{"id":23182,"date":"2025-10-30T21:35:09","date_gmt":"2025-10-30T21:35:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/23182\/"},"modified":"2025-10-30T21:35:09","modified_gmt":"2025-10-30T21:35:09","slug":"nyc-landlords-who-harass-tenants-could-get-7-years-in-prison-under-da-bragg-backed-bill","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/23182\/","title":{"rendered":"NYC landlords who harass tenants could get 7 years in prison under DA Bragg-backed bill"},"content":{"rendered":"<p>New York City landlords who make life hell for their rent-regulated tenants could spend up to seven years behind bars if <a href=\"https:\/\/legislation.nysenate.gov\/pdf\/bills\/2025\/S8559\" rel=\"nofollow noopener\" target=\"_blank\">a new bill co-sponsored by Manhattan District Attorney Alvin Bragg<\/a> becomes law.<\/p>\n<p>At a press conference Thursday, the DA announced<a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2025\/S8559\" rel=\"nofollow noopener\" target=\"_blank\"> newly proposed state legislation<\/a> that would allow prosecutors to charge landlords with Class D felonies if they engage in aggravated harassment against rent-regulated tenants to induce them to move out so owners can raise the rent.<\/p>\n<p>Bragg said he was getting behind the bill because the city\u2019s worsening housing crisis was a matter of public safety.<\/p>\n<p>\u201cIt exacerbates power asymmetries between landlords and tenants, and in various parts of our practice, where substantial power asymmetries exist, criminal activity often follows, with people targeting vulnerable populations for profit,\u201d the DA said.<\/p>\n<p>\u201cAs New Yorkers, we\u2019ve all heard horror stories of extreme forms of tenant harassment, especially against rent-regulated tenants. By making conditions unlivable, bad actors hope that rent-regulated tenants will just pack up and go.\u201d<\/p>\n<p>Currently, landlords who harass two tenants in one building face the same potential punishment as landlords who harass 10 tenants across 10 buildings \u2014 a Class E felony carrying a maximum of four years, with no minimum prison term.<\/p>\n<p>The proposed legislation would create a new Class D felony, aggravated harassment of a rent-regulated tenant, carrying a maximum prison term of seven years. It would target landlords who engage in a \u201csystematic ongoing course of conduct\u201d across several properties, as well as landlords who reoffend after being convicted of harassing their tenants under current law.<\/p>\n<p>Landlords whose conduct \u201cimpairs the habitability\u201d of a tenant\u2019s rent-regulated unit, or who create or maintain conditions that endanger tenants\u2019 health and safety, or who disturb tenants\u2019 \u201ccomfort, repose, peace or quiet,\u201d could face arrest on Class D felonies, <a href=\"https:\/\/legislation.nysenate.gov\/pdf\/bills\/2025\/S8559\" rel=\"nofollow noopener\" target=\"_blank\">the proposed bill details<\/a>.<\/p>\n<p>Bragg, state Sen. Brian Kavanagh (D-Manhattan), who heads the Senate Housing Committee, and Democratic Assemblyman Micah Lasher, who represents parts of upper Manhattan, <a href=\"https:\/\/legislation.nysenate.gov\/pdf\/bills\/2025\/S8559\" rel=\"nofollow noopener\" target=\"_blank\">introduced the bill in Albany<\/a> on Wednesday.<\/p>\n<p>\u201cThe landmark Housing Stability and Tenant Protection Act of 2019 eliminated the loopholes that allowed rent-regulated tenants to be legally displaced through exorbitant rent increases and deregulation,\u201d Kavanagh said Thursday.<\/p>\n<p>\u201cUnfortunately, some unscrupulous landlords continue to employ harassment and other illegal means as they attempt to drive tenants out of their buildings.\u201d<\/p>\n<p>If the bill becomes law, the Manhattan <a href=\"https:\/\/manhattanda.org\/victim-resources\/housing-tenant-protection\/\" rel=\"nofollow noopener\" target=\"_blank\">DA\u2019s Housing &amp; Tenant Protection Unit<\/a> will handle the cases.
