{"id":358453,"date":"2026-09-28T00:48:08","date_gmt":"2026-09-28T00:48:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/358453\/"},"modified":"2026-09-28T00:48:08","modified_gmt":"2026-09-28T00:48:08","slug":"cheer-this-latest-strike-against-ny-pols-climate-posturing","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/358453\/","title":{"rendered":"Cheer this latest strike against NY pols&#8217; climate posturing"},"content":{"rendered":"<p>Judicial rulings against New York\u2019s bogus Climate Superfund law marks yet another well-deserved blow to politicians\u2019 global-warming posturing.<\/p>\n<p>The <a href=\"https:\/\/nypost.com\/2024\/12\/26\/us-news\/hochul-signs-ny-law-that-charges-75b-to-oil-gas-and-coal-companies-for-climate-change\/\" rel=\"nofollow noopener\" target=\"_blank\">2024 legislation sought<\/a> to swipe a whopping $75 billion from fossil-fuel companies it deemed responsible for more than a billion tons of greenhouse-gas emission since 2000.<\/p>\n<p>Or as Robert S. Smith, a former top state judge, put it, lawmakers \u201cneeded some money \u2014 $75 billion, to be exact \u2014 for \u2018comprehensive adaptation to the effects of climate change in New York\u2019\u201d and thought they had \u201ca good way\u201d to get it: Just take it.<\/p>\n<p>That was patently unconstitutional for numerous reasons, starting with the fact that the federal government oversees environmental regulation under the Clean Air Act, not states.<\/p>\n<p>And the public would\u2019ve paid in the end, as those companies <a href=\"https:\/\/nypost.com\/2025\/03\/02\/us-news\/ny-gov-kathy-hochul-sued-over-75b-climate-law\/\" rel=\"nofollow noopener\" target=\"_blank\">passed the new costs<\/a> on to consumers. <\/p>\n<p>But passing the Superfund law <a href=\"https:\/\/nypost.com\/2024\/12\/26\/us-news\/hochul-signs-ny-law-that-charges-75b-to-oil-gas-and-coal-companies-for-climate-change\/\" rel=\"nofollow noopener\" target=\"_blank\">let Democratic lawmakers pander<\/a> to climate extremists by slapping Big Bad Oil, so they saw it as a win-win.<\/p>\n<p>\t\t\tMore From\t\t\t\t\t\t\tPost Editorial Board<\/p>\n<p>Note that Judge P. Kevin Castel struck down that law just days after another federal jurist, Obama appointee Brenda Sannes, declared the \u201cunusual and sweeping statute\u201d wholly unenforceable.<\/p>\n<p>Their rulings add to climate crazies\u2019 mounting courtroom losses: In 2021, the Second Circuit Court of Appeals struck down <a href=\"https:\/\/nypost.com\/2018\/01\/10\/de-blasio-sues-major-oil-companies-over-climate-change\/\" rel=\"nofollow noopener\" target=\"_blank\">New York City\u2019s wild bid<\/a> to collect damages for climate change.<\/p>\n<p>And on Tuesday, a federal judge dismissed still another nutty lawsuit, filed by Michigan Attorney General Dana Nessel, claiming oil companies created a cartel that slowed the development of renewable energy.<\/p>\n<p>How fitting that such crazy laws, and lawsuits, grow out of a movement that\u2019s <a href=\"https:\/\/nypost.com\/2025\/09\/20\/opinion\/brace-for-a-blizzard-of-calls-for-needlessly-painful-measures-as-climate-week-descends-on-ny\/\" rel=\"nofollow noopener\" target=\"_blank\">itself based on insanity<\/a>: the idea, essentially, that man-made global warming will destroy the world in just a few years unless we trash the economy and live like cavemen.<\/p>\n<p>In New York, that\u2019s produced a climate agenda that\u2019s done nothing to mitigate climate change but <a href=\"https:\/\/nypost.com\/2026\/08\/10\/opinion\/blame-gov-kathy-hochul-and-the-legislature-for-nycs-power-peril\/\" rel=\"nofollow noopener\" target=\"_blank\">only driven energy costs<\/a> through the roof and boosted the chances of power outages.<\/p>\n<p>It\u2019s brought plenty of bad policy at the federal level, too, including billions burned on green giveaways.<\/p>\n<p>For example, the Environmental Protection Agency <a href=\"https:\/\/nypost.com\/2026\/09\/24\/us-news\/less-than-40-of-ev-school-buses-purchased-with-biden-era-epa-grants-have-been-delivered\/\" rel=\"nofollow noopener\" target=\"_blank\">revealed Thursday<\/a> that less than 40% of electric school buses purchased under multibillion-dollar Biden-era program have been delivered.<\/p>\n<p>\u201cIn essence, American taxpayer dollars vanished into thin air, and our children were left without school buses,\u201d fumed EPA boss Lee Zeldin. Brilliant.<\/p>\n<p>On energy issues, of course, even Republicans can be lured to nonsense, as their recent suggestion to ban diesel exports attests: The ban would mess with the entire oil-refining industry, rapidly yielding higher prices in America \u2014 not just for diesel but regular gasoline as well.<\/p>\n<p>The good news? Pushback and reality checks appear, finally, to be reining in climate lunacy.<\/p>\n<p>In New\u00a0 York, sky-high electric bills forced Gov.
