Kathy Hochul <a href=\"https:\/\/www.governor.ny.gov\/news\/first-statewide-moratorium-new-hyperscale-data-centers-launched-governor-kathy-hochul\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">signed an executive order<\/a> on Tuesday to pause the issuance of new building permits for hyperscale data centers in the state, the first state-level freeze on new construction of AI data centers.<\/p>\n<p class=\"u-speakableText-p2\">The moratorium could last up to one year with the expectation that the state will use that time to &#8220;build a regulatory framework that protects ratepayers, the environment, the energy grid and communities across the state.&#8221;<\/p>\n<p>&#8220;As data center development threatens to hike up utility bills, deplete our natural resources and create uncertainty for New Yorkers, it&#8217;s my responsibility to take action and lead,&#8221; Gov. Hochul\u00a0<a href=\"https:\/\/www.governor.ny.gov\/news\/first-statewide-moratorium-new-hyperscale-data-centers-launched-governor-kathy-hochul\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">said in a press release<\/a>. &#8220;New York will lead the way in creating the strongest standards in the nation for data center development.&#8221;<\/p>\n<p>Other states may soon follow suit. <a href=\"https:\/\/www.ncsl.org\/fiscal\/which-states-are-banning-data-centers\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">Lawmakers in 15 states<\/a> have proposed temporary or permanent halts to data center construction, although several have failed to gain legislative support. In Maine, the legislature passed a moratorium, but was\u00a0<a href=\"https:\/\/www.cnet.com\/tech\/services-and-software\/maine-could-become-first-state-to-pass-year-long-ban-on-new-large-data-centers\/\" rel=\"nofollow noopener\" class=\"c-shortcodeLink c-shortcodeLink-active\" target=\"_blank\">vetoed by Gov. Janet Mills<\/a>.\u00a0<\/p>\n<p>The executive order specifically targets <a href=\"https:\/\/www.tierpoint.com\/glossary\/hyperscale-data-center\/#:~:text=The%20most%20significant,include%20more%20automation.\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">hyperscale data centers<\/a>, which are used for AI training or inference. While traditional data centers might house hundreds of servers, hyperscale data centers can host tens of thousands of servers and are responsible for disproportionate use of <a href=\"https:\/\/mostpolicyinitiative.org\/science-note\/data-center-water-use\/\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">local water<\/a> and <a href=\"https:\/\/www.congress.gov\/crs-product\/R48646\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">electricity resources<\/a>.<\/p>\n<p><a rel=\"nofollow noopener\" href=\"https:\/\/www.cnet.com\/ai-atlas\/\" target=\"_blank\" class=\"c-shortcodeImage_imageContainer\">  <img decoding=\"async\" src=\"\" alt=\"AI Atlas\" height=\"268.29694323144105\" width=\"768\" loading=\"lazy\"\/>  <\/a> <\/p>\n<p>Hochul <a href=\"https:\/\/www.governor.ny.gov\/news\/first-statewide-moratorium-new-hyperscale-data-centers-launched-governor-kathy-hochul#:~:text=Additionally%2C%20the%20Governor,across%20the%20state.\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">is directing<\/a> the New York Department of Public Service to &#8220;consider creating a New York Grid Acceleration Fund to require data centers to invest in the state&#8217;s aging grid infrastructure and energy needs&#8221; and is pursuing additional legislation to repeal sales tax exemptions for hyperscale data centers in the state.<\/p>\n<p>A representative of Gov. Hochul&#8217;s press office didn&#8217;t immediately respond to a request for comment.<\/p>\n<p>Existing data centers are unaffected<\/p>\n<p>Hochul&#8217;s one-year moratorium applies to new hyperscale data centers, but construction will continue on AI data centers that were previously issued valid permits. There are also exceptions carved out for certain research and educational facilities that use less power, <a href=\"https:\/\/www.politico.com\/news\/2026\/07\/14\/hochul-to-approve-nations-first-state-level-data-center-pause-00995561#:~:text=There%20will%20be%20some%20exceptions%20for%20facilities%20that%20generally%20use%20less%20power%20and%20are%20built%20for%20research%2C%20education%20and%20health%20care%20purposes%2C%20Hochul%E2%80%99s%20office%20said.\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">according to Politico<\/a>.<\/p>\n<p>There are currently 133 data centers operating in <a href=\"https:\/\/www.datacentermap.com\/usa\/new-york\/\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">New York<\/a>, with <a href=\"https:\/\/www.datacentermap.com\/usa\/new-york\/new-york\/\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">New York City<\/a> and <a href=\"https:\/\/www.datacentermap.com\/usa\/new-york\/buffalo\/\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">Buffalo<\/a> serving as particularly large hotspots for facility construction.<\/p>\n<p>To put that number into perspective, other states like <a href=\"https:\/\/www.datacentermap.com\/usa\/virginia\/\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">Virginia<\/a> and Texas have built hundreds more data centers than New York and account for nearly a quarter of the AI data center infrastructure in the US.