(<a href=\"https:\/\/www.news10.com\/top-stories\/dhs-new-york-refusing-to-comply-with-orders-to-detain-16000-migrants-accused-or-convicted-of-crimes\/\" rel=\"nofollow noopener\" target=\"_blank\">NEWS10<\/a>) \u2014 The Department of Homeland Security (DHS) said New York refused to hand over 16,000 undocumented migrants accused or convicted of crimes since the start of the second Trump Administration.<\/p>\n<p>Governor Kathy Hochul\u2019s office strongly refuted those claims, saying the state always notifies immigration enforcement of any non-citizen serving a state prison sentence. <\/p>\n<p>\t<a href=\"https:\/\/www.news10.com\/watch-news10-on-roku-fire-tv-and-apple-tv\/\" class=\"promo-link__link\" target=\"&quot;_blank&quot;\" rel=\"nofollow noopener\"><br \/>\n\t\tDownload our WTEN+ streaming app on Roku, Fire TV and Apple TV!\t<\/a><\/p>\n<p>\u201cGovernor Hochul has been clear: New York State is not and never will be a sanctuary for violent criminals,\u201d a spokesperson for Hochul said. \u201cAny assertion otherwise is a blatant mischaracterization of the facts meant to distract from the cruelty and violence we saw from Secretary Mullin\u2019s ICE agents last week.\u201d<\/p>\n<p><a href=\"https:\/\/www.dhs.gov\/news\/2026\/10\/12\/dhs-releases-new-data-revealing-new-york-has-refused-honor-more-16000-ice-detainers\" rel=\"nofollow noopener\" target=\"_blank\">DHS stated <\/a>there are 52,503 total crimes and convictions associated with the undocumented individuals that range from homicides to drug offenses.<\/p>\n<p>\u201cThese are criminal illegal aliens turned loose by the state of New York who refuses to do its job,\u201d Rensselaer County\u00a0Executive Steven McLaughlin said. <\/p>\n<p>\t<a href=\"https:\/\/nxslink.news10.com\/join\/6sd\/signup\" class=\"promo-link__link\" target=\"&quot;_blank&quot;\" rel=\"nofollow noopener\"><br \/>\n\t\tGet the latest news, weather, sports and entertainment delivered right to your inbox!\t<\/a><\/p>\n<p>McLaughlin has criticized the Hochul Administration for its immigration policies, including the 287(g) Agreement Ban, which went into effect in August and limits how much local law enforcement can cooperate with ICE. <\/p>\n<p>\u201cThey are infringing on the constitutional rights of a duly elected New York Sheriff,\u201d McLaughlin said.<\/p>\n<p>As a result, Rensselaer County filed a lawsuit against the state challenging the ban.
