{"id":45750,"date":"2025-11-20T06:03:11","date_gmt":"2025-11-20T06:03:11","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/45750\/"},"modified":"2025-11-20T06:03:11","modified_gmt":"2025-11-20T06:03:11","slug":"house-passes-pair-of-bills-repealing-cashless-bail-laws-limiting-cops-ability-to-crack-down-on-crime-in-dc","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/45750\/","title":{"rendered":"House passes pair of bills repealing cashless bail, laws limiting cops ability to crack down on crime in DC"},"content":{"rendered":"<p>WASHINGTON \u2014 The House passed a pair of bills Wednesday repealing <a href=\"https:\/\/nypost.com\/2025\/08\/25\/us-news\/president-trump-to-sign-executive-order-ending-cashless-bail\/\" rel=\"nofollow noopener\" target=\"_blank\">cashless bail<\/a> in DC and much of a law passed by the city\u2019s council in 2022 that limited cops\u2019 use of force \u2014 including banning chokeholds \u2014 and their ability to collectively negotiate disciplinary actions against them.<\/p>\n<p>The first measure, introduced by Rep. Elise Stefanik (R-NY), would mandate pretrial and post-conviction detention for dangerous or violent crimes and require mandatory cash bail for offenders who pose a threat to public safety in the nation\u2019s capital \u2014 and it passed in a 237-179 vote.<\/p>\n<p>DC had\u00a0the fourth-highest murder-per-capita rate\u00a0of any US city last year, according to a February 2025 report from the Center for Public Safety Initiatives at the Rochester Institute of Technology. AP<\/p>\n<p>The other piece of legislation doing away with the DC Council\u2019s <a href=\"https:\/\/code.dccouncil.gov\/us\/dc\/council\/laws\/24-345\" target=\"_blank\" rel=\"noopener nofollow\">Comprehensive Policing and Justice Reform Amendment Act of 2022<\/a> sailed through the House in a 233-190 vote.<\/p>\n<p>Stefanik described her bill as a \u201cprecursor\u201d to an effort aimed at scrapping New York\u2019s \u201cfailed bail reform.\u201d<\/p>\n<p>\u201cNew Yorkers know that Kathy Hochul\u2019s failed bail reform has unleashed a crime wave across our state by emboldening violent criminals and putting law-abiding New Yorkers in harm\u2019s way,\u201d Stefanik told The Post. \u201cKathy Hochul\u2019s failed bail reform has literally caused murders, assaults, rapes, and heinous crimes to be committed against law-abiding New Yorkers.\u201d<\/p>\n<p>\u201cToday I proudly voted to end cashless bail in DC, which Congress has jurisdiction over, and this is a precursor to next month when Congress will pass my bill to end New York\u2019s failed bail reform,\u201d she added. \u201cKathy Hochul is incapable of making New York safe, so I will come over the top of her and pass this in Congress.\u201d<\/p>\n<p>Republicans rallied behind Stefanik\u2019s bill, but Democrats claimed DC\u2019s current rules for pretrial release largely matched federal law, making the measure needless.<\/p>\n<p>\u201cHer bill isn\u2019t just unconstitutional; it runs directly against one of the bedrock principles of our justice system: The accused are presumed innocent until proven guilty in a court of law,\u201d <a href=\"https:\/\/x.com\/EleanorNorton\/status\/1991220225732129264\" target=\"_blank\" rel=\"noopener nofollow\">said<\/a> Delegate Eleanor Holmes Norton, a Democrat who represents the District in Congress.<\/p>\n<p>\u201cProgressive, activist judges are currently allowed to release criminals to DC\u2019s streets with only a promise that they will not re-offend and will return to court for their trial date,\u201d said Rep. James Comer (R-Ky.) during floor debate on the legislation.<\/p>\n<p>The first measure, introduced by Reps. It would require judges to hold anyone charged with a violent crime before trial, and it would impose cash bail or bail bonds on anyone charged with a range of public-safety or law-and-order offenses,\u201d added the chair of the powerful House Oversight Committee.<\/p>\n<p>Rep. Andrew Clyde (R-Ga.) also reintroduced <a href=\"https:\/\/nypost.com\/2023\/05\/16\/senate-repeals-dc-policing-bill-passed-by-city-council\/\" rel=\"nofollow noopener\" target=\"_blank\">a bill similar to one passed by the House in 2023<\/a> that rolled back a host of so-called \u201cpolice reforms\u201d adopted by the Democrat-controlled DC city council the year before. Critics claimed the reforms hamstrung cops\u2019 enforcement capabilities and scrapped their due process rights.