{"id":271429,"date":"2026-06-18T23:20:14","date_gmt":"2026-06-18T23:20:14","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/271429\/"},"modified":"2026-06-18T23:20:14","modified_gmt":"2026-06-18T23:20:14","slug":"mangione-withdraws-emotional-disturbance-defense-in-new-york-case","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/271429\/","title":{"rendered":"Mangione Withdraws Emotional Disturbance Defense in New York Case"},"content":{"rendered":"<p class=\"css-140ip4z e1me5xab0\">Luigi Mangione\u2019s lawyers told a New York State judge on Thursday that they had withdrawn their intent to argue that their client was experiencing \u201cextreme emotional disturbance\u201d at the time he was accused of killing a UnitedHealthcare executive in Midtown Manhattan in 2024.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">The <a class=\"css-yywogo\" href=\"https:\/\/www.nycourts.gov\/LegacyPDFs\/press\/pdfs\/mangione-withdrawal.pdf\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">disclosure came one day after<\/a> the judge overseeing the case, Justice Gregory Carro, revealed at a pretrial hearing that Mr. Mangione\u2019s legal team had filed a motion last year notifying the court it was considering the defense.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">In a one-sentence letter, Mr. Mangione\u2019s lawyers wrote, \u201cThe defense respectfully withdraws CPL \u00a7 250.10 notice at this time,\u201d referring to psychiatric evidence.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">In New York, if defense lawyers can convince a jury that strong emotions resulted in a \u201cprofound loss of self-control,\u201d leading to a homicide, the highest charge their clients can be convicted of is manslaughter. Mr. Mangione faces multiple state charges, including second-degree murder. He is also facing federal charges in a separate trial.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">The developments come less than three months before the scheduled start of Mr. Mangione\u2019s trial in September.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">Mr. Mangione has pleaded not guilty to the state and federal charges.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">This is a developing story.
