Andersen told police he had woken up after hearing something and had only gotten a few hours of sleep that night, court records showed.\u00a0<\/p>\n
He heard a commotion at the door and recalled hearing the intensifying sounds of some type of key, tool, or instrument being used at the door, documents said.<\/p>\n
The homeowner\u2019s actions were not protected by the state\u2019s \u201cStand Your Ground\u201d law, Eastwood said. AP<\/p>\n

The commotion \u201cscared him\u201d after he realized it was real, causing him to retreat to the top of the stairs at the landing and look toward the front door, the documents continued.<\/p>\n
Unsure of what to do, Andersen walked to what he called his \u201csafe room,\u201d or his music room, and grabbed a handgun, police wrote.\u00a0<\/p>\n
After hearing the commotion at the front door get \u201cmore and more aggressive,\u201d he loaded his gun, went to the top of the stairs, and told his wife to go to the safe room.\u00a0<\/p>\n
He then fired the first shot, which was followed by the sounds of a man crying out and weeping, the documents alleged.\u00a0<\/p>\n
Andersen told his wife to call 911, who eventually handed him the phone.\u00a0<\/p>\n
\u00a0\u201cPlease come, please come, please come, they are trying to get in,\u201d he allegedly told the 911 dispatcher.<\/p>\n
Andersen and his wife did not comply with leaving the house for some time, but eventually left the home and were detained, court documents obtained by the outlet said.<\/p>\n
Vel\u00e1squez told cops that his wife had only been fiddling with the keys for 30 seconds to one minute before the shot rang out, the outlet reported.<\/p>\n
It was his first day on the job with his wife, he recalled to police.<\/p>\n
\u201cWhat I need now is for there to be justice because he took her life in that sense, I don\u2019t believe that\u2019s human,\u201d the heartbroken father told WRTV.<\/p>\n
\u201cHe\u2019s an animal, a dog, a deer, to kill in that way,\u201d Velazquez said.<\/p>\n

\u201cNow, I am father and mother for my children, for my daughters \u2014 and he\u2019s happy at home,\u201d he added of the shooter.<\/p>\n
P\u00e9rez leaves behind four children,\u00a0aged 11 months to 17.\u00a0<\/p>\n
Andersen\u2019s attorney, Guy Relford, said in a statement Monday that he thinks the mom of four\u2019s death was a \u201cterrible tragedy,\u201d\u00a0but believed his client\u2019s actions were fully justified by Indiana\u2019s self-defense laws.<\/p>\n
\u201cThe death of Maria Florinda Rios Perez de Velasquez is a terrible tragedy that is heartbreaking for everyone involved,\u201d Relford wrote.<\/p>\n
\u201cAnd while we are disappointed that the Boone County Prosecutor\u2019s Office has elected to file criminal charges against Mr. Curt Andersen, I look forward to proving in court that his actions were fully justified by the \u2018castle doctrine\u2019 provision of Indiana\u2019s self-defense law,\u201d he said.\u00a0<\/p>\n
The \u201ccastle doctrine\u201d provision allows a person to use reasonable, possibly deadly force if they believe that it is necessary to stop someone from unlawfully entering their home.\u00a0<\/p>\n
