{"id":295346,"date":"2026-07-14T12:11:09","date_gmt":"2026-07-14T12:11:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/295346\/"},"modified":"2026-07-14T12:11:09","modified_gmt":"2026-07-14T12:11:09","slug":"new-york-becomes-first-us-state-to-impose-data-center-moratorium","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/295346\/","title":{"rendered":"New York becomes first US state to impose data center moratorium"},"content":{"rendered":"<p data-block-key=\"9jo2z\">New York has become the first US state to impose a moratorium on new large-scale data centers.<\/p>\n<p data-block-key=\"536r3\">The state imposed a one-year moratorium, following growing concerns about the impact of large-scale data centers on power costs, water supplies, and local communities.<\/p>\n<p data-block-key=\"1ca0n\">The moratorium was signed into law by New York Governor Kathy Hochul. The order will immediately pause environmental permits for projects with a capacity of 50MW or more, providing time for a requisite regulatory framework to be developed.<\/p>\n<p data-block-key=\"4649d\">The framework includes a &#8220;Generic Environmental Impact Statement,&#8221; which will assess data center energy demand, water use and quality, and air quality. In addition, the order will also provide &#8211; within 60 days &#8211; guidance for local entities to negotiate community benefits with companies.<\/p>\n<p data-block-key=\"2a0lf\">&#8220;As data center development threatens \u2060to hike up utility bills, deplete our natural resources, and create uncertainty for New Yorkers, it&#8217;s my responsibility to take \u200baction and lead,&#8221; said Hochul<\/p>\n<p data-block-key=\"cqph9\">The order also directs the Department of Public Service to consider creating a New York Grid Acceleration Fund, which would require data centers to invest in the state&#8217;s aging grid infrastructure. Reports also indicate that Hochul will pursue legislation to repeal statewide sales tax exemptions for data centers.<\/p>\n<p data-block-key=\"205k6\">A proposed <a href=\"https:\/\/www.datacenterdynamics.com\/en\/news\/three-year-data-center-moratorium-considered-in-new-york-state\/\" rel=\"nofollow noopener\" target=\"_blank\">three-year moratorium<\/a> in New York is also making its way through the legislature after being introduced earlier in the year. Introduced by Democratic state senator Elizabeth Krueger on February 6, <a href=\"https:\/\/legislation.nysenate.gov\/pdf\/bills\/2025\/S9144\" rel=\"nofollow noopener\" target=\"_blank\">S.9144<\/a> would also require the state government to investigate and mitigate the environmental and utility rate impacts of data centers. According to the governor&#8217;s office, the decision was made to advance a one-year moratorium due to the apparent \u201ccomplicated\u201d nature of the Krueger-proposed bill.<\/p>\n<p data-block-key=\"45t91\">While New York is the first to enforce a statewide moratorium, several other US states have seen similar legislation proposed. In Maine, a bill passed both houses that would have imposed an 18-month moratorium, but it was ultimately <a href=\"https:\/\/www.datacenterdynamics.com\/en\/news\/maine-governor-vetoes-bill-proposing-state-wide-data-center-moratorium\/\" rel=\"nofollow noopener\" target=\"_blank\">vetoed by the governor<\/a>.<\/p>\n<p data-block-key=\"58bt2\">Although moratoriums have long been used at the local level, officials in <a href=\"https:\/\/www.datacenterdynamics.com\/en\/news\/state-wide-data-center-moratorium-set-to-be-proposed-in-minnesota\/\" rel=\"nofollow noopener\" target=\"_blank\">Minnesota<\/a>, <a href=\"https:\/\/www.datacenterdynamics.com\/en\/news\/virginia-house-of-delegates-may-consider-temporary-data-center-moratorium\/\" rel=\"nofollow noopener\" target=\"_blank\">Virginia<\/a>, <a href=\"https:\/\/gc.nh.gov\/bill_status\/legacy\/bs2016\/billText.aspx?sy=2026&amp;id=1685&amp;txtFormat=html\" rel=\"nofollow noopener\" target=\"_blank\">New Hampshire<\/a>, <a href=\"https:\/\/legislature.vermont.gov\/bill\/status\/2026\/S.205\" rel=\"nofollow noopener\" target=\"_blank\">Vermont<\/a>, <a href=\"https:\/\/www.datacenterdynamics.com\/en\/news\/oklahoma-senator-proposes-three-year-data-center-moratorium-in-the-state\/\" rel=\"nofollow noopener\" target=\"_blank\">Oklahoma<\/a>, <a href=\"https:\/\/www.billtrack50.com\/billdetail\/1926292\" rel=\"nofollow noopener\" target=\"_blank\">Maryland<\/a>, <a href=\"https:\/\/www.datacenterdynamics.com\/en\/news\/georgia-considering-bill-that-could-shield-ratepayers-from-data-center-related-increases\/\" rel=\"nofollow noopener\" target=\"_blank\">Georgia<\/a>, <a href=\"https:\/\/www.datacenterdynamics.com\/en\/news\/state-wide-data-center-moratorium-could-be-proposed-in-pennsylvania\/\" rel=\"nofollow noopener\" target=\"_blank\">Pennsylvania<\/a>, <a href=\"https:\/\/www.scstatehouse.gov\/query.php?category=LEGISLATION&amp;conid=76577010&amp;keyval=1265286&amp;numrows=10&amp;result_pos=0&amp;search=DOC&amp;searchtext=data+center&amp;session=126\" rel=\"nofollow noopener\" target=\"_blank\">South Carolina<\/a>, <a href=\"https:\/\/d35i5brrnx3uxo.cloudfront.net\/wp-content\/uploads\/2026\/02\/12183010\/25-6377_1.pdf\" rel=\"nofollow noopener\" target=\"_blank\">Wisconsin<\/a>, and <a href=\"https:\/\/www.legislature.mi.gov\/Bills\/Bill?ObjectName=2026-HB-5594\" rel=\"nofollow noopener\" target=\"_blank\">Michigan<\/a> have also introduced bills calling for state-wide bans on new developments.<\/p>\n<p data-block-key=\"8mtt8\">A bill proposing a national moratorium was also introduced by US Senators Bernie Sanders and Alexandria Ocasio-Cortez in March 2026.<\/p>\n<p data-block-key=\"4913u\">Dubbed the <a href=\"https:\/\/www.datacenterdynamics.com\/en\/news\/us-bernie-senators-sanders-and-aoc-introduce-bill-for-nationwide-ban-on-data-centers\/\" rel=\"nofollow noopener\" target=\"_blank\">Artificial Intelligence Data Center Moratorium Act<\/a>, it would prevent data center construction until the government enacts laws to protect workers and consumers, the environment, and civil rights from the impacts of AI.<\/p>\n","protected":false},"excerpt":{"rendered":"New York has become the first US state to impose a moratorium on new large-scale data centers.
