{"id":275512,"date":"2026-06-23T18:07:11","date_gmt":"2026-06-23T18:07:11","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/275512\/"},"modified":"2026-06-23T18:07:11","modified_gmt":"2026-06-23T18:07:11","slug":"nypd-officer-denies-intentionally-pointing-gun-in-subordinates-face-amid-alleged-sex-harassment","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/275512\/","title":{"rendered":"NYPD officer denies \u2018intentionally\u2019 pointing gun in subordinate\u2019s face amid alleged sex harassment"},"content":{"rendered":"<p>An NYPD officer Tuesday denied \u201cintentionally\u201d <a href=\"https:\/\/www.nydailynews.com\/2026\/06\/01\/nypd-officer-pulled-gun-on-female-colleague-after-incessantly-sexually-harassing-her-lawsuit\/\" rel=\"nofollow noopener\" target=\"_blank\">pointing a loaded gun in a subordinate\u2019s face <\/a>amid an alleged campaign of sexual harassment and refused to quit the force via a no-jail plea deal.<\/p>\n<p>\u201cNot guilty, ma\u2019am,\u201d Officer Quilbvio Espinal, 35, said at his Manhattan Supreme Criminal Court arraignment when asked how he wished to plead to felony charges of second-degree menacing and one count of official misconduct stemming from <a href=\"https:\/\/www.nydailynews.com\/2026\/03\/27\/nypd-cop-busted-after-pulling-gun-on-fellow-officer-at-1pp-headquarters-sources\/\" rel=\"nofollow noopener\" target=\"_blank\">the March 26 incident<\/a> inside NYPD headquarters.<\/p>\n<p>Assistant District Attorney Jana Loeb said the alleged victim, a civilian employee, was sitting at her desk inside the Information Security Office at 1PP in lower Manhattan in the presence of another colleague when Espinal aimed his weapon at her point-blank.<\/p>\n<p>\u201cThe defendant stood up, drew his NYPD-authorized off-duty firearm, pointed it toward civilian No. 2, then slowly raised it up, in line with her body, until it was pointing at the ceiling,\u201d Loeb said. \u201cThe defendant paused with his firearm raised, and then slowly brought the firearm back down to his side, all the while keeping it pointed directly toward Civilian No. 2 across from him.\u201d<\/p>\n<p>The prosecutor said Manhattan District Attorney Alvin Bragg\u2019s office would drop the official misconduct charge if Espinal agreed to plead guilty to menacing in exchange for resigning from the NYPD, serving two years\u2019 probation with counseling, and completing 10 days of community service.<\/p>\n<p>Espinal rejected the offer.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" lazyautosizes lazyload\" alt=\"Quilbvio Espinal (center) appears in Manhattan Supreme Court Tuesday, June 23, 2026 in Manhattan, New York. (Barry Williams\/ New York Daily News)<\/p>\n<p>The alleged victim, Megan Kwan, who was not named in charging papers, reported the incident the same day, <a href=\"https:\/\/www.nydailynews.com\/2026\/03\/27\/nypd-cop-busted-after-pulling-gun-on-fellow-officer-at-1pp-headquarters-sources\/\" rel=\"nofollow noopener\" target=\"_blank\">and Espinal was arrested<\/a>. Kwan has claimed in graphic detail in a related lawsuit that the incident culminated two years of relentless sexual harassment by Espinal, who has been on the force a decade.<\/p>\n<p>The 25-year-old Kwan, who was hired in 2021 at the NYPD after an internship program,<a href=\"https:\/\/iapps.courts.state.ny.us\/nyscef\/ViewDocument?docIndex=l39cfDc1fXfonNFZd16mIw==\" rel=\"nofollow noopener\" target=\"_blank\"> alleges the officer pulled a gun on her<\/a> after she made a recommendation about a project he was working on in front of his supervisor, and he became embarrassed.<\/p>\n<p>Jumping to his feet before Manhattan Justice Felicia Mennin on Tuesday, Espinal\u2019s attorney Robert Gottlieb said he wanted to make his own \u201cstatement of facts,\u201d vociferously pushing back against the allegations in both the criminal and civil cases. He characterized correspondence between Espinal and Kwan that Kwan has described as sexual harassment as evidence of a close friendship.<\/p>\n<p>\u201cIt is so atrociously absurd because we have seen the text messages between the alleged victim here and our client, who had an incredibly close relationship for months and months,\u201d Gottlieb said.<\/p>\n<p>\u201cThis is all about money because this so-called victim has already filed a lawsuit seeking monetary damages.\u201d<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" lazyautosizes lazyload\" alt=\"Quilbvio Espinal heads into a courtroom in Manhattan Supreme Court Tuesday, June 23, 2026 in Manhattan, New York. (Barry Williams\/ New York Daily News)<\/p>\n<p>Responding to Gottlieb\u2019s statement, Mennin said that nothing could be regarded as fact unless proven at trial.<\/p>\n<p>\u201cBottom line is, it\u2019s worth nothing,\u201d the judge said.<\/p>\n<p>Mennin re-ordered Espinal to stay away from Kwan. As of June 1, he was suspended from the NYPD with pay. The NYPD did not immediately respond to a Daily News inquiry on Tuesday regarding the status of his employment.<\/p>\n<p>Outside the courthouse with his arm slung around a frowning Espinal, Gottlieb told the Daily News his client did not \u201cintentionally\u201d stick a gun in his colleague\u2019s face. He declined to elaborate, or say whether Espinal removed his weapon from its holster.<\/p>\n<p>\u201cHe never intentionally pointed a loaded gun at anybody,\u201d Gottlieb said. \u201cWe\u2019re not discussing it. Jayson Valentin, who <a href=\"https:\/\/iapps.courts.state.ny.us\/nyscef\/ViewDocument?docIndex=l39cfDc1fXfonNFZd16mIw==\" rel=\"nofollow noopener\" target=\"_blank\">she alleges participated in sexual harassment <\/a>that included the two men denigrating her over being Asian and partially deaf.