<\/p>\n<p>  <img decoding=\"async\" src=\"\" alt=\"An Amazon Web Services hyperscale data center is on display as someone points to a massive server rack.\" height=\"800.390625\" width=\"1200\" loading=\"lazy\"\/>   <\/p>\n<p>The tens of thousands of servers necessary for AI data centers suck up local natural resources and pollute the environment.<\/p>\n<p> Mark Felix\/AFP\/Getty ImagesAmericans broadly reject data center construction<\/p>\n<p>There are already serious concerns about the proliferation of hyperscale data centers across the country.<\/p>\n<p>Reports about Virginia&#8217;s data centers claim\u00a0<a href=\"https:\/\/www.washingtonpost.com\/business\/2026\/05\/28\/data-centers-boom-virginians-breathe-exhaust-10000-diesel-generators\/\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">tens of thousands of on-site fossil-fuel generators<\/a> could be responsible for <a href=\"https:\/\/www.pecva.org\/resources\/press\/press-release-new-study-finds-on-site-power-at-virginia-data-center-could-result-in-53-million-99-million-in-annual-health-damages\/\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">tens of millions of dollars in annual health damages<\/a>. Foreboding images of deep black smog emanating from these data centers <a href=\"https:\/\/www.yahoo.com\/news\/weather-news\/articles\/dark-smoke-rose-above-virginia-040201221.html\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">recently made headlines<\/a> during a heat wave that strained the state&#8217;s power grid.<\/p>\n<p>These highly publicized scares are just one reason people are protesting the construction of data centers near their homes. A <a href=\"https:\/\/sri.siena.edu\/wp-content\/uploads\/2026\/06\/SNY0626-Release-Crosstabs.pdf\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">Siena Research Institute poll<\/a> (PDF) found that most New York state residents supported Hochul&#8217;s one-year moratorium.<\/p>\n<p>&#8220;Technology should make our lives better, not pollute our water, strain our energy grid, or drive up our utility bills,&#8221; New York State Sen. Kristen Gonzalez <a href=\"https:\/\/www.governor.ny.gov\/news\/first-statewide-moratorium-new-hyperscale-data-centers-launched-governor-kathy-hochul\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">said in the New York press release<\/a>. &#8220;I have heard from New Yorkers across our state who are concerned about what the rise in large data centers might mean for their communities.&#8221;<\/p>\n<p>The New York numbers reflect a broader nationwide reality: Regardless of political affiliation, most people don&#8217;t want data centers in their backyard. A <a href=\"https:\/\/news.gallup.com\/poll\/709772\/americans-oppose-data-centers-area.aspx\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">recent Gallup poll<\/a> found that roughly 71% of Americans oppose the construction of data centers in their area. More US residents said they opposed new data centers in their area\u00a0<a href=\"https:\/\/news.gallup.com\/poll\/709772\/americans-oppose-data-centers-area.aspx#:~:text=The%20data%20center,has%20been%2063%25.\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">than opposed new nuclear power plants<\/a>\u00a0nearby.<\/p>\n<p>And while many states&#8217; governments have been reluctant to craft legislation banning AI data center construction &#8212; or have <a href=\"https:\/\/www.maine.gov\/governor\/mills\/news\/governor-mills-announces-decision-ld-307-2026-04-24\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">outright vetoed proposed moratoriums<\/a> &#8212; local communities across the country <a href=\"https:\/\/news.harvard.edu\/gazette\/story\/2026\/04\/why-are-communities-pushing-back-against-data-centers\/\" rel=\"noopener nofollow\" target=\"_blank\" title=\"(opens in a new window)\" class=\"c-regularLink\">have mobilized to drive out the server farms<\/a>.<\/p>\n<p>While the New York executive order is an important win for data center opponents, the odds are still stacked against them. President Donald Trump has thrown his weight behind the AI industry with the intention of removing so-called &#8220;cumbersome legislation&#8221; to the advancement of the biggest AI companies.<\/p>\n<p>In December, Trump <a href=\"https:\/\/www.cnet.com\/tech\/services-and-software\/trump-ai-executive-order\/\" target=\"_self\" rel=\"nofollow noopener\">issued an executive order<\/a> attempting to limit state-by-state regulations and provide a single federal framework for AI companies. The president threatened to withhold broadband funding from states that insist on stricter regulations.<\/p>\n<p>While several deadlines under this executive order\u00a0<a href=\"https:\/\/www.axios.com\/2026\/04\/24\/trump-missed-ai-deadlines#link={%22role%22:%22standard%22,%22href%22:%22https:\/\/www.axios.com\/2026\/04\/24\/trump-missed-ai-deadlines%22,%22target%22:%22%22,%22absolute%22:%22%22,%22linkText%22:%22have already passed%22}\" target=\"_blank\" rel=\"noopener nofollow\" title=\"(opens in a new window)\" class=\"c-regularLink\">have already passed<\/a>\u00a0without action by the Trump administration, the threat of federal opposition still looms over state governments considering moratoriums like the one in New York.<\/p>\n","protected":false},"excerpt":{"rendered":"New York Gov.
