{"id":318111,"date":"2026-08-10T21:48:25","date_gmt":"2026-08-10T21:48:25","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/318111\/"},"modified":"2026-08-10T21:48:25","modified_gmt":"2026-08-10T21:48:25","slug":"doj-sues-to-stop-in-state-tuition-for-undocumented-students-in-three-states","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/318111\/","title":{"rendered":"DOJ Sues to Stop In-State Tuition for Undocumented Students in Three States"},"content":{"rendered":"<p>The Department of Justice filed lawsuits against New York, Connecticut and Vermont on Monday for allowing undocumented students to receive in-state tuition \u2014 and vowed to keep pushing to end the practice nationwide.<\/p>\n<p>Seventeen states have already faced legal challenges over state laws that give undocumented immigrants access to financial assistance programs.<\/p>\n<p>The DOJ argues that the state programs in question unconstitutionally discriminate against students with U.S. citizenship \u2014 although New York, Connecticut and Vermont all offer in-state tuition reductions to all students who meet certain state residency requirements.<\/p>\n<p>\u201cOur efforts will not cease until President Trump\u2019s promise is fulfilled: illegal aliens will not receive benefits denied to our Nation\u2019s own citizens,\u201d Associate Attorney General Stanley Woodward said in a statement.<\/p>\n<p>The Trump administration prevailed in some of its prior lawsuits, and multiple states have halted their tuition policies, including Texas, Kentucky, Oklahoma, Nebraska and Illinois.<\/p>\n<p>Some of the lawsuits led to the <a class=\"Link\" href=\"https:\/\/www.notus.org\/courts\/texas-college-tuition-undocumented-students\" target=\"_blank\" rel=\"noopener nofollow\">end of programs<\/a> started by decades-old state laws, like the Texas Dream Act, which passed with bipartisan support in 2001.<\/p>\n<p>Woodward said the Justice Department has \u201cnow sued every state in the Second Circuit that seeks to thwart Congress\u2019s clear prohibition by placing alien over citizen.\u201d<\/p>\n<p>The university systems for New York, Connecticut and Vermont did not immediately respond to a request for comment on the new legal challenges from the Trump administration.<\/p>\n<p>Approximately 2.4% of all students enrolled in U.S. colleges and universities are undocumented, according to an October <a class=\"Link\" href=\"https:\/\/www.higheredimmigrationportal.org\/research\/breakdown-of-the-undocumented-student-population-in-u-s-colleges-and-universities\/\" target=\"_blank\" rel=\"noopener nofollow\">report<\/a> from the Higher Ed Immigration Portal.