<\/p>\n<p>Norton also took issue with the measure, claiming it was, like Stefanik\u2019s, \u201canti-home rule\u201d and that violent crime has already been cut in half since the last time the House considered a similar measure.<\/p>\n<p>DC Mayor Muriel Bowser \u2014 who vetoed her city council\u2019s crime bill in January 2023 but was later overruled by its members \u2014 credited the federal takeover in August with reducing violent crime by 45%. Getty Images<\/p>\n<p>\u201cViolent crime in DC dropped 35% last year and is down another 28% this year, yet Republicans are acting as if we\u2019re in a crisis that justifies extraordinary federal overreach,\u201d the DC Dem delegate <a href=\"https:\/\/x.com\/EleanorNorton\/status\/1991215607853789617\" target=\"_blank\" rel=\"noopener nofollow\">said<\/a>.<\/p>\n<p>DC still had<a href=\"https:\/\/nypost.com\/2025\/08\/17\/us-news\/dc-police-allegedly-downplay-violent-crimes-to-make-stats-look-more-favorable\/\" rel=\"nofollow noopener\" target=\"_blank\">\u00a0the fourth-highest murder-per-capita rate<\/a>\u00a0of any US city last year, according to a February 2025 report from the Center for Public Safety Initiatives at the Rochester Institute of Technology.<\/p>\n<p>Comer said the CLEAN DC Act was an \u201canti-police law\u201d that \u201cstripped law enforcement officers of many tools needed to execute their duties safely and without fear of retribution, as well as limited their options in situations of life or death.\u201d<\/p>\n<p>President Trump authorized the takeover of Washington that deployed National Guard troops to clean up \u2014 sometimes literally \u2014 the city and use the show of force to deter crime. REUTERS<\/p>\n<p>\u201cIt also created new opportunities for anti-police activists to harass law enforcement officers and added many undue burdens and requirements to officers in the DC Metropolitan Police Department,\u201d he claimed in his floor speech.<\/p>\n<p>\u201cBy addressing the retention and recruitment crises gripping D.C.\u2019s Metropolitan Police Department, Congress can do its part in helping boost the number of crime fighters this city desperately needs to keep violent criminals off the streets,\u201d he said.<\/p>\n<p>Former President Joe Biden vetoed a version of the bill that passed both chambers of Congress on a bipartisan basis, claiming it would \u201coverturn commonsense police reforms such as: banning chokeholds; limiting use of force and deadly force; improving access to body-worn camera recordings; and requiring officer training on de-escalation and use of force.\u201d<\/p>\n<p>Trump has continued to threaten Democratic localities and jurisdictions using cashless bail with the revocation of federal funds if they refuse to scupper the policy. Andrew Garbarino (R-NY) had also championed a bill <a href=\"https:\/\/nypost.com\/2025\/06\/10\/us-news\/house-votes-to-overturn-dc-law-allowing-noncitizens-to-vote\/\" rel=\"nofollow noopener\" target=\"_blank\">rolling back parts of that DC law in June<\/a>.<\/p>\n<p>In August, President Trump authorized a federal takeover of Washington that deployed National Guard troops to clean up \u2014 <a href=\"https:\/\/nypost.com\/2025\/08\/27\/us-news\/national-guard-troops-turn-to-custodial-work-landscaping-in-dc\/\" rel=\"nofollow noopener\" target=\"_blank\">sometimes literally<\/a> \u2014 the city and use the show of force to deter crime, all while other federal agents were sent out in a task force <a href=\"https:\/\/nypost.com\/2025\/08\/08\/us-news\/feds-in-dc-arrest-eight-seize-stolen-guns-and-drugs-trumps-law-enforcement-crackdown-takes-aim-at-nations-capitol\/\" rel=\"nofollow noopener\" target=\"_blank\">to seize guns, drugs and collar perps<\/a>.<\/p>\n<p>DC Mayor Muriel Bowser \u2014 who vetoed her city council\u2019s crime bill in January 2023 but was later overruled by its members \u2014 credited the move with reducing violent crime by 45% by the end of the month.<\/p>\n<p>DC US Attorney, Jeanine Pirro, has also called for the repeal of other soft-on-crime laws like the Incarceration Reduction Act and the Youth Rehabilitation Amendment Act AP<\/p>\n<p>Carjackings fell a whopping 87%, and overall crime dipped 15%.
