Harvey Weinstein won\u2019t face a fourth New York City trial on rape charges, but the much accused producer isn\u2019t getting out of prison anytime soon, says the Manhattan District Attorney.<\/p>\n
\u201cToday, following discussions with Jessica Mann, who does not wish to testify again, and in accordance with our survivor-centered approach to prosecutions, we informed the court that we will not retry the remaining count of Rape in the Third Degree, D.A. Alvin Bragg announced early Thursday in a not unexpected shift in his office\u2019s #MeToo strategy. \u201cIn consideration of Ms. Mann\u2019s stance, and in recognition of Mr. Weinstein\u2019s class B felony conviction for violently sexually assaulting Miriam Haley, we will not pursue a fourth trial and therefore moved to dismiss the remaining count.\u201d<\/p>\n

Weinstein was sentenced to 23 years in the clink in 2020 after being convicted by a Big Apple jury in 2020 on raping Mann and other since overturned <\/a>sex crimes. Even with that twist in the case, the once feared producer remained behind bars due to his 2022 L.A. sex crimes guilty verdict<\/a>. The perpetually and publicly ailing 74-year-old Weinstein\u2019s third New York\u00a0rape<\/a>\u00a0trial ended in mid-May with a deadlocked jury. <\/a><\/p>\n That impasse saw MY Judge Curtis Farber\u00a0declare a mistrial on May 15.<\/p>\n It was in many ways a repeat of June 2025 when a seven-woman, five-man jury delivered a mixed verdict on Weinstein. The producer was found guilty of a first-degree criminal sexual act against Miriam Haley, not guilty of the same act against Kaja Sokola and stuck on a decision about Mann.<\/p>\n With the Pulp Fiction producer continuing to declare his innocence of the dozens and dozens of claims against him from A-lister actresses to Production Assistants and more, Bragg\u2019s team last month said: \u201cWe will consider our next steps in consultation with Ms. Mann, and in consideration of Harvey Weinstein\u2019s pending sentencing following last year\u2019s trial conviction for forcibly sexually assaulting Miriam Haley.\u201d<\/p>\n The first part of legal ship sailed today, with the second in dock or the docket, depending on your point of view.<\/p>\n Noting \u201cwe believe Ms. Mann\u2019s account and her credibility as a witness,\u201d as well as praising the one time aspiring actress\u2019 \u201chonesty and her tremendous bravery,\u201d Bragg\u2019s office added: \u201cWe also shared our recommendation to the court that Mr. Weinstein be sentenced to 20 years in prison, which would account for the significant harms his actions have caused Ms. Haley.\u201d<\/p>\n Already appealing his West Coast conviction, Weinstein\u2019s side took today\u2019s events as a rare big win.<\/p>\n \u201cHarvey is relieved by today\u2019s outcome,\u201d a rep for Weinstein told Deadline Thursday.<\/p>\n \u201cWe believe this is the result that should have been reached from the outset, had the grand jury been presented with the full scope of the emails, text messages, and other private communications,\u201d they went on to say.<\/p>\n Looking for another Hail Mary in terms of the time their client spends in an upstate prison, Weinstein\u2019s defense team added: \u201cWe will be submitting our sentencing materials in the coming weeks. As we argued following the original trial, we believe the prior sentence imposed by Judge Burke was excessive, and we intend to challenge the prosecution\u2019s sentencing recommendations.
