{"id":292533,"date":"2026-07-10T18:45:32","date_gmt":"2026-07-10T18:45:32","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/292533\/"},"modified":"2026-07-10T18:45:32","modified_gmt":"2026-07-10T18:45:32","slug":"lawyer-of-nypd-cop-accused-of-sexually-assaulting-brooklyn-minor-says-girl-may-recant","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/292533\/","title":{"rendered":"Lawyer of NYPD cop accused of sexually assaulting Brooklyn minor says girl may recant"},"content":{"rendered":"<p>The lawyer for an <a href=\"https:\/\/www.nydailynews.com\/2026\/07\/09\/nypd-cop-officer-joshua-acosta-arrested-for-rape-sexual-misconduct-with-a-child\/\" rel=\"nofollow noopener\" target=\"_blank\">NYPD cop accused of sexually assaulting a minor<\/a> he knew said Friday the charges are unfounded and that the victim may recant part of all of the allegations.<\/p>\n<p>Officer Joshua Acosta was taken into custody Wednesday night and charged with three counts of rape, three counts of sexual misconduct and acting in a manner injurious to a child. Acosta, 39, was also charged with <a href=\"https:\/\/www.nysenate.gov\/legislation\/laws\/PEN\/130.75\" rel=\"nofollow noopener\" target=\"_blank\">course of sexual conduct against a child,<\/a> which is defined as engaging in sexual conduct with a child younger than 13.<\/p>\n<p>At Acosta\u2019s arraignment Friday, his lawyer, David Gelfand, maintained the cop\u2019s innocence.<\/p>\n<p>\u201cOur office has begun a preliminary investigation into the matter which has revealed real issues with the complaint\u2019s credibility,\u201d Gelfand said in Brooklyn Criminal Court.<\/p>\n<p>He also said the girl as \u201crecently as yesterday indicated to family members, she desired potentially to recant at least part, if not all, of the testimony she\u2019s offered to the people in this matter.\u201d<\/p>\n<p>The <a href=\"https:\/\/pix11.com\/news\/local-news\/brooklyn\/nypd-officer-accused-of-raping-minor-in-domestic-incident-sources\/\" rel=\"nofollow noopener\" target=\"_blank\">alleged crimes occurred in Brooklyn over the course of several years<\/a> and while Acosta was off duty, prosecutors said.<\/p>\n<p>Acosta joined the NYPD in January 2014 and had been assigned to the Police Action Litigation Section of the NYPD\u2019s Legal Bureau.
