The lawsuit, filed in Manhattan federal court, comes alongside a separate suit led by New York Attorney General Letitia James.<\/p>\n<p>\u00a0<\/p>\n<p>Federal law has defined a public charge as someone primarily dependent on the government for long-term subsistence, including cash assistance or institutionalization, for more than 140 years, according to the <a href=\"https:\/\/ag.ny.gov\/press-release\/2026\/attorney-general-james-leads-major-challenge-trump-administrations-attack\" rel=\"nofollow noopener\" target=\"_blank\">Office of the New York Attorney General<\/a>.<\/p>\n<p>\u00a0<\/p>\n<p>The new rule, which took effect on Sept. 18, lets immigration officers count almost any public benefit used for any length of time against an applicant, including benefits legally used by family members who are U.S. citizens.<\/p>\n<p>\u00a0<\/p>\n<p>The city\u2019s suit was <a href=\"https:\/\/www.nyc.gov\/mayors-office\/news\/2026\/09\/new-york-city-leads-cities-and-counties-in-lawsuit-challenging-f\" rel=\"nofollow noopener\" target=\"_blank\">joined<\/a> by Chicago, San Francisco, Santa Clara County, Seattle, King County in Washington state and the Public Rights Project. James is leading a separate coalition of 21 other states, including California, Illinois, Massachusetts, Washington, Pennsylvania and Washington D.C.<\/p>\n<p>\u00a0<\/p>\n<p>Both lawsuits <a href=\"https:\/\/apnews.com\/article\/immigration-public-charge-benefits-assistance-lawsuit-new-york-95ac8c221f5ded109d36fe13ebd7bc8f\" rel=\"nofollow noopener\" target=\"_blank\">argue<\/a> the rule is \u201carbitrary and capricious, exceeds the Department of Homeland Security\u2019s statutory authority, and departs from the longstanding meaning of public charge provision established by Congress,\u201d according to the attorney general\u2019s office.<\/p>\n<p>\u00a0<\/p>\n<p>Under the new rule, a noncitizen parent\u2019s green card application could be <a href=\"https:\/\/ag.ny.gov\/press-release\/2026\/attorney-general-james-leads-major-challenge-trump-administrations-attack\" rel=\"nofollow noopener\" target=\"_blank\">jeopardized<\/a> because their child, who is a U.S. citizen, used state-provided health insurance or took part in a school\u2019s free lunch program. Mamdani <a href=\"https:\/\/www.nyc.gov\/mayors-office\/news\/2026\/09\/new-york-city-leads-cities-and-counties-in-lawsuit-challenging-f\" rel=\"nofollow noopener\" target=\"_blank\">said<\/a> the rule creates a \u201cchilling effect\u201d that could push eligible families away from benefits altogether, regardless of their immigration status.<\/p>\n<p>\u00a0<\/p>\n<p>The DHS has <a href=\"https:\/\/ag.ny.gov\/press-release\/2026\/attorney-general-james-leads-major-challenge-trump-administrations-attack\" rel=\"nofollow noopener\" target=\"_blank\">predicted<\/a> that the change will cost states about $4.05 billion annually in Medicaid and Children\u2019s Health Insurance Program funding and another $1 billion annually in food assistance funding nationwide. A previous, similar rule led to disenrollment rates of up to 35% among mixed-status families and 60% among refugees.\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>James\u2019 coalition also <a href=\"https:\/\/ag.ny.gov\/press-release\/2026\/attorney-general-james-leads-major-challenge-trump-administrations-attack\" rel=\"nofollow noopener\" target=\"_blank\">warned<\/a> that lower enrollment could cause schools to lose automatic certification for free and reduced-price meal programs if Medicaid and food assistance enrollment falls below required thresholds. This would cut off meals for eligible students regardless of their immigration status.<\/p>\n<p>\u00a0<\/p>\n<p>\u201cThe new public charge rule seeks to push immigrant families away from the programs that have kept people fed and healthy for decades,\u201d Mamdani <a href=\"https:\/\/www.nyc.gov\/mayors-office\/news\/2026\/09\/new-york-city-leads-cities-and-counties-in-lawsuit-challenging-f\" rel=\"nofollow noopener\" target=\"_blank\">said<\/a>. \u201cNew Yorkers will be afraid to see a doctor or ask for help they are legally entitled to.\u201d<\/p>\n<p>\u00a0<\/p>\n<p>James <a href=\"https:\/\/apnews.com\/article\/immigration-public-charge-benefits-assistance-lawsuit-new-york-95ac8c221f5ded109d36fe13ebd7bc8f\" rel=\"nofollow noopener\" target=\"_blank\">said<\/a> the rule \u201cpreys on\u201d families\u2019 fears and depends on families forfeiting benefits for which they are legally entitled.\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>She <a href=\"https:\/\/ag.ny.gov\/press-release\/2026\/attorney-general-james-leads-major-challenge-trump-administrations-attack\" rel=\"nofollow noopener\" target=\"_blank\">previously led<\/a> a coalition that successfully blocked a similar rule in 2020, a decision later upheld by the U.S. Court of Appeals for the Second Circuit.<\/p>\n<p>\u00a0<\/p>\n<p>A DHS spokesperson told <a href=\"https:\/\/ny1.com\/nyc\/all-boroughs\/politics\/2026\/09\/14\/nyc-sues-over-trump-rule-on-green-cards-for-immigrants-using-public-aid\" rel=\"nofollow noopener\" target=\"_blank\">NY1<\/a>, \u201cSanctuary states are terrified they will lose federal funds because hundreds of thousands of illegals and noncitizens might remove themselves from American welfare programs.\u201d\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>Immigration advocates said the rule already has families weighing impossible choices.
