What Fireworks Are Legal & Illegal in New York State?<\/p>\n

With the summer<\/a> season in full swing and the Fourth of July<\/a> right around the corner, it\u2019s that time of year when fireworks start showing up everywhere.<\/p>\n

But before you grab a sparkler or think about going bigger, here\u2019s the 411 on what\u2019s actually legal in New York State\u2014and what could land you in trouble.<\/p>\n

Sparkling Devices Only<\/p>\n

Here\u2019s the simple version: in New York State, the only fireworks <\/a>you can legally use without a permit are \u201csparkling devices.\u201d<\/p>\n

These are your handheld or ground-based items that throw off colored sparks, maybe a little colored flame, some crackling or whistling sounds, and smoke. Think sparklers, not sky-high explosions.<\/p>\n

Everything else\u2014firecrackers, bottle rockets, Roman candles, aerial shells, spinners, and M-80s\u2014is still illegal statewide. No exceptions.<\/p>\n

If you\u2019re planning ahead, there\u2019s also a pretty tight window when sparkling devices can even be sold in New York:<\/p>\n

Certified retailers can sell them from June 1 to July 5, and again from December 26 to January 2. Temporary stands have an even shorter window\u2014June 20 to July 5 and December 26 to January 2.<\/p>\n

Even if they\u2019re legal statewide in some form, not every county allows the sale or use. Several areas\u2014including Albany, Bronx, Kings, Nassau, Queens, Richmond, Suffolk, Westchester, and others\u2014have restrictions or bans in place.<\/p>\n

So depending on where you are, the rules can change fast.<\/p>\n
