The accuser at the center of the dropped charge, Jessica Mann, wrote a letter to the court saying she could no longer endure going through this any longer after years of testifying. Prosecutors in DA Alvin Bragg\u2019s office<\/a> cited her exhaustion in asking the judge to dismiss the third-degree rape count from a 2013 hotel allegation, and the judge agreed.<\/p>\n

The decision followed two hung juries on that exact charge: a mistrial in the 2025 retrial after Weinstein\u2019s original 2020 conviction was overturned on appeal, then another deadlock in the spring 2026 trial. Rather than try it a fourth time, the office walked away. They praised Mann\u2019s \u201cbravery, strength, courage, and inspiration to other survivors.\u201d<\/p>\n

Weinstein, 74 and in poor health, was wheeled out of the courtroom afterward. He remains incarcerated on his other New York and California convictions, with prosecutors recommending roughly 20 years on the counts that still stand. His new defense lawyer, Jacob Kaplan, argued the case should never have been brought.<\/p>\n
