{"id":348762,"date":"2026-09-16T23:16:14","date_gmt":"2026-09-16T23:16:14","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/348762\/"},"modified":"2026-09-16T23:16:14","modified_gmt":"2026-09-16T23:16:14","slug":"nyc-rent-freeze-lawsuit-judge-demands-to-see-communications-between-city-hall-and-rent-guidelines-board","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/348762\/","title":{"rendered":"NYC rent freeze lawsuit: Judge demands to see communications between City Hall and Rent Guidelines Board"},"content":{"rendered":"<p>The Manhattan judge overseeing a case seeking to overturn the Rent Guidelines Board\u2019s (RGB) June decision to freeze the rent on approximately one million stabilized apartments <a href=\"https:\/\/iapps.courts.state.ny.us\/nyscef\/ViewDocument?docIndex=8ngHYx11CKR10ONL6EU6Ow==\" target=\"_blank\" rel=\"noopener nofollow\">ruled<\/a> Wednesday that he needed to see communications between City Hall personnel and the rent board\u2019s decision-makers.<\/p>\n<p>The ruling represented a small win for the landlords who brought the case forward, and allege the board\u2019s rent freeze approval for one- and two-year leases came thanks to undue influence from Mayor Zohran Mamdani. The suing landlords claim the mayor\u00a0\u201c<a href=\"https:\/\/www.amny.com\/news\/nyc-rent-freeze-hangs-balance-hearing\/\" rel=\"nofollow noopener\" target=\"_blank\">put his thumb on the scale<\/a>\u201d and influenced RGB members to ignore crucial data showing landlords were experiencing financial hardship. <\/p>\n<p>City Hall, which has denied the allegations, did not respond to a request for comment. In court, city lawyers have <a href=\"https:\/\/www.amny.com\/news\/nyc-rent-freeze-hangs-balance-hearing\/\" rel=\"nofollow noopener\" target=\"_blank\">maintained<\/a> there was no undue influence on the RGB and that its members took all of the required data into account when making their decision.\u00a0<\/p>\n<p>A demand to see such communications, known as discovery, is rarely granted in cases where a person sues to challenge government decisions, called Article 78 proceedings. However, Manhattan Supreme Court Judge Brendan Lantry wrote Wednesday that he felt the allegations brought by the landlords were concerning enough to warrant an exception.\u00a0<\/p>\n<p>\u201cThe allegations set forth by petitioners-plaintiffs have raised significant concern to this court regarding the lawfulness of the Board\u2019s procedure in determining [the rent freeze],\u201d Lantry wrote. \u201cThe court acknowledges that discovery in a special proceeding is rare. He also brought the lawsuit against the city\u2019s Rent Guidelines Board over the rent freeze.Photo by Isabella Gallo<\/p>\n<p>Lantry ruled the city will have to turn over all written communications between any personnel from the Mayor\u2019s Office \u2014 including the Mayor\u2019s Office of Mass Engagement, the Mayor\u2019s Office to Protect Tenants, the Mayor\u2019s Office of Management and Budget and Mamdani himself \u2014 and any personnel from the Rent Guidelines Board from\u00a0 Jan. 1 to June 25, the day the board voted to freeze the rent.\u00a0<\/p>\n<p>In his decision, Lantry cited a campaign ad Mamdani posted last year where the now-mayor said he \u201cguaranteed\u201d to freeze the rent \u201cevery year\u201d he was in office, as what made him want to see the communications between City Hall and the RGB. <\/p>\n<p>He also noted former board member Christina Smyth, who resigned in protest before the RGB\u2019s June vote, saying she believed the board had traded its status as a \u201cfact-finding body\u201d for one that \u201cstarts with an answer and vibe codes its way backward to justify it.\u201d<\/p>\n<p>Arpit Gupta, the only board member to vote against the rent freeze and an Adams appointee, made a statement after the vote saying he didn\u2019t believe Mamdani had influenced the board\u2019s decision \u2013 a rarity, he noted, accusing past mayors of interfering.\u00a0<\/p>\n<p>Lantry\u2019s request for the communications between City Hall and the RGB indicates he\u2019s weighing the landlord\u2019s allegation that Mamdani unduly influenced the board and their challenge to the rent freeze seriously.\u00a0<\/p>\n<p>Legal experts from New York Law School, the Legal Aid Society and landlord-aligned firms have <a href=\"https:\/\/www.amny.com\/law\/experts-landlords-lose-rent-freeze-no-idea-leases\/\" rel=\"nofollow noopener\" target=\"_blank\">told<\/a> amNewYork they believed the lawsuit brought by the group of landlords was \u201cweak\u201d and found the argument that Mamdani unduly influenced the RGB to freeze the rent unconvincing.\u00a0<\/p>\n<p>That\u2019s partially because the landlords bringing the case can\u2019t win simply by arguing that Mamdani influenced the RGB\u2019s decision, those lawyers and lawyers for the city say. They\u2019ll have to convince the judge that there\u2019s no rational basis in the record of facts and data considered by the RGB to freeze the rent \u2013 an incredibly high bar, the attorneys said. There are likely many decisions that have a rational basis in the record the RGB considered, they said, and freezing the rent is one of them.\u00a0<\/p>\n<p>In an early September court hearing, Corporation Counsel Steven Banks and RGB Assistant Corporation Counsel Rachel Moston pointed to thousands of pages of studies and data in the public record that board members testified to taking into account when making their decision.<\/p>\n<p>\u201cThere is no basis in the record to show there is anything other than proper and lawful proceedings that took place,\u201d Moston said. \u201cIt cannot be said looking at the record \u2026 that the board did not consider all of the factors.\u201d<\/p>\n<p>The city said the board did take rising costs for landlords into account, but that it was only one of the many factors the board must consider. 50% of the city\u2019s tenants in rent-stabilized units were rent-burdened and 30% were severely rent-burdened \u2013 meaning they spend more than 30% or 50% of their income on rent, respectively \u2013 and 40% of the lowest-income tenants had seen a decrease in their wages, all data the RGB took into account.\u00a0<\/p>\n<p>\u201cIt\u2019s not easy enough to just say, \u2018Owners\u2019 costs are up and therefore rents have to go up too,\u2019\u201d Moston told the judge. \u201cThe board has to consider all factors.\u201d<\/p>\n<p>Randy Mastro, the landlord\u2019s attorney who previously served as first deputy mayor in the Adams administration, said he and his clients were \u201cgratified\u201d by the judge\u2019s decision to grant discovery. \u00a0<\/p>\n<p>\u201cThis targeted discovery goes to the heart of our position that this was a sham process with a predetermined outcome, and communications between the Mayor\u2019s Office and the Rent Guidelines Board, which all parties admitted is supposed to be independent of the Mayor\u2019s Office, should show that,\u201d Mastro said.<\/p>\n<p>The parties are due back in court on Sept. 21 for a conference over the demanded communications record.<\/p>\n","protected":false},"excerpt":{"rendered":"The Manhattan judge overseeing a case seeking to overturn the Rent Guidelines Board\u2019s (RGB) June decision to freeze&hellip;\n","protected":false},"author":2,"featured_media":348763,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[6],"tags":[2710,9,11,10,6205,15021],"class_list":["post-348762","post","type-post","status-publish","format-standard","has-post-thumbnail","category-new-york","tag-law","tag-new-york","tag-new-york-headlines","tag-new-york-news","tag-rent-freeze","tag-rent-guidelines-board"],"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/posts\/348762","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/comments?post=348762"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/posts\/348762\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/media\/348763"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/media?parent=348762"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/categories?post=348762"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/tags?post=348762"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
