Michael Virgil, 35, was served 33 drinks at one of the ship\u2019s bars on Dec. 2024, the day he died in custody, according to a wrongful death lawsuit. FOX 11 Los Angeles<\/p>\n
But he died within hours after being restrained and taken into custody by cruise ship security, according to the lawsuit \u2014 with Virgil\u2019s family initially alleging they injected him with a sedative which killed him.<\/p>\n
A year later, the family is standing by that claim in their new lawsuit, and they said Virgil\u2019s cause of death was changed to homicide, legal papers show.<\/p>\n
Virgil had boarded the Mexico-bound cruise with his fianc\u00e9 and 7-year-old autistic son when they were told their room wasn\u2019t ready that fateful day.<\/p>\n
Crew members directed them to a bar, where they remained for a period of time.<\/p>\n
But when their son grew restless, Virgil\u2019s wife took him to check on their room while he remained at the bar.<\/p>\n
It was during that time he was allegedly served the booze \u2014 and he broke into a rage when he left the bar extremely inebriated and couldn\u2019t find his room.<\/p>\n

Footage from the cruise caught Virgil attempting to batter down a door after he\u2019d allegedly attacked crew members and threatened to kill passengers.<\/p>\n
When he was eventually detained, his fianc\u00e9 alleged \u201cthe excessive force and fatal actions taken by crew members including security and medical personnel\u201d who \u201cadministered an injection of a sedative medication, Haloperidol, and used multiple cans of pepper spray\u201d led to his death, according to the lawsuit.<\/p>\n
Virgil died of \u201csignificant hypoxia and impaired ventilation, respiratory failure, cardiovascular instability and ultimately cardiopulmonary arrest, leading to his death which has been ruled a homicide,\u201d the lawsuit read.<\/p>\n
His family\u2019s lawsuit is seeking damages for loss of support, future earnings, medical expenses, along with pain and suffering.<\/p>\n
Royal Caribbean declined to comment pending the ongoing case.<\/p>\n
