{"id":71737,"date":"2025-12-16T00:26:07","date_gmt":"2025-12-16T00:26:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/71737\/"},"modified":"2025-12-16T00:26:07","modified_gmt":"2025-12-16T00:26:07","slug":"new-york-sues-ups-alleging-underpayment-of-seasonal-workers","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/71737\/","title":{"rendered":"New York Sues UPS, Alleging Underpayment of Seasonal Workers"},"content":{"rendered":"<p>The <a class=\"editor-rtfLink\" href=\"https:\/\/ag.ny.gov\/\" target=\"_blank\" rel=\"noopener nofollow\">New York State Office of the Attorney General<\/a> (OAG) sued <a class=\"editor-rtfLink\" href=\"https:\/\/www.ups.com\/us\/en\/home\" target=\"_blank\" rel=\"noopener nofollow\">UPS<\/a> Monday (Dec. 15), alleging that the package delivery company \u201crepeatedly and persistently\u201d underpaid seasonal workers by requiring them to work off the clock, failing to accurately record all hours worked, and manipulating timekeeping systems to reduce paid hours.<\/p>\n<p>The <a class=\"editor-rtfLink\" href=\"https:\/\/ag.ny.gov\/sites\/default\/files\/court-filings\/new-york-v-united-parcel-service-inc-complaint-2025.pdf\" target=\"_blank\" rel=\"noopener nofollow\">lawsuit<\/a> centers on UPS\u2019 practices involving temporary workers, including driver helpers and seasons support drivers, who are hired each year between October and January, the OAG said in a Monday <a class=\"editor-rtfLink\" href=\"https:\/\/ag.ny.gov\/press-release\/2025\/attorney-general-james-sues-ups-cheating-seasonal-workers-out-millions-dollars\" target=\"_blank\" rel=\"noopener nofollow\">press release<\/a>.<\/p>\n<p>\u201cUPS built its holiday business on the backs of workers who were not paid for their time and labor,\u201d New York Attorney General <a class=\"editor-rtfLink\" href=\"https:\/\/ag.ny.gov\/about\/meet-letitia-james\" target=\"_blank\" rel=\"noopener nofollow\">Letitia James<\/a> said in the release.<\/p>\n<p>Reached by PYMNTS, UPS said in an emailed statement that it is aware of the lawsuit.<\/p>\n<p>\u201cUPS denies the unfounded allegation of intentionally underpaying UPS employees,\u201d the company said. \u201cWe offer industry-leading pay and benefits to our more than 26,000 employees in New York, and we remain committed to following all applicable laws.\u201d<\/p>\n<p>The OAG\u2019s complaint alleges that UPS did not pay seasonal workers for time spent traveling between assignments, watching required training videos, returning undelivered packages and handing in equipment at the end of their jobs, according to the release.<\/p>\n<p style=\"text-align:center\">Advertisement: Scroll to Continue<\/p>\n<p>It also alleges that the company delayed clock-ins until a worker scanned or delivered the first package, automatically deducted 30-minute meal breaks regardless of whether workers took them, and edited employees\u2019 timesheets to reduce paid hours, per the release.<\/p>\n<p>The complaint also alleges that UPS failed to compensate workers for work performed when packages or drivers had not yet arrived, failed to provide legally required overtime pay, and forced workers to clock out before completing assignments, according to the release.<\/p>\n<p>The lawsuit asks the court to order UPS to pay restitution to the workers and reform its practices, per the release.<\/p>\n<p>It was reported in October that UPS is increasing its use of gig <a class=\"editor-rtfLink\" href=\"https:\/\/www.pymnts.com\/news\/delivery\/2025\/ups-adds-more-gig-drivers-to-offset-ecommerce-surges\/\" target=\"_blank\" rel=\"noopener nofollow\">delivery drivers<\/a> who use their own vehicles to deliver smaller, low-volume parcels.
