(TNND)<\/p>\n<\/p>\n<p>The guilty plea ends the federal case short of trial and leaves Mangione facing up to life in prison. Sentencing is set for December and the judge made clear on the record that no promises have been made to Mangione about the sentence he will receive. There is also no agreement on a recommended term.<\/p>\n<p>Mangione\u2019s <a href=\"https:\/\/thenationaldesk.com\/top-videos\/luigi-mangione-federal-guilty-plea-new-york-murder-case-neama-rahmani-megan-clarke-7news-stalking-charges-double-jeopardy-state-prosecution-manhattan-district-attorney-trial-september-8-defense-motion-constitution-paul-manafort-todd-blanche-death-penalty#\" target=\"_blank\" rel=\"nofollow noopener\">plea<\/a> included a detailed account of planning and it came without a plea bargain in place.<\/p>\n<p>Criminal attorney and legal expert Jonna Spilbor told The National News Desk the defense will need to present mitigating circumstances at sentencing if it hopes to avoid a life sentence.<\/p>\n<p>\u201cI love this question because as I sit here and this is all very fresh, I can&#8217;t think of a single mitigating factor,\u201d Spilbor said. \u201cAnd that is what his defense team is going to have to put forth if they have a chance of this man not spending the rest of his life in prison.\u201d<\/p>\n<p>Spilbor added, \u201cFrankly, he should spend the rest of his life in prison, but they will have to garner whatever mitigating circumstances they can find and present that to this federal judge when it comes time for sentencing.\u201d<\/p>\n<p>Spilbor said Mangione\u2019s position through his lawyers over \u201cthe last not quite two years\u201d has been that he believed he was wronged by the system and by United Health Care, and that \u201cthe health care system puts a lot of people in jeopardy.\u201d Spilbor said that appears to be the direction the defense may lean on in arguing mitigation, though he questioned how much it would matter in a case with a potential life sentence.<\/p>\n<p>The plea also sets up a legal fight over whether New York\u2019s double jeopardy rules will block Mangione\u2019s state murder trial, which is set to start next month.<\/p>\n<p>Spilbor said the double jeopardy argument in New York state court is \u201creally strong,\u201d even though the federal plea involved two counts of stalking, leading to death rather than murder, which are the New York charges.<\/p>\n<p>\u201cThe transaction, which is kind of the legal term of art, is identical. It&#8217;s the same thing,\u201d Spilbor said. \u201cWe saw it with our own eyes on camera. There&#8217;s nothing different there.
