It has since expanded into other states and is one of the four political parties that appear on the ballot in the Empire State.

New York’s fusion voting system allows candidates to appear on multiple ballot lines, creating opportunities for so-called spoiler candidates.

Article continues below this ad

For decades, both Republicans and Democrats have run spoiler candidates on the Working Families Party line. Those are candidates who may obtain enough signatures to secure a ballot line, but do not actively campaign. Even without a campaign, many voters will select those candidates based on their party affiliation but without knowing they are only on the ballot to pull votes from other candidates.

The Working Families Party was involved in crafting the bill. They brought it to Levenberg, who believed it would halt ballot line hijacking because it could allow the party to intervene during the petitioning process.

The legislation was prompted, in part, by the 2024 race in New York’s 17th Congressional District, where Anthony Frascone secured the Working Families Party ballot line against Democratic candidate Mondaire Jones. Party officials accused Republicans of backing Frascone to siphon votes. He received 2% of the vote in a race Jones lost by 6%.

Gripper said the Frascone race underscored the need for more control over the party’s ballot line.

Article continues below this ad

Assembly Republicans opposed the bill, arguing it shifted power to state party leaders and expulsions over ideology.

Burns shares that criticism.

“Many New Yorkers, they would assume these were trials over someone’s personal beliefs, trials over somebody’s philosophy and what constitutes a Working Families Party in good or bad standing,” said Burns, who is now a partner with Holtzman Vogel, a political, regulatory and litigation firm.

Why the new law may be ineffective

Kenny switched from the Conservative Party shortly before running on the Working Families Party line.

Article continues below this ad

Kenny, who refused to agree to an in-person or telephone interview, has denied allegations that he is a sham candidate.
