comes in the immediate wake of the high-profile arrest of Councilmember Chi Oss\u00e9 earlier this week. Oss\u00e9 was taken into custody while protesting the eviction of Carmella Charrington, a 54-year old Bed-Stuy<\/a> resident and victim of an alleged deed theft.<\/p>\n

Mamdani, who campaigned on housing justice for both renters and homeowners<\/a>, framed the new office as a direct answer to the “scourge”<\/a> highlighted by that standoff.<\/p>\n

“Deed theft not only disproportionately robs Black and Brown New Yorkers of their homes, it also robs them of the stability that a home provides,\u201d Mayor Mamdani said at the Brooklyn Bank in Bed-Stuy.<\/p>\n

New York City recorded 517 deed theft complaints in 2025\u2014a more-than-threefold increase from the 149 cases reported in 2023, according to data from Attorney General Letitia James.<\/p>\n

The new office, led by veteran housing attorney Peter White, will be housed in the Department of Finance to coordinate enforcement and provide legal resources to vulnerable owners.<\/p>\n

Attorney General James, who was present at the announcement, framed the mayor\u2019s actions as a critical step in protecting the generational wealth of some of the city\u2019s most vulnerable homeowners.<\/p>\n

“We are witnessing a disturbing rise in the number of housing scams,\u201d she said, \u201cparticularly scams like deed theft that target Black and Brown neighborhoods, homeowners in gentrifying neighborhoods.”<\/p>\n

Recent research from Realtor.com\u00ae<\/a> has highlighted the wealth-building power of homeownership<\/a>: While homeowners historically hold 30 to 50 times the net worth of renters, homeownership rates for Black and Hispanic families continue to lag behind those of white households.<\/p>\n

In addition to deed theft, the speakers highlighted the threat of tax lien sales:<\/a> a process where the city sells unpaid property tax and water debts to private investors who can then charge high interest rates and eventually foreclose on the home.<\/p>\n

Critics have long denounced the practice as predatory, arguing it effectively strips homeowners of their equity through a shadow theft process<\/a>. New York<\/a> remains one of only five states where the legal hurdles to reclaiming home equity are so onerous that many residents are forced to walk away with nothing.<\/p>\n

Take the case of Filmore Brown, a longtime Brooklyn homeowner. Brown\u2019s nightmare began with a missed $600 water bill<\/a>. Under the city\u2019s tax lien system, that minor debt was sold to a private trust and spiraled through interest and fees into a $20,000 liability.<\/p>\n

Brown was reportedly unaware of the debt until after his deed was auctioned and he faced eviction. He ultimately lost the home he purchased for $240,000 in 1996\u2014a property he had already paid off and was valued between $800,000 and $1 million.<\/p>\n

James also highlighted the threat of partition sales, also known as heirs disputes or heirs property, wherein bad actors buy out the interest of a single family member (often for a fraction of its value) and then use that small stake to legally force a court-ordered sale of the entire family home.<\/p>\n

This tactic, which James described as part of the same “playbook of confusion” as deed theft, often targets families who have inherited property without a clear will in the haze of grief.<\/p>\n

Co-owners can sue for partition to get their share of the equity, allowing speculators to displace an entire family\u2014including seniors who have lived there for decades\u2014simply by acquiring the rights of one distant or disgruntled heir.<\/p>\n

Today, there is an estimated $32.3 billion at risk of heirs disputes<\/a> across the country\u2014most of which is concentrated in the rural South.<\/p>\n

What the new office will do<\/p>\n

The new office amounts to the city’s first dedicated operational hub to centralize the fight against property fraud. Councilmember Oss\u00e9 framed the move as the mayor \u201cputting money where his mouth is,\u201d taking direct action where past administrations had remained idle.<\/p>\n

Speaking at the announcement, White outlined the strategy his new office will take.<\/p>\n

“This office will focus on three central tenets. Number one, deed fraud identification. Number two, deed fraud prevention. And number three, deed fraud correction and remediation,\u201d White explained.<\/p>\n

While the city acts locally, the speakers were adamant that the crisis remains a state-level battle.<\/p>\n

James and Public Advocate Jumaane Williams called directly on Gov. Kathy Hochul and Secretary of State Walter Mosley to use their executive authority to sign a moratorium on unsolicited real estate solicitations by designating all of Central Brooklyn as a cease-and-desist zone.<\/p>\n

This legal designation would prohibit real estate brokers and speculators from making unsolicited contact with homeowners. It effectively creates a no solicitation list for neighborhoods, barring the door-to-door canvassing and mass mailers that scammers use to exploit vulnerable residents.<\/p>\n

“The secretary of state today\u2014today, with a pen\u2014can designate districts, particularly in Central Brooklyn, as cease-and-desist zones,” James said. “We must save homes.
