A National Football League employee injured in the mass shooting at a Midtown office building<\/a> last year has sued New York City for $24 million \u2014 boldly claiming the slain off-duty cop\u2019s negligence allowed the gunman to storm the building and carry out the deadly spree.<\/p>\n

Craig Clementi, who worked in the NFL\u2019s finance department, was severely injured after he was shot in the back by deranged gunman Shane Tamura at the Park Avenue skyscraper on July 28, 2025.\u00a0<\/p>\n

In a civil lawsuit filed in the Manhattan Supreme Court last week, Clementi said that NYPD Detective Didarul Islam failed to stop Tamura, 27, from wounding him and killing four other people, including Islam, in the bloody massacre, the New York Daily News<\/a> reported.\u00a0<\/p>\n

Islam was working in uniform at 345 Park Ave. as part of the NYPD\u2019s \u201cpaid detail\u201d security program when Tan armed amura strolled into the building. <\/p>\n

\u201cDetective Islam\u2026failed to identify a visible impending security threat and took no action to thwart or mitigate said threat, including while the threat was in view for an extended period of time prior to the attack,\u201d a notice of claim that accompanies the lawsuit states, according to the outlet.\u00a0<\/p>\n

The suit claims that Islam breached a special duty he had to protect people in the building by failing to notice the gunman walk roughly 100 feet across its outdoor plaza while carrying an M4 assault rifle in plain sight.<\/p>\n

It is not clear if Islam, who was standing at the lobby entrance, saw the gunman before bullets flew.\u00a0<\/p>\n

\u201cIn short, the video evidence provides a good faith basis to assert that Detective Islam\u2019s inattentiveness and negligence allowed the gunman to walk across the building\u2019s plaza with a visible assault rifle and into the building; all without the gunman being detected, deterred, confronted, neutralized and without building\/lobby occupants being warned of the approaching danger,\u201d the lawsuit argues.\u00a0<\/p>\n

Clementi \u201cwas shot in close range\u201d in his side and lower back, around 10 feet away from Islam, the Daily News reported.\u00a0<\/p>\n

The suit alleges that despite the \u201cgrievous gunshot wound,\u201d the NFL staffer was able to escape through the building\u2019s shattered revolving door before locating NYPD officers nearby and calling 911.\u00a0<\/p>\n

He lay bleeding on a sidewalk before being rushed to New York-Presbyterian\/Weill Cornell Medical Center, where he was put in the Intensive Care Unit and had surgery to remove bullet fragments.\u00a0<\/p>\n

Clementi suffered a lumbar fracture and was hospitalized for 10 days and required \u201chome wound care nursing and physical therapy\u201d after being discharged, one document in the suit states.\u00a0<\/p>\n

\u201cI bear permanent depressed scars from the wound and I experience pain every day,\u201d Clementi wrote in an attached filing, the outlet reported.\u00a0<\/p>\n

\u201cSince the shooting, I have also suffered from severe psychological trauma, including multiple daily flashbacks to the incident, hypervigilance, and significant disruption to my daily life and professional activities.\u201d<\/p>\n

Clementi is seeking $24 million in damages from the city.\u00a0<\/p>\n

While Islam was technically off-duty from the NYPD while working as private security, the lawsuit argues that the city can be held liable in the case as his duties \u201cremain within the City\u2019s control.\u201d<\/p>\n

The program allows private companies to pay for off-duty security work by NYPD officers while in their uniforms.\u00a0<\/p>\n

NYPD Commissioner Jessica Tisch praised the 36-year-old off-duty cop after he was killed in the shooting. NYPD<\/p>\n

Detective Islam, who lived in the Bronx and was assigned to the 47th Precinct,<\/a> had served on the force for four years.\u00a0<\/p>\n

In the aftermath of the shooting, NYPD Commissioner Jessica Tisch praised the 36-year-old off-duty cop, who was a Bangladeshi immigrant and father of three.\u00a0<\/p>\n

The family of\u00a0 27-year-old Cornell University graduate Julia Hyman<\/a>, who was one of the four people killed in the horrific Midtown shooting spree, also plans to sue the city for $65 million \u2014 claiming police \u201cutterly and completely\u201d failed to stop the crazed gunman before he stormed into the building, The Post previously reported.\u00a0<\/a><\/p>\n

While Tamura\u2019s motive for the bloody massacre remains under investigation, it is believed that he intended to target the NFL offices before shooting himself. <\/p>\n
