{"id":359233,"date":"2026-09-28T22:02:27","date_gmt":"2026-09-28T22:02:27","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/359233\/"},"modified":"2026-09-28T22:02:27","modified_gmt":"2026-09-28T22:02:27","slug":"new-yorks-union-protection-act-challenged-in-court-new-york","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/359233\/","title":{"rendered":"New York&#8217;s &#8216;union protection act&#8217; challenged in court | New York"},"content":{"rendered":"<p>(The Center Square) \u2014 A controversial New York law that would allow organized labor to take legal action against groups that discourage union membership has drawn a legal challenge.\u00a0<\/p>\n<p>The lawsuit, filed Monday in U.S. District Court Albany by the Washington, D.C.-based Freedom Foundation, claims the new law is an &#8220;unconstitutional&#8221; effort to block their work in New York and elsewhere to educate workers about their First Amendment right to opt out of union membership.<\/p>\n<p>\u201cNew York\u2019s government unions had a choice,\u201d said Freedom Foundation CEO Aaron Withe. \u201cThey could make the case to their own members why they\u2019re worth the money, or they could get the state to make it illegal to hear any other point of view. They chose the latter.&#8221;<\/p>\n<p>The Democratic plan, <a href=\"https:\/\/www.thecentersquare.com\/new_york\/article_76c9055d-b95c-46f9-aa6f-01fe75d8323a.html\" target=\"_blank\" rel=\"nofollow noopener\">signed<\/a> by Gov. Kathy Hochul earlier this month, makes it illegal to &#8220;falsely impersonate&#8221; a union representative and give state Attorney General Letitia James broad powers to investigate, subpoena and fine any person or organization \u2014 including out-of-state groups \u2014 for communications deemed impersonations. The fine is $1,000 per violation.<\/p>\n<p>But lawyers for the foundation said the new rules are part of broader efforts by Democratic-led states to silence groups seeking to advise workers about their right not to join a union.<\/p>\n<p>&#8220;Telling a public employee the truth about their constitutional rights isn&#8217;t impersonation,&#8221; Withe said, &#8220;and it isn\u2019t a crime. We\u2019re asking the court to say so.&#8221;<\/p>\n<p>There was no immediate comment from James, whose office will be defending the law court.\u00a0<\/p>\n<p>The new law is based on an Oregon law that the foundation is currently challenging in court. But New York&#8217;s rules go further than Oregon&#8217;s by granting a &#8220;private right of action,&#8221; allowing unions to file lawsuits against out-of-state parties that could result in devastating fines, the group said.<\/p>\n<p>Nearly 7,500 New York public employees \u2014 out of approximately 968,000 covered by union contracts \u2014 have used Freedom Foundation materials to cancel their membership, including more than 1,400 so far this year, the group said.<\/p>\n<p>Union leaders claim that the protections are needed to safeguard workers&#8217; rights and to push back against conservative groups seeking to reduce public-sector membership.
