The push by Lindsay Clancy\u2019s lawyer<\/a> to investigate the lone holdout juror who forced a mistrial in her triple-murder case has been stopped in its tracks by the judge.<\/p>\n

Clancy\u2019s defense attorney, Kevin Reddington, had asked<\/a> for an evidentiary hearing at an upcoming Nov. 2 court date to call witnesses to speak about accusations that Michael P. Desronvil lied on his jury questionnaire and used his cellphone during deliberations.<\/p>\n

However, Judge William F. Sullivan wasn\u2019t having it, and ruled Wednesday that the mistrial<\/a> must only be evaluated based on the circumstances known at the time \u2014 not allegations after the mistrial.\u00a0<\/p>\n

Additionally, Sullivan ruled that digging further into the juror\u2019s reasoning<\/a> or the jury\u2019s internal deliberations would be inappropriate under state law.<\/p>\n

The defense was trying to prove juror misconduct to argue that the mistrial wasn\u2019t a \u201cmanifest necessity,\u201d a key legal avenue to try to stop prosecutors from retrying Clancy under double jeopardy protections.\u00a0<\/p>\n

While the judge blocked the request to call live witnesses or examine the holdout juror, Clancy\u2019s motion to dismiss the charges remains pending and will be argued in court on Nov. 2.<\/p>\n

The 36-year-old Duxbury mom is accused of strangling her three young children \u2014 Cora, 5, Dawson, 3, and 8-month-old Callan \u2014 inside their home in January 2023 before jumping out a second-story window in a suicide attempt.<\/p>\n

She was partially paralyzed in the fall.<\/p>\n

Clancy defense attorney Reddington didn\u2019t dispute the murders, and instead centered their defense on her severe mental illness and postpartum psychosis.<\/p>\n

But prosecutors claimed Clancy \u2013 a former labor and delivery nurse \u2013 carefully planned and carried out the horrific acts.<\/p>\n

After trial, several jurors came forward and revealed that 11 of the 12-person panel, made up of nine women and three men, were prepared to find her not guilty by reason of insanity.<\/p>\n

Desronvil was the only juror who wanted to convict Clancy on the three first-degree murder charges she faced.\u00a0<\/p>\n

He has claimed he didn\u2019t have any doubt about her guilt \u2013 in the wake of other jurors accusing him of voicing doubts but refusing to find her not criminally responsible.<\/p>\n

Prosecutors still haven\u2019t confirmed whether they plan to retry Clancy on the same charges. They could also seek to downgrade the charges, drop them altogether or try to hash out a deal with her legal team.<\/p>\n

Either way, Sullivan said he hopes to nail down a trial date at the Nov. 2 hearing.<\/p>\n
