A man who was punched repeatedly inside a Brooklyn liquor store by two NYPD narcotics detectives<\/a> who mistook him for a drug suspect has filed a legal claim against the city.<\/p>\n

In a notice of claim filed with the city\u2019s comptroller\u2019s office, attorneys for Timothy Brown allege he was the victim of assault, battery, false imprisonment and a laundry list of other violations at the hands of Brooklyn North Narcotics Dets. Volkan Maden and Michael Algerio<\/a> during his arrest on April 14.<\/p>\n

The claim further accuses Maden and Algerio of violating NYPD policy by failing to record the arrest<\/a> inside BK Wine Depot in Gowanus using body-worn cameras.<\/p>\n

Brown, a licensed security guard and home health aid, had recently clocked out from work and was going to purchase wine from the store on Hoyt St. near Baltic St. when the detectives approached him around 4 p.m., according to the legal filing.<\/p>\n

The cops seized Brown and battered him in an assault that lasted roughly eight minutes, during which they repeatedly punched him in the face, slammed him into a refrigerator door and dragged him across a floor strewn with broken glass, the claim reads.<\/p>\n

Brown, who repeatedly told the detectives, \u201cI\u2019m not resisting,\u201d suffered cuts and a black eye in addition to leg injures that resulted in permanent scarring and required him to walk with a cane.<\/p>\n

The detectives were participating in an undercover narcotics operations when they mistook Brown for a man seen taking money from a drug dealer, who had sold crack to an undercover cop near the liquor store, NYPD officials have previously said.<\/p>\n

Surveillance video from inside the store that later emerged shows the run-up to the takedown \u2014 the detectives, wearing NYPD vests, flank Brown, as they speak to him briefly, then try to place him in handcuffs. Maden takes thee wine bottle from him and the officers reach for his wrists but Brown resists and yanks his arms back, the video shows.<\/p>\n

After that, each cop grabs one of Brown\u2019s arms as they place him against a refrigerated case. Brown again pulls his hands away from the cops before Maden starts punching him. As they continue to struggle, Maden pushes Brown\u2019s head into a glass refrigerator door as both cops repeatedly hit him.<\/p>\n

Brown was charged with resisting arrest and obstructing governmental administration. The Brooklyn District Attorney\u2019s office quickly dropped both charges.<\/p>\n

Brown has also accused the narcotics unit that mistakenly targeted him of a pattern of misconduct, which allegedly includes the wrongful arrest of another man during the same operation.<\/p>\n

After cell phone video taken by an outraged witness went viral a day later, NYPD Commissioner Jessica Tisch announced on social media<\/a> that both Maden and Algerio had been placed on modified duty and stripped of their guns and badges. Mayor Mamdani called the videos \u201cdeeply disturbing and unacceptable.\u201d<\/p>\n

In the aftermath of the video, the NYPD transferred a captain, a lieutenant, and six Brooklyn Narcotics detectives who made up the team that ran the botched buy-and-bust operation .<\/p>\n

The heads of several police unions pushed back against the mayor\u2019s comments.<\/p>\n

\u201cThe mayor\u2019s words matters,\u201d said Patrick Hendry, president of the Police Benevolent Association. \u201cHe should not publicly prejudge any incident involving police officers.\u201d<\/p>\n

\u201cNYPD detectives put their lives on the line daily, doing the dangerous work politicians would never have the courage to do,\u201d said Scott Munro, president of the Detectives Endowment Association. \u201cNarcotics detectives arrest you and tell you to put your hands behind your back and [you] don\u2019t comply, what do you think happens? We deserve all the facts before anyone rushes to judgment.\u201d<\/p>\n

The NYPD is conducting a 90-day review of the department\u2019s narcotics bureau to determine whether changes to policy, training and equipment are necessary in wake of Brown\u2019s arrest.<\/p>\n
