{"id":4089,"date":"2025-10-15T22:09:06","date_gmt":"2025-10-15T22:09:06","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/4089\/"},"modified":"2025-10-15T22:09:06","modified_gmt":"2025-10-15T22:09:06","slug":"wayne-disposal-fails-to-loosen-court-order-blocking-manhattan-project-waste-shipments-planet-detroit","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/4089\/","title":{"rendered":"Wayne Disposal fails to loosen court order blocking Manhattan Project waste shipments\u00a0 \u2013 Planet Detroit"},"content":{"rendered":"<p class=\"&quot;byline&quot;\">by Brian Allnutt, Planet Detroit  <br \/>October 15, 2025<\/p>\n<p>A Wayne County judge denied proposed changes Wednesday to an <a href=\"https:\/\/www.documentcloud.org\/documents\/26041735-preliminary-injunction\/\" rel=\"nofollow noopener\" target=\"_blank\">injunction<\/a> that <a href=\"https:\/\/planetdetroit.org\/2025\/08\/wayne-disposal-radioactive-waste\/\" rel=\"nofollow noopener\" target=\"_blank\">bars the shipment of radioactive waste <\/a>from all Manhattan Project-era sites managed by the U.S. Army Corps of Engineers to the Wayne Disposal landfill.\u00a0<\/p>\n<p>Attorneys for the Van Buren Township landfill sought to amend Wayne County Circuit Judge Kevin Cox\u2019s Aug. 6 preliminary injunction in order to accept what it said are materials with radiation levels below what&#8217;s classified as TENORM, or technologically enhanced naturally occurring radiological materials.<\/p>\n<p>The legal battle over the shipments began in 2024 over Army Corps plans to send elevated radiation waste from the Niagara Falls Storage Site in Lewiston, New York to Wayne County.<\/p>\n<p>Belleville, Van Buren Township, Canton Township, Romulus, and the Van Buren Township fire chief filed a <a href=\"https:\/\/www.documentcloud.org\/documents\/25198593-belleville-vs-wdi-case-no-24-013420-ch-part-3-1\/?responsive=1&amp;title=1\" rel=\"nofollow noopener\" target=\"_blank\">lawsuit<\/a> in September 2024 to stop the shipments, and Wayne County intervened in the case. The lawsuit is scheduled to go to trial Feb. 2.\u00a0<\/p>\n<p>Wayne Disposal\u2019s proposed amendment includes a different definition of TENORM than the one included in the August court order barring the radioactive waste, Cox said during a Wednesday hearing.<\/p>\n<p>Michael Caldwell, an attorney representing Wayne County, said determining whether the waste sent from the Manhattan Project-era sites contains TENORM is an &#8220;almost insurmountable&#8221; problem.<\/p>\n<p>&#8220;This really does have to do with the defendant\u2019s refusal to provide any information &#8230; that would be necessary to determine whether the waste they want to ship to Van Buren Township falls within the scope of your preliminary injunction,&#8221; Caldwell said.<\/p>\n<p>Scott Watson, an attorney for Wayne Disposal, said it\u2019s the Army Corps&#8217; responsibility to properly characterize waste before sending it to the landfill for disposal.<\/p>\n<p>Cox said it\u2019s possible the Army Corps&#8217; and the court&#8217;s definition of TENORM are different.
