{"id":277994,"date":"2026-06-25T16:59:09","date_gmt":"2026-06-25T16:59:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/277994\/"},"modified":"2026-06-25T16:59:09","modified_gmt":"2026-06-25T16:59:09","slug":"manhattan-da-bragg-declines-to-pursue-fourth-retrial-of-harvey-weinsteins-rape-charge","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/277994\/","title":{"rendered":"Manhattan DA Bragg declines to pursue fourth retrial of Harvey Weinstein\u2019s rape charge"},"content":{"rendered":"<p>\t\t\t\t<img width=\"1200\" height=\"800\" src=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2026\/06\/weinstein-hearing-set-aside.jpg\" class=\"crop-center wp-post-image\" alt=\"Harvey Weinstein sits at retrial of rape case in Manhattan\" decoding=\"async\" fetchpriority=\"high\"   title=\"Manhattan DA Bragg declines to pursue fourth retrial of Harvey Weinstein's rape charge 1\"\/>\t\t\t<\/p>\n<p>Harvey Weinstein appears in Manhattan Supreme Court.<\/p>\n<p>Pool photo by Curtis Means<\/p>\n<p>A month after a Manhattan judge <a href=\"https:\/\/www.amny.com\/law\/harvey-weinstein-rape-case-manhattan-jury-deadlocks-judge-declares-mistrial-in-third-rape-prosecution\/\" rel=\"nofollow noopener\" target=\"_blank\">declared a mistrial in Harvey Weinstein\u2019s third rape trial,<\/a> <a href=\"https:\/\/manhattanda.org\" target=\"_blank\" rel=\"noopener nofollow\">Manhattan District Attorney Alvin Bragg<\/a> announced that he would not pursue the same charges against the media mogul a fourth time.<\/p>\n<p>Bragg said that he had discussed the matter with Jessica Mann, the actress and hairstylist who alleged that Weinstein raped her in a Manhattan hotel room in 2013, and she said she didn\u2019t want to testify in the case again.\u00a0<\/p>\n<p>The most recent mistrial involving Mann\u2019s charges was the second time a jury was unable to reach a verdict in her case, and her third time testifying about her sexual encounters with Weinstein in graphic testimony in front of a trial jury.\u00a0<\/p>\n<p>\u201cIn accordance with our survivor-centered approach to prosecutions, we informed the court that we will not retry the remaining count of rape in the third degree,\u201d Bragg said in a statement. \u201cTo be clear, we believe Ms. Mann\u2019s account and her credibility as a witness. This has been an extraordinarily taxing ordeal for her, and she has never wavered while testifying in front of two grand juries and three trial juries over the course of eight years. We thank her for her honesty and her tremendous bravery.\u201d<\/p>\n<p>Weinstein\u2019s legal counsel did not immediately respond to a request for comment.<br \/>\n<img loading=\"lazy\" decoding=\"async\" class=\"size-large wp-image-137772946\" src=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2026\/06\/DSC2534.jpg\" alt=\"Manhattan District Attorney Alvin Bragg.\" width=\"1200\" height=\"800\" title=\"Manhattan DA Bragg declines to pursue fourth retrial of Harvey Weinstein's rape charge 2\"  \/>Manhattan District Attorney Alvin Bragg.Photo by Lloyd Mitchell\n<\/p>\n<p>Weinstein was first convicted in a New York state trial in early 2020 of third-degree rape involving Mann, but the New York Court of Appeals <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/harvey-weinsteins-rape-conviction-overturned-rcna149328\" target=\"_blank\" rel=\"noopener nofollow\">overturned the conviction<\/a> in 2024, ruling that the judge had improperly allowed testimony from women who were not directly a part of the case. The jury then deadlocked in a 2025 retrial over Mann\u2019s charges.<\/p>\n<p>In the New York trial last year, Weinstein was convicted of forcing oral sex on former \u201cProject Runway\u201d assistant Miriam Haley in 2006 and not guilty of assaulting Polish model Kaja Sokola.<\/p>\n<p>Bragg said he reached the decision in light of the conviction on the charges involving Haley, and that his office recommended that Weinstein be sentenced to 20 years in prison in that matter.<\/p>\n<p>\u201cI want survivors of sexual violence in Manhattan to know that we believe you, and we will fight for you.
