A real estate industry that has sounded alarms<\/a> over New York City Mayor Zohran Mamdani\u2019s pied-a-terre tax harming the luxury residential market got a momentary reprieve Monday.<\/p>\n

Staten Island Supreme Court Justice Wayne Ozzi blocked the Mamdani administration\u2019s rollout of a controversial surcharge on second homes worth more than $5 million and ordered the removal of nearly 1 million properties the city had posted online affected by the tax. The decision<\/a>, which was issued in response to a lawsuit filed by homeowners<\/a> last week, was appealed by the city Monday evening, which automatically triggered a stay of the ruling until an appeal is heard on Aug. 31.\u00a0<\/p>\n

A source familiar with New York tax laws\u00a0cautioned that no matter how the legal drama plays out, the tax is likely to still take effect even if delayed. The source said\u00a0 homeowners who received original July surcharge notices should \u201cstill get their paperwork ready.\u201d\u00a0<\/p>\n

The pied-a-terre tax was approved by the New York State Legislature in May and is projected to raise $500 million in revenue for the Big Apple, according to an analysis<\/a> by New York City Comptroller Mark Levine. The policy has sparked concerns, however, from many real estate professionals about potential negative effects of luxury developers and buyers avoiding New York City despite the luxury market seeing an uptick<\/a> in June.\u00a0<\/p>\n

\u201cWe disagree with today\u2019s ruling, but we are confident in both the pied-\u00e0-terre surcharge and the city\u2019s ability to implement it fairly and effectively,\u201d Mamdani spokesperson Matt Rauschenbach told<\/a> the Wall Street Journal. \u201cThis surcharge asks those who own second homes valued at $5 million or more to contribute their fair share to the city they benefit from.\u201d<\/p>\n
