The New York State Court of Appeals heard arguments Tuesday related to civil lawsuits filed in the wake of the 2022 racially motivated mass shooting at a Tops supermarket in Buffalo.\u00a0<\/p>\n
The civil lawsuits take aim at several social media companies shooter Payton Gendron used before and during the attack on May 14, 2022.<\/p>\n
Plaintiffs argue that the social media platforms have harmful addictive algorithms that played a role in the shooting.<\/p>\n
Attorneys, representing survivors and families of the victims, appealed a 2025 appellate court decision dismissing complaints against the social media companies, citing the First Amendment and Section 230 of the Communications Decency Act.<\/p>\n
The federal rule protects social media platforms from being held responsible for content posted by third parties.<\/p>\n
Plaintiffs argued that Section 230 shouldn\u2019t apply, saying their suit alleges social media companies designed platforms that cause social media addiction, leading to increased isolation, risk taking, lack of impulse control and an inability to evaluate consequences.\u00a0<\/p>\n
Still, attorneys representing the social media companies argued for immunity under Section 230.<\/p>\n
