The Supreme Court said today that President Trump\u2019s executive order limiting birthright citizenship had violated the 14th Amendment of the Constitution. The justices, in a 6-to-3 decision, reaffirmed the long-held principle that children born on U.S. soil are American citizens<\/a>.<\/p>\n

The ruling blocked Trump\u2019s effort to prevent babies born to undocumented immigrants and temporary foreign residents from automatically becoming Americans. Chief Justice John Roberts \u2014 who was joined in the majority by all three liberals, as well as conservative justices Amy Coney Barrett and Brett Kavanaugh \u2014 cited the views of the lawmakers who approved the 14th Amendment<\/a>: \u201cCitizenship, then and now, was the right to have rights \u2014 to freely participate in our political community,\u201d he wrote.<\/p>\n

In dissent, Justice Samuel Alito called the ruling a \u201cserious mistake\u201d that opened the door to those he called \u201cbirth tourists.\u201d On social media, the president called the Supreme Court\u2019s decision \u201ctoo bad for our Country,\u201d and urged Congress to take up the issue with legislation. My colleagues explained why that\u2019s unlikely<\/a>.<\/p>\n

The justices allow bans on trans athletes in girls\u2019 sports<\/p>\n

The Supreme Court also announced today that it was upholding two state laws<\/a> that bar transgender athletes from girls\u2019 and women\u2019s sports teams. The 6-to-3 decision means that all 27 states with such restrictions \u2014 nearly every red state in the country \u2014 will most likely be allowed to maintain their laws. It could also put pressure on states without bans<\/a>.<\/p>\n

The case centered on two transgender plaintiffs \u2014 a college student who wanted to compete on a women\u2019s track team, and a high schooler who recently won a state shot put title<\/a> \u2014 who argued that the laws violated the Constitution\u2019s guarantee of equal protection. However, in the majority opinion, Kavanaugh wrote: \u201cAllowing a biological male athlete to compete on a girls\u2019 team necessarily displaces or disadvantages a female athlete.\u201d<\/p>\n

The court also lifts spending limits on political parties<\/p>\n

In another 6-to-3 decision along ideological lines, the Supreme Court\u2019s conservative majority removed restrictions<\/a> on how much political parties can spend in coordination with candidates. The ruling further expanded the power of big money in American politics, and delivered a major victory for Republicans<\/a>.<\/p>\n

At issue was whether the federal limits on such spending \u2014 called coordinated party expenditures \u2014 violate the First Amendment. Kavanaugh, writing for the majority, said the court\u2019s campaign finance precedents required it to strike down the restrictions. In dissent, Justice Elena Kagan wrote that the ruling was a recipe for corruption: \u201cWith no limits on coordinated expenditures,\u201d she wrote, \u201cthe party can serve as the candidate\u2019s checking account.\u201d<\/p>\n
