Why are Mangione\u2019s lawyers arguing that the state case should be dropped?<\/p>\n

Mangione previously pleaded not guilty to all the federal and state charges levied against him, and his lawyers have not publicly disclosed why the 28-year-old chose to change his plea in the federal case. But after the hearing on Friday, his lawyers announced that they had filed the motion claiming double jeopardy.<\/p>\n

\u201cIt was a single tragic event, yet he\u2019s being prosecuted twice for the same conduct,\u201d Karen Friedman Agnifilo, one of Mangione\u2019s lawyers, told reporters on Friday.<\/p>\n

In the motion<\/a>, his lawyers argue that Mangione\u2019s federal guilty plea \u201c\u2018terminates\u2019 the federal proceeding\u201d and is now considered to be a \u201cprevious prosecution,\u201d meaning that the New York state case would be a \u201csecond prosecution,\u201d triggering double jeopardy.<\/p>\n

His lawyers also allege in the filing that the Justice Department and Manhattan District Attorney\u2019s Office coordinated their cases against Mangione so that the state would go to trial first \u201cto ensure dual successive prosecutions, in order to attempt to avoid double jeopardy protections.\u201d They allege that this effort was meant \u201cto maximize the punitive effectiveness of the two cases at the expense of Mr. Mangione,\u201d which in turn \u201cundercuts the separate sovereign rationale of the federal double jeopardy jurisprudence.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"Why are Mangione\u2019s lawyers arguing that the state case should be dropped?
