COURTHOUSE,
\n May 22 – A man who was charged
\n in The Bronx with two 2021
\n murder and then found not
\n guilty in a less than two week
\n trial there now faces a
\n Federal trial for the same
\n murders, starting on September
\n 14.\u00a0\u00a0 <\/p>\n

On April 28 U.S.
\n District Court for the
\n Southern District of New York
\n Senior Judge Colleen McMahon
\n held a conference. Inner City
\n Press was there.\u00a0 <\/p>\n

\u00a0 The US
\n Attorney’s Office on April 21
\n wrote in that the Acting
\n Attorney General, Todd
\n Blanche, directed that the
\n death penalty not be sought.
\n Still, there is learned
\n counsel on the
\n case.\u00a0\u00a0 <\/p>\n

The AUSA, who has
\n said he is on two other
\n death-eligible cases in SDNY,
\n asked that the 3500 material
\n be attorneys-eyes-only until a
\n week before trial. He said the
\n witnesses live where the
\n defendant does – or did. He is
\n now in detention, awaiting
\n trial.\u00a0 <\/p>\n

On May 8 the US
\n Attorney’s Office wrote in
\n asking Judge McMahon to
\n reconsider her order they
\n produce 3500 material by
\n August 21, arguing politely
\n that she does not have the
\n authority, and that “the
\n Government’s witnesses did not
\n testify at the state trial,”
\n that safety is implicated.<\/p>\n

On May 22 defense
\n could filed a letter motion
\n seeking to suppress everything
\n found in the NYPD search of
\n 1243 Findlay Avenue, saying
\n the warrant omitted
\n “materially different
\n clothing.”<\/p>\n

\n USA v. Savage, 1:25-cr-472
\n (McMahon)<\/p>\n
