{"id":72061,"date":"2025-12-16T11:11:09","date_gmt":"2025-12-16T11:11:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/72061\/"},"modified":"2025-12-16T11:11:09","modified_gmt":"2025-12-16T11:11:09","slug":"staten-island-project-may-have-a-new-path-forward-after-trumps-order-is-overturned","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/72061\/","title":{"rendered":"Staten Island project may have a new path forward after Trump\u2019s order is overturned"},"content":{"rendered":"<p class=\"article__paragraph article__paragraph--left\" id=\"NEYYDLT5KJGSPCT56I5QIIJTF4\">STATEN ISLAND, N.Y. \u2014 Arthur Kill Terminal\u2019s future remains in limbo after President Donald Trump\u2019s actions halted the project\u2019s construction this year. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"DP3ZTXQYQZAIVKP6TF3LGGK37I\">The terminal is meant to function as a specialized port at the foot of the Outerbridge Crossing where offshore wind turbines and towers could be assembled and staged before being brought out to sea.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ZEZSGF54OZGMPKVWLGE6DXQQCU\">In August, under the direction of Trump, <a href=\"https:\/\/www.silive.com\/news\/2025\/09\/arthur-kill-terminal-to-proceed-despite-loss-of-48m-in-federal-funding.html\" target=\"_blank\" rel=\"nofollow noopener\">Arthur Kill Terminal lost $48 million in federal funding<\/a> that was acquired by <a href=\"https:\/\/www.silive.com\/news\/2022\/10\/staten-island-wind-turbine-facility-gets-big-boost-48m-in-federal-funding.html\" target=\"_blank\" rel=\"nofollow noopener\">Sen. Chuck Schumer in 2022.<\/a> <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BTG4UR6GOFBB5KNCLQ2QMRYUAM\">Prior to that, <a href=\"https:\/\/www.silive.com\/climate\/2025\/01\/fate-of-staten-island-offshore-wind-project-that-promised-700-union-jobs-now-unknown-after-trump-executive-order.html\" target=\"_blank\" rel=\"nofollow noopener\">Trump\u2019s executive order<\/a> halting all federal offshore wind project permits delayed the terminal\u2019s final authorizations and groundbreaking. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"XBBWIIYNT5EUZJXWUG4A7P32CI\">That is, until the beginning of December 2025. <\/p>\n<p>A new year of opportunity<img fetchpriority=\"low\" loading=\"lazy\" decoding=\"async\" alt=\"arthur kill terminal\" class=\"article__image-content\" src=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2025\/12\/DCNCLLFBKFAX5DSZMR3DMYI344.jpg\"  \/>Boone Davis, president and CEO of AOT. (Staten Island Advance\/Joseph Ostapiuk)Staten Island Advance\/Joseph Ostapiuk<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"PWMWWJZZ6FH6HDF3BMA6CFX4FU\">Last week, the U.S. District Court for the District of Massachusetts struck down President Trump\u2019s executive memorandum that indefinitely halted new offshore and onshore wind leasing and permitting. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"MJIJA4VMLRBYPBTEBXFQDHTBNU\">Judge Patti B. Saris ruled the January 20 directive \u201carbitrary and capricious\u201d and \u201ccontrary to law\u201d under the Administrative Procedure Act (APA), determining it was a final agency action subject to judicial review. The decision vacates the memorandum in full, clearing the way for agencies to resume processing wind energy projects.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4Y4SMJICAFB45DTLSBJOYLFTZE\">\u201cWe were very encouraged to see the decision from the federal court last week invalidating President Trump\u2019s executive memorandum with regard to offshore wind energy and are hoping that the federal agencies that are involved in the project will respond accordingly, and that [we] will be able to move forward then,\u201d said Atlantic Offshore Terminal CEO and President Boone Davis and CCO Charles Dougherty. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4O7WASNIRVH6LB7U6RX74JGAPE\">Atlantic Offshore Terminals is the parent company behind Arthur Kill Terminal, which has been in the planning stages for over five years.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"2J3LCNJZORGCJGQWLSTYP4LICM\">The terminal was initially supposed to undergo its 20- to 23-month construction this year, with <a href=\"https:\/\/The%20terminal%20was%20initially%20supposed%20to%20undergo%20its%2020-%20to%2023-month%20construction\" rel=\"nofollow\" target=\"_blank\">an activation anticipated for 2026.<\/a> <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"SKIRFKCCR5HFLGSWAXLW7GRKRU\">Even with the court\u2019s decision to axe Trump\u2019s executive order, a 2026 groundbreaking at the terminal site along Arthur Kill Road remains unclear, Dougherty and Davis said. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"QWWKVQWCWFF2HNM4L7SRLSVVTU\">The construction aimed to create 750 union jobs after the terminal signed a memorandum of understanding with the Building and Construction Trades Council of Greater New York in March of 2024.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4LGMXEMLUVECPE3WY3DXZNVMKI\">In terms of permitting, the city permits are complete and the state permits are nearly completed.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"OJUBWFP3NVBVPNHAKKH6T3N5TY\">Despite the pushback from the federal government and the loss of their federal funding, Davis and Dougherty maintain their steadfast dedication to the project\u2019s completion and success. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"XHBWZHWZ3VHJ7KU6VHGJYAHFMM\">They said, \u201c&#8230;we were very pleased to see the response of Governor Hochul and other members of the New York state government to the federal court\u2019s decision and are looking forward to seeing how the state responds to this gate being opened and continuing to lead the way on offshore wind energy in 2026.