{"id":51963,"date":"2025-11-25T18:59:07","date_gmt":"2025-11-25T18:59:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/51963\/"},"modified":"2025-11-25T18:59:07","modified_gmt":"2025-11-25T18:59:07","slug":"what-n-y-residents-need-to-know-about-utility-shut-off-laws-this-winter-season","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/51963\/","title":{"rendered":"What N.Y. residents need to know about utility shut-off laws this winter season"},"content":{"rendered":"<p class=\"article__paragraph article__paragraph--left\" id=\"AE3PK2GUWNG5TKOACOGFIMCPMQ\">STATEN ISLAND, N.Y. &#8212; As temperatures continue to drop as we head into the winter months, Attorney General Letitia James wants to make sure New Yorkers know their legal rights when it comes to keeping warm.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"FPPH4545BBEQXPIHLN7KGO4PV4\">Last week, James issued a consumer alert to remind New Yorkers of their home utilities rights, including legal protections for heat and hot water.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BX47QN5SBRBJBNC2HMGZVIGHEI\">\u201cNew Yorkers have a legal right to heat and hot water services during the winter season,\u201d said James. \u201cAs temperatures drop, I urge New Yorkers to know their rights when it comes to home utilities, and to reach out to my office if they feel their rights are being violated. No New Yorker should be left without heat or hot water as days and nights grow colder.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"VLNS4HKECVATTPGCGWEQEGEEYQ\">In New York, utility companies are required to make extra efforts to contact a household before a shut off during the cold weather period, which is defined as Nov. 1 through Apr. 15.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"IQTP5BY57RBEPDDIWW732YB7XM\">Utility companies are required to wait at least 35 days from when notices are past due to pursue termination of service and must provide at least 15 days notice before doing so.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"XD4QZQ726VFVFKMJALTXZGFRN4\">Additionally, utility companies are not permitted to shut off service to residential costumers during the two-week period that includes Christmas and New Year\u2019s Day.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"XCAR5DEJ3FBFNCJTHCRP5MTSTI\">Companies are also required to have trained personnel evaluate whether shutting off service to a customer poses a risk of serious impairment to a resident\u2019s health or safety.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6NNVCE52CJGMDKWJXMWIBXNADQ\">If such a risk is determined, the utility company must notify social services to evaluate the situation before shutting off service.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"MFD6FQFGJJBP7DYNQKRJCUWJ4Y\">Any New Yorker who has been subject to an unauthorized shut off of services is encouraged to <a href=\"https:\/\/formsnym.ag.ny.gov\/OAGOnlineSubmissionForm\/faces\/OAGCFCHome;jsessionid=FzyXY2VAUebGoggWSg8Yb7K_fy5qPVzCASfVzTyilaxKs6lIdHli!325854764\" target=\"_blank\" rel=\"nofollow noopener\">file a complaint online<\/a> or call 1-800-771-7755.<\/p>\n","protected":false},"excerpt":{"rendered":"STATEN ISLAND, N.Y. &#8212; As temperatures continue to drop as we head into the winter months, Attorney General&hellip;\n","protected":false},"author":2,"featured_media":51964,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[39],"tags":[9,24,63,134,136,135],"class_list":["post-51963","post","type-post","status-publish","format-standard","has-post-thumbnail","category-staten-island","tag-new-york","tag-new-york-city","tag-nyc","tag-staten-island","tag-staten-island-headlines","tag-staten-island-news"],"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/posts\/51963","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/comments?post=51963"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/posts\/51963\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/media\/51964"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/media?parent=51963"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/categories?post=51963"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ny\/wp-json\/wp\/v2\/tags?post=51963"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
