New York State the Unified Court System<\/p>\n<p><a href=\"https:\/\/www.imdb.com\/name\/nm10872562\/bio\/\" target=\"_blank\" rel=\"noopener nofollow\">The Dominican Republic-born<\/a> model-actress stuck simple, classy poses with her arms to her side and a neutral expression as she starred into the camera. <\/p>\n<p>But the finalized ads were drastically different and AI generated \u2014 <a href=\"https:\/\/nypost.com\/2026\/03\/28\/us-news\/ai-porn-star-twins-chat-with-fans-and-make-custom-erotic-material\/\" rel=\"nofollow noopener\" target=\"_blank\">placing her doppelganger<\/a> in sex-up poses and different settings \u2014 the lawsuit alleged.<\/p>\n<p>Pujols, 28, who\u2019s strutted down the runway at New York Swim Week and posed on the cover of Canada-based fashion magazine Vigour, alleged the ads ran after the contract expired.<\/p>\n<p>In one of the hyper-realistic created images, Pujols\u2019 AI twin, wearing a light brown skirt and a dark brown cropped top with a cheetah print collar, seductively lays on another woman\u2019s lap while holding a cocktail. <\/p>\n<p>In another, the clone wears a mini denim skirt and a white top with her legs spread wide over a barstool. She holds a camera over her eye with one hand and a drink in the other.\u00a0<\/p>\n<p>The lawsuit argued this particular pictures\u2019 \u201ccrudeness\u201d is wrecking Pujols\u2019 reputation as a high-end model.<\/p>\n<p>Pujols especially took issue with an AI-altered image with her legs spread open over a barstool. New York State the Unified Court System<\/p>\n<p>The contract allegedly allowed for Rainbow to make minor tweaks to the photos, including cropping and \u201cstylistic alterations\u201d \u2014 not to create new ones.<\/p>\n<p>The lawsuit explains that Pujols \u201cdid not consent to any use of her name, portrait, picture or likeness \u2014 including any AI-generated or AI-altered depictions\u201d after the contract was up. <\/p>\n<p>Pujols, who lives in Manhattan, sent Rainbow a cease and desist in March, but it allegedly hasn\u2019t stopped the brand from using them on its website, digital ads and in stores.\u00a0 <\/p>\n<p>Rainbow\u2019s allegedly brazen move means Pujols \u2014 who starred in Amazon Prime series \u201cHood Deals\u201d and feature film \u201cWhat Happened at 625 River Road?\u201d \u2014 is missing out on licensing fees and that her professional image is being tarnished, the suit alleges.\u00a0 <\/p>\n<p>The since-dropped lawsuit accused Rainbow of violating a contract with Pujols and creating AI content using her likeness. Rice for NY Post<\/p>\n<p>Pujols demanded a jury trial, accusing Rainbow of defamation, misappropriation, false endorsement and violation of New York\u2019s Right of Privacy Law, which protects people\u2019s names and likenesses from being misused for advertising.\u00a0<\/p>\n<p>Rainbow fiercely denied any wrongdoing. <\/p>\n<p>\u201cWe used our images properly and there\u2019s no violation of her rights,\u201d a spokeswoman for the legal department said.<\/p>\n<p>Pujols dropped the lawsuit Friday and declined to comment when The Post reached out. <\/p>\n<p>It is unclear if Pujols and Rainbow have reached a settlement, but her lawyer Richard Altman said the parties are \u201cseeking to resolve this matter privately.\u201d <\/p>\n<p>One of the AI-generated ads placed Pujols laying on another woman\u2019s lap. New York State the Unified Court System<\/p>\n<p>Beyond Pujols case, AI has unleashed chaos onto the modeling world, experts told The Post.\u00a0<\/p>\n<p>\u201cSometimes technology advances so quickly that the laws are just not able to capture the spirit of the wrong that\u2019s occurring,\u201d Joshua R. Bressler, a strategic business attorney who specializes in intellectual property, said. <\/p>\n<p>\u201cThese issues are coming fast and furious. We\u2019re very much in the throes of sorting all this out.\u201d <\/p>\n<p>Model advocacy nonprofit Modeling Alliance has championed the New York Fashion Workers Act, a state law which will take effect on June 19.\u00a0  <\/p>\n<p>The law will tighten up consent requirements, giving models more power over content featuring them in the age of AI.\u00a0<\/p>\n<p>Pujols\u2019 likeness, left, was modeled in a field with another woman in one of the allegedly unauthorized ads. New York State the Unified Court System<\/p>\n<p>The act will require the model\u2019s written consent for \u201cdigital replicas\u201d before agencies and companies can clone them for content. <\/p>\n<p>Attorney Anthony Lupo, the chairman of ArentFox Schiff, told The Post that AI will soon replace most clothing catalogue models.<\/p>\n<p>\u201c[AI is] going to gut the modeling industry,\u201d Lupo, dubbed the \u201cfather of fashion law\u201d by Forbes, said.<\/p>\n<p>Lupo, who works with high-fashion giants including Yves Saint Laurent, Jimmy Choo and Valentino, explained that especially in the world fast-fashion, customers \u201cdon\u2019t care\u201d who the models are.<\/p>\n<p>\u201cYou\u2019re always going to have supermodels, you\u2019re always going to have runway shows, you\u2019re going to have anything where you\u2019re spending major money,\u201d he said. <\/p>\n<p>\u201cBut that accounts for 15% of what companies do. The other 85% is just day to day, \u2018I need somebody to wear this.\u2019<\/p>\n<p>\u201cThe less established models are going to have real problems making a living just doing modeling.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"It\u2019s the attack of the clones!