\u201d<\/p>\n<p><img fetchpriority=\"low\" loading=\"lazy\" decoding=\"async\" alt=\"Arthur Kill Terminal\" class=\"article__image-content\" src=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2025\/12\/KMTDMTLB5NEZVPZ6PUR2NPSAWQ.png\"  \/>Pictured is a rendering of the Arthur Kill Terminal warehouse. (Courtesy of Arthur Kill Terminal\/Atlantic Offshore Terminals)Courtesy of Arthur Kill Terminal\/Atlantic Offshore Terminals<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"Y7YD7YX5BVCS5DSKLM4DF3MEWA\">The terminal previously boasted unanimous support from all elected officials on Staten Island at the city, state and federal level.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"P6UZZQJ7JNA65FV7JJBXLZTYJM\">However, after U.S. Transportation Secretary Sean P. Duffy pulled funding for a dozen offshore wind projects in Trump\u2019s bid to push America away from green, sustainable energy, the tone changed.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"JX5JXTC3ABBKDANYYU7N46QCEE\">\u201cWe were skeptical of the suitability of this site, viewing the massive, long-term funding required as both risky and overly ambitious. Moreover, we were concerned about the potential environmental damage and the risk of burdening the community with abandoned infrastructure if the project collapsed. Those fears were justified\u2014and here we are,\u201d <a href=\"https:\/\/www.silive.com\/climate\/2025\/08\/fossella-applauds-trump-admin-for-pulling-48-million-from-staten-island-project.html\" target=\"_blank\" rel=\"nofollow noopener\">Borough President Vito Fossella said in a written statement in August.<\/a> \u201cMoving forward, we will collaborate with city and state agencies to champion alternative plans that truly prioritize the best interests of the Staten Island community.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ZDI7FE6BLNCJJDHFDKAJ3CFWSA\">The project passed through Fossella\u2019s office during the terminal\u2019s Uniform Land Use Review Procedure, where he was given a chance to make recommendations <a href=\"https:\/\/www.silive.com\/climate\/2024\/04\/this-staten-island-construction-project-is-one-step-closer-to-breaking-ground.html\" target=\"_blank\" rel=\"nofollow noopener\">in 2024<\/a> before it went to the City Planning Commission and City Council for approval.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"2CZM3ZRTR5BCNCSJNC3EDTMBXY\">Rep. Nicole Malliotakis, who had <a href=\"https:\/\/www.silive.com\/climate\/2025\/04\/malliotakis-urges-army-officials-to-approve-staten-island-wind-terminal-permit.html\" target=\"_blank\" rel=\"nofollow noopener\">petitioned two high-level military officials<\/a> to approve a permit for the construction of Arthur Kill Terminal in April, said: \u201cWe are working with Secretary Duffy to get the funding repurposed to another maritime, port infrastructure or economic development project that would benefit Staten Island. The permitting work I did in April is for the development of the port, but not specific to any one project.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"F3LN2RXKZRBNXJZ4SCVBL3F74M\">Gov. Kathy Hochul\u2019s office said they are reviewing the funding cut made by Duffy, but did not explicitly name Arthur Kill Terminal.<\/p>\n<p>Schumer Responds<img fetchpriority=\"low\" loading=\"lazy\" decoding=\"async\" alt=\"Chuck Schumer\" class=\"article__image-content\" src=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2025\/12\/HLYDURYO5FFRXDQ22Z5KA3JD5E.jpg\"  \/>Sen. It kills many hundreds of good-paying union jobs and short-circuits the essential effort to expand clean wind energy, which will lower energy bills, clean our air, and power our economy. In the strongest terms possible, I urge the Trump administration to realize its mistake, reverse course, and restore funding to this critical infrastructure project. (Courtesy of Arthur Kill Terminal\/Atlantic Offshore Terminals)Courtesy of Arthur Kill Terminal\/Atlantic Offshore Terminals<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"U44Z4UDSJVA7DNDVKYVEZFNU4A\"><a href=\"https:\/\/www.silive.com\/climate\/2024\/10\/arthur-kill-terminal-teams-up-with-college-of-staten-island-for-1-million-grant-to-give-career-opportunities-to-students.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.silive.com\/climate\/2024\/10\/arthur-kill-terminal-teams-up-with-college-of-staten-island-for-1-million-grant-to-give-career-opportunities-to-students.html\">In October 2024<\/a>, Arthur Kill Terminal announced its plan to unite with the College of Staten Island to provide educational opportunities for students looking to enter the offshore wind industry.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"EABUE6O3BBCCXEC35DJLZNKKXA\">In an interview with the college\u2019s vice president, Robert Wallace, and the director of offshore wind initiatives, workforce development and professional programs at the college, James Bennett, the pair agreed that the college will continue to support students looking to enter this field.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"CUTGGZ7HQZGPZHUGIWEORIQ6BY\">\u201cArthur Kill [Terminal] is a proposed project for Staten Island that has great potential and a lot of big pluses,\u201d said Bennett, who spent a large portion of his career in renewable energy.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"A52JJBTJWFDABEBGAE2CGFKO4M\">\u201cWe are in the process of assessing the market and determining at what point it would be best to move forward with that particular project.
