It\u2019s the latest blow to the Trump administration\u2019s efforts to pursue legal action against the president\u2019s political foes.<\/p>\n<p class=\"clay-paragraph\" data-editable=\"text\" data-uri=\"nymag.com\/intelligencer\/_components\/clay-paragraph\/instances\/cmidiiq42000g3b78ndw69fah@published\" data-word-count=\"99\">In her <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.vaed.582136\/gov.uscourts.vaed.582136.213.0_1.pdf\" rel=\"nofollow noopener\" target=\"_blank\">decision<\/a> in Comey\u2019s case, U.S. District Judge Cameron McGowan Currie wrote that Halligan, the U.S. Attorney for the Eastern District of Virginia, was appointed to that role in violation of federal law. Attorney General <a href=\"https:\/\/nymag.com\/intelligencer\/article\/trump-prosecution-demand-pam-bondi-react.html\" rel=\"nofollow noopener\" target=\"_blank\">Pam Bondi<\/a> tapped Halligan to replace the interim appointee in that role, Erik Siebert, who resigned under pressure to pursue prosecutions against James and Comey that he felt were unsubstantial. The judge concluded that Bondi\u2019s authority to name another interim U.S. Attorney was limited to the 120 day-period Siebert was named under and officially expired on May 21, months prior to Halligan\u2019s appointment.<\/p>\n<p class=\"clay-paragraph\" data-editable=\"text\" data-uri=\"nymag.com\/intelligencer\/_components\/clay-paragraph\/instances\/cmidiiqcx000h3b78bb3v6c3g@published\" data-word-count=\"71\">\u201cConsequently, I conclude that the Attorney General\u2019s attempt to install Ms. Halligan as Interim U.S. Attorney for the Eastern District of Virginia was invalid and that Ms. Halligan has been unlawfully serving in that role since September 22, 2025,\u201d the judge wrote. \u201cI conclude that all actions flowing from Ms. Halligan\u2019s defective appointment, including securing and signing Mr. Comey\u2019s indictment, constitute unlawful exercises of executive power and must be set aside.\u201d<\/p>\n<p class=\"clay-paragraph\" data-editable=\"text\" data-uri=\"nymag.com\/intelligencer\/_components\/clay-paragraph\/instances\/cmidk0fo8000c3b78nw91rue0@published\" data-word-count=\"25\">Currie\u2019s ruling concludes that the task of selecting a new interim U.S. attorney falls to the district court until the Senate confirms an official appointee.<\/p>\n<p class=\"clay-paragraph\" data-editable=\"text\" data-uri=\"nymag.com\/intelligencer\/_components\/clay-paragraph\/instances\/cmidiiqek000i3b783xtlgmec@published\" data-word-count=\"70\">The judge issued a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.vaed.583342\/gov.uscourts.vaed.583342.140.0_2.pdf\" rel=\"nofollow noopener\" target=\"_blank\">similar ruling<\/a> in a case brought by James, who also challenged the legality of Halligan\u2019s appointment. Both cases were dismissed without prejudice, meaning the government could choose to pursue the matters again. However, the Justice Department might be out of luck with regards to Comey: Halligan secured her<a href=\"https:\/\/nymag.com\/intelligencer\/article\/james-comey-indictment-trump-prosecution.html\" rel=\"nofollow noopener\" target=\"_blank\"> indictment of the FBI director<\/a> just days before the five-year statute of limitations on the alleged conduct expired.<\/p>\n<p class=\"clay-paragraph\" data-editable=\"text\" data-uri=\"nymag.com\/intelligencer\/_components\/clay-paragraph\/instances\/cmidiiqgt000j3b78f06b7kdo@published\" data-word-count=\"103\">The dismissal of Comey\u2019s and James\u2019s cases marks another high-profile failure for the Donald Trump\u2013helmed Justice Department, which has frequently leaned more on loyalists willing to speedily execute the president\u2019s orders than on veteran appointees with extensive legal experience. Halligan, who had never served as a prosecutor prior to her appointment, is just the latest administration pick to have their authority revoked. In August, a federal judge found that Alina Habba, a onetime personal attorney for Trump, was <a href=\"https:\/\/www.politico.com\/news\/2025\/08\/21\/alina-habba-new-jersey-us-attorney-ruling-00518559\" rel=\"nofollow noopener\" target=\"_blank\">unlawfully appointed<\/a> to serve as the U.S. Attorney for New Jersey. The Justice Department has appealed the ruling, and the matter is still being litigated.<\/p>\n<p class=\"clay-paragraph\" data-editable=\"text\" data-uri=\"nymag.com\/intelligencer\/_components\/clay-paragraph\/instances\/cmidiiqkj000k3b786sbnuzbb@published\" data-word-count=\"98\">But Trump personally sought the prosecutions of Comey and James, directing Bondi to look into them in a social-media post. \u201cPam: I have reviewed over 30 statements and posts saying that, essentially, \u2018same old story as last time, all talk, no action. Nothing is being done. What about Comey, Adam \u2018Shifty\u2019 Schiff, Leticia??? They\u2019re all guilty as hell, but nothing is going to be done,\u201d the president wrote on <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/115239044548033727\" rel=\"nofollow noopener\" target=\"_blank\">Truth Social<\/a>. \u201cWe can\u2019t delay any longer, it\u2019s killing our reputation and credibility. They impeached me twice, and indicted me (5 times!), OVER NOTHING. JUSTICE MUST BE SERVED, NOW!!!\u201d<\/p>\n<p class=\"clay-paragraph\" data-editable=\"text\" data-uri=\"nymag.com\/intelligencer\/_components\/clay-paragraph\/instances\/cmidiiqp5000m3b78md0yacz2@published\" data-word-count=\"55\">James addressed the news of the dismissed indictment against her in a statement. \u201cI am heartened by today\u2019s victory and grateful for the prayers and support I have received from around the country. I remain fearless in the face of these baseless charges as I continue fighting for New Yorkers every single day,\u201d she said.<\/p>\n<p class=\"clay-paragraph\" data-editable=\"text\" data-uri=\"nymag.com\/intelligencer\/_components\/clay-paragraph\/instances\/cmidma3a2000h3b78tsf2zmk9@published\" data-word-count=\"29\">In a <a href=\"https:\/\/x.com\/atrupar\/status\/1993044973474770946\" rel=\"nofollow\">video shared to social media<\/a>, Comey said he was \u201cgrateful\u201d that the indictment against him was tossed, denouncing the prosecution as one \u201cbased on malevolence and incompetence.\u201d<\/p>\n<p class=\"clay-paragraph\" data-editable=\"text\" data-uri=\"nymag.com\/intelligencer\/_components\/clay-paragraph\/instances\/cmidmemv4000u3b781otx6miv@published\" data-word-count=\"40\">\u201cI was also inspired by the example of the career people who refused to be part of this travesty.
