New York City \u2014 A handful of Staten Island residents have challenged their Congressional District lines, arguing the current map dilutes minority voting strength. <\/p>\n
The 11th Congressional District is currently held by Republican Nicole Malliotakis, and a seat Democrats are hoping to flip in the 2025 midterm elections. <\/p>\n
Jeffrey Wice, Distinguished Adjunct Professor New York Law School, and of N.Y. Elections, Census & Redistricting Institute, says this lawsuit is unique, in that it’s invoking the State Voting Rights Act of 2022. <\/p>\n
“That applies to counties, towns, villages and school boards, and they’re trying to apply the different standards in the state law applicable to localities to the Congressional plan, because they have similar wording, similar intent, similar purpose. So it’s a very novel approach, but it’s one where this is going to have to go through the motions to see how far it gets,” he says.<\/p>\n
While there’s been pushes, and legislation proposed, to allow for New York to redraw the entire map mid-decade, Wice says if the judge allows a redraw in this case, it would only apply to NY-11. The entire map was challenged in 2022, and redrawn in 2024.<\/p>\n
CBS6 asked: “What’s the difference between that and now?”<\/p>\n
Jeff Wice: “Well, in 2022 the legislature in drawing a map that the courts rejected, arguably targeted for Republican districts for elimination, and the court undid that. The legislature modified the map in 2024 and won those four seats back, but passed a plan through the legislature with bipartisan support, so everybody was happy. Here we have a situation where they’re using this novel approach of using the State Voting Rights Act as a wedge to get a State Constitutional violation in one district. Because, you know, the Republicans going after one district in Missouri, in Indiana, Democrats are looking at one district in Virginia, maybe one district in Maryland. It’s getting down to try to find as many districts, if it’s a one on one, as the parties can, to fight this out fight that might take us all the way till the next census in 2030.”<\/p>\n
Wice added that the process would need to move quickly, and if the judge does allow a redraw of NY-11, Republicans are expected to appeal. <\/p>\n
