{"id":25526,"date":"2025-11-02T00:04:09","date_gmt":"2025-11-02T00:04:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/25526\/"},"modified":"2025-11-02T00:04:09","modified_gmt":"2025-11-02T00:04:09","slug":"house-republicans-exploring-ways-to-prevent-mamdani-from-being-sworn-in-as-nyc-mayor","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/25526\/","title":{"rendered":"House Republicans exploring ways to prevent Mamdani from being sworn in as NYC mayor"},"content":{"rendered":"<p>House Republicans are exploring ways to prevent <a href=\"https:\/\/nypost.com\/us-news\/who-is-zohran-mamdani\/\" rel=\"nofollow noopener\" target=\"_blank\">Zohran Mamdani<\/a> from ever being sworn in as mayor even if he <a href=\"https:\/\/nypost.com\/2025\/10\/28\/us-news\/zohran-mamdani-can-win-mayoral-election-despite-new-yorkers-disagreeing-with-progressive-points-poll\/\" rel=\"nofollow noopener\" target=\"_blank\">prevails in Tuesday\u2019s election<\/a> by using the Constitution\u2019s \u201cinsurrection clause,\u201d The Post has learned.<\/p>\n<p>The New York Young Republican Club is pushing to prevent the NYC mayoral frontrunner from taking the oath of office Jan. 1 under an idea <a href=\"https:\/\/nypost.com\/2025\/07\/21\/us-news\/new-york-young-republican-club-pushing-congress-to-disqualify-zohran-mamdani-from-becoming-nyc-mayor\/\" rel=\"nofollow noopener\" target=\"_blank\">floated this summer<\/a>.<\/p>\n<p>It cites language in the post-Civil War 14th Amendment to the Constitution barring from office anyone who\u00a0\u201cengaged in insurrection or rebellion\u201d\u00a0or who has \u201cgiven aid or comfort to the enemies.\u201d The group argues that Mamdani\u2019s own statements calling to resist ICE could violate the prohibition.<\/p>\n<p>House Republicans are looking at proposed legislation what would try to bar Zohran Mamdani (pictured) under the Constitution\u2019s \u201cinsurrection clause\u2019 Getty Images<\/p>\n<p>\u201cThere is a real and legitimate push to see the insurrectionist Zohran Mamdani either a) removed from the ballot or b) removed from office if he is to win on Tuesday,\u201d Stefano Forte, president of the New York Young Republicans, told The Post.<\/p>\n<p>Republican lawmakers are keyed in on the idea and are considering rolling out legislation on it once the government shutdown ends, sources told The Post.<\/p>\n<p>It\u2019s the same provision Colorado used to try to kick Trump off the ballot last year, only to get slapped down by the Supreme Court. The high court ruled that it was up to Congress to enforcement the amendment, giving majority Republicans a chance to test their authority.<\/p>\n<p>Proponents would like to see a congressional vote on declaring Mamdani ineligible, although that would mean getting it through the narrow 219-213 Republican House majority and overcoming a Senate filibuster should leaders decide to put it on the floor.<\/p>\n<p>It would also have to survive any court challenge to removing a popularly elected official. But it would create a political wedge that would force Democrats to vote either for or against a socialist who President Trump is eager to turn into a national foil for MAGA.<\/p>\n<p>The effort would come after the election, and only after Speaker Mike Johnson brings lawmakers back from an extended recess during the government shutdown. <\/p>\n<p>Former Trump White House chief strategist Steve Bannon predicted on his \u201cWar Room Pandemic\u201d podcast last week that Mamdani would \u201crebrand the Democratic party,\u201d in a signal of how MAGA allies plan to respond if the <a href=\"https:\/\/nypost.com\/2025\/11\/01\/us-news\/andrew-cuomo-closing-in-on-zohran-mamdani-as-nyc-mayoral-race-tightens\/\" rel=\"nofollow noopener\" target=\"_blank\">frontrunner<\/a> prevails on Tuesday.<\/p>\n<p>Republicans want AG Pam Bondi to probe Mamdani\u2019s path to citizenship AP<\/p>\n<p>Meanwhile, House Republicans are doubling down on their effort to push the Justice Department to probe Mamdani\u2019s path to citizenship.<\/p>\n<p>Rep. Andy Ogles (R-Tenn.) has goosed is own earlier campaign to prod the federal government to investigate statements the New York assemblyman made when he became a naturalized citizen in 2018. The lawmaker wrote Attorney General Pam Bondi Monday trying to spur action and urging her to \u201cuphold the integrity of its citizenship process.\u201d<\/p>\n<p>His idea has snowballed since The Post broke a story about his plan Sunday, as he booked a slew of media appearances and vowed to continue.<\/p>\n<p>\t\t\t\t\t\t\tStart your day with all you need to know\t\t\t\t\t\t<\/p>\n<p class=\"inline-module__cta\">\n\t\t\t\t\t\t\tMorning Report delivers the latest news, videos, photos and more.\t\t\t\t\t\t<\/p>\n<p>\t\t\t\t\t\tThanks for signing up!\n\t\t\t\t<\/p>\n<p>Ogles wrote the Justice Department Oct. 28, <a href=\"https:\/\/nypost.com\/2025\/10\/25\/us-news\/house-republicans-push-to-denaturalize-mamdani-over-citizenship-form\/\" rel=\"nofollow noopener\" target=\"_blank\">citing The Post\u2019s reporting<\/a> and re-upping his call to have Mamdani deported over his \u201crefusal to disavow violent anti-American rhetoric.\u201d Current law bars membership in a communist or totalitarian party for people becoming citizens.<\/p>\n<p>He accuses Mamdani, 34, of engaging in a \u201cbroader pattern of conduct inconsistent with the oath of allegiance required of new citizens.\u201d He asks AG Pam Bondi for any update on the scope of any inquiry and \u201cthe steps being taken to determine whether denaturalization proceedings are warranted.\u201d His comments were even more fiery on X, where he accused Mamdani of coming to the US from Uganda \u201cto turn America into an Islamic theocracy.\u201d<\/p>\n<p>Rep. Randy Fine (R-Fla.) accuses Mamdani of having lied on his citizenship form when he failed to disclose his membership in the Democratic Socialists of America and <a href=\"https:\/\/nypost.com\/2025\/06\/21\/us-news\/socialist-nyc-mayoral-candidate-zohran-mamdani-once-rapped-about-his-love-for-hamas-teror-funding-group-holy-land-five\/\" rel=\"nofollow noopener\" target=\"_blank\">statements in support of the \u201cHoly land five.\u201d<\/a><\/p>\n<p>\u201cNew York City falls to communism next week, and they will have nobody but themselves to blame,\u201d Fine <a href=\"https:\/\/x.com\/RepFine\/status\/1983973123503632402\" target=\"_blank\" rel=\"nofollow noopener\" data-nyp-affiliate=\"true\">posted<\/a> on X Thursday. Ogles\u2019 initial letter to DOJ also references Mamdani\u2019s comments about the group \u2013 a reference to Palestinian-Americans who led the shuttered Holy Land Foundation for Relief and Development Muslim charity. The feds shut it down in 2001 for funneling funds to terror group Hamas.<\/p>\n<p>Mamdani has claimed he is not a communist in <a href=\"https:\/\/nypost.com\/2025\/10\/26\/us-news\/zohran-mamdani-boasts-hes-a-proud-dsa-member-in-response-to-gop-citizenship-threats\/\" rel=\"nofollow noopener\" target=\"_blank\">comments to The Post<\/a>. \u201cNo matter how many times these Republican Congress members or the president of this country calls me a communist, it doesn\u2019t make it true,\u201d he said last weekend.
