Moore was arrested May 7 and was presented the same day before U.S. Magistrate Judge Valerie Figueredo. The case has been assigned to U.S. District\u00a0Judge Richard M. Berman.<\/p>\n<p>\u00a0<\/p>\n<p>The announcement was made by Jay Clayton, U.S. attorney for the Southern\u00a0District of New York, James C. Barnacle, Jr., assistant director in charge of the FBI\u2019s New York field office, and NYC Police Commissioner Jessica S. Tisch, who said the defendant, who is already\u00a0serving a federal sentence at a residential reentry facility, violently attacked a gay man based on the victim\u2019s sexual orientation. <\/p>\n<p>\u00a0<\/p>\n<p>\u201cBias-motivated crimes tear at the fabric of society, and the NYPD will never tolerate hate of any kind in our city,\u201d she said. \u201cI thank our NYPD investigators, our partners at the FBI, and the U.S. Attorney\u2019s Office for the Southern\u00a0District for their work in this case, for their efforts to bring this criminal to justice.\u201d<\/p>\n<p><a href=\"https:\/\/www.norwoodnews.org\/wp-content\/uploads\/2026\/05\/Screenshot-2026-05-08-203713.png\" rel=\"nofollow noopener\" target=\"_blank\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-131633 size-large\" src=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2026\/05\/Screenshot-2026-05-08-203713-1024x401.png\" alt=\"\" width=\"1024\" height=\"401\"  \/><\/a>HATE CRIMES (CITYWIDE) April 2025 and April 2026 comparison <br \/>Source: NYPD<\/p>\n<p>For his part, Clayton said, \u201cAll New Yorkers deserve to live in their communities free from hate-fueled violence. Hate undermines all that we hold dear in New York, including providing opportunity to all. No one should be targeted because of their sexual orientation.\u201d He added, \u201cThis Office, working with our state and federal law enforcement partners, will always protect New Yorkers from hateful, violent crimes.\u201d<\/p>\n<p>\u00a0<\/p>\n<p>According to the allegations in the indictment and other public filings on April 1, Moore was serving a term of imprisonment for narcotics trafficking at a Federal Bureau of Prisons residential reentry center in The Bronx, and on that day, while standing outside a Bronx deli located on White Plains Road, he yelled anti-gay slurs and statements, including that gay people should \u201cget off the block\u201d before assaulting a gay victim with his fist, a recycling bin, and a plastic crate.<\/p>\n<p>\u00a0<\/p>\n<p>Norwood News asked the Office of U.S. Attorneys for the Southern District of New York where on White Plains Road the referenced deli was located. We also asked for a bit more clarification surrounding Moore\u2019s term of imprisonment for narcotics trafficking at the Federal Bureau of Prisons residential reentry center in The Bronx to better understand how he happened to be in the vicinity of the deli at the time the incident occurred. We did not get an immediate response but will share any feedback we receive.<\/p>\n<p>\u00a0<\/p>\n<p>Moore is charged with one count of committing a hate crime, which carries a maximum sentence of 10 years in prison. He is presumed innocent unless and until convicted in a court of law.\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>The maximum potential sentence in this case is prescribed by Congress and provided for informational purposes only, as any sentencing of the defendant will be determined by the judge.<\/p>\n<p><a href=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2026\/05\/Screenshot-2026-05-08-203651.png\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-131634 size-full\" src=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2026\/05\/Screenshot-2026-05-08-203651.png\" alt=\"\" width=\"660\" height=\"422\"  \/><\/a>HATE CRIME STATISTICS April 2026 by targeted category <br \/>Source: NYPD<\/p>\n<p>Clayton praised what he described as the outstanding investigative work of the FBI and the NYPD. The prosecution of the case is being handled by the Office of the U.S. Attorney\u2019s for the Southern District of New York\u2019s civil rights and human trafficking unit within the criminal division.
