Kathy Hochul announced Wednesday that she will sign a revised Medical Aid in Dying Act in January 2026<\/a>, setting New York on course to legalize a tightly regulated end\u2011of\u2011life option for terminally ill adults. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"UWD6HRT4ENARDGAW5YMXXHJ2KE\">The law would take effect six months after signing to allow state agencies and health systems time to prepare. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"D666O57FR5GUBHTELOGCI5GBMI\">Even as it gained momentum, the law remained controversial, and was pushed forward largely because of passionate advocacy. <a href=\"https:\/\/www.silive.com\/news\/2025\/01\/heartbreaking-stories-fuel-fight-for-medical-aid-in-dying-in-new-york.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.silive.com\/news\/2025\/01\/heartbreaking-stories-fuel-fight-for-medical-aid-in-dying-in-new-york.html\">In some cases the advocates were dying people\u2014or their loved ones\u2014who shared their suffering in the hopes of getting the bill passed.<\/a><\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"WNNYWECZFVAKJK7B2NDLWHJGAE\">Given the strong feelings on both sides, Hochul\u2019s decision follows months of deliberation and adds new protections to the bill lawmakers approved earlier this year. <a href=\"https:\/\/www.silive.com\/opinion\/2025\/12\/gov-explains-why-she-will-make-it-legal-for-dying-new-yorkers-to-opt-for-life-ending-medication.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.silive.com\/opinion\/2025\/12\/gov-explains-why-she-will-make-it-legal-for-dying-new-yorkers-to-opt-for-life-ending-medication.html\">In an official statement<\/a>, the governor framed the policy as a compassionate extension of personal autonomy, noting her mother\u2019s death from ALS and describing the measure as \u201cshortening dying,\u201d not life.<\/p>\n<p>How we got here<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4D4IZIX7XNDVHOHQ6JRTAR7TZA\">The Medical Aid in Dying Act first appeared in Albany a decade ago, <a href=\"https:\/\/www.silive.com\/news\/2015\/02\/sen_diane_savino_sponsors_bill.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.silive.com\/news\/2015\/02\/sen_diane_savino_sponsors_bill.html\">supported back then by an early Staten Island advocate: then-state Sen. Diane Savino<\/a>. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4VKYODF3KBA45NBIYLDFAXBIIQ\">The legislation didn\u2019t win its first floor votes until 2025, <a href=\"https:\/\/www.silive.com\/news\/2025\/04\/ny-assembly-votes-in-favor-of-medical-aid-in-dying.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.silive.com\/news\/2025\/04\/ny-assembly-votes-in-favor-of-medical-aid-in-dying.html\">passing the Assembly in April<\/a> and <a href=\"https:\/\/www.silive.com\/news\/2025\/06\/ny-senate-passes-medical-aid-in-dying-act-next-step-is-gov-hochuls-desk.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.silive.com\/news\/2025\/06\/ny-senate-passes-medical-aid-in-dying-act-next-step-is-gov-hochuls-desk.html\">the Senate in June<\/a>.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"C42IEFEMGVHDXMG3A4PV74NI7M\">On Staten Island, Sen. Jessica Scarcella\u2011Spanton, a prime co\u2011sponsor and Savino\u2019s successor, voted in favor, while Sen. Andrew Lanza voted against. When running for reelection last year, Scarcella-Spanton spoke to the Advance\/SILive.com of spending time with dying people who desperately wanted medically-assisted death legalized. <\/p>\n<p>Heartbreaking Staten Island and New York stories fueled the conversation<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"OZZ5WYONDVB4FNB3XKB4Q5QOCM\">In recent years, the Advance\/SILive.com has shared intimate stories of people and families facing terminal illness. Those who believed the law should pass advocated for it, even when it was clear it would come too late for them. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ZYLUX44K2RCUNLX6W6NNUYGWZA\">After passage of the law in the senate, Scarcella-Spanton said \u201cI kept the advocacy of Brian Moffett, Ayla Eilert, and Gina Luongo with me through out the fight to get this passed. I am grateful to my colleagues for their support and look forward to this historic bill getting signed into law.\u201d<\/p>\n<p>Brian Moffett: An ALS advocate whose legacy helped move lawmakers<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"A546RFA7JBECLA32GVPFMED7GM\">Brian Moffett, a longtime Staten Islander and founding member of the Westerleigh Folk Festival, was diagnosed with ALS and became a vocal proponent of medical aid in dying. <a href=\"https:\/\/www.silive.com\/news\/2024\/07\/longtime-staten-islander-with-als-urges-new-york-to-pass-medical-aid-in-dying-act-so-no-one-else-suffers-like-him-let-me-go-in-peace.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.silive.com\/news\/2024\/07\/longtime-staten-islander-with-als-urges-new-york-to-pass-medical-aid-in-dying-act-so-no-one-else-suffers-like-him-let-me-go-in-peace.html\">He spoke about wanting control and dignity at the end of life and urged lawmakers to act<\/a>; he died in 2024 at age 66. Family and friends later remembered him as an organizer, father and friend \u2014 and as someone who hoped the law would be part of his legacy. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BH7QMWIL5BGUTM7UKPNATPGSME\"><a href=\"https:\/\/www.silive.com\/opinion\/2024\/08\/my-dad-died-in-fear-it-didnt-have-to-be-that-way-opinion.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.silive.com\/opinion\/2024\/08\/my-dad-died-in-fear-it-didnt-have-to-be-that-way-opinion.html\">In a subsequent reflection published by the Advance\/SILive.com<\/a>, his family described the fear and suffering of his final days \u2014 emotions that advocates argue the new law aims to address. <\/p>\n<p><img fetchpriority=\"low\" loading=\"lazy\" decoding=\"async\" alt=\"nws maid\" class=\"article__image-content\" src=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2025\/12\/X45TWL6YWRFIPE67VDL55TNCOI.jpg\"  \/>Ayla Eilert, a Manhattan resident, died of cancer at just 24 years old. (Eilert family photos)Eilert family photosAyla Rain Eilert: A young New Yorker\u2019s pain \u2014and her parents\u2019 plea<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4OLEAB5G7RG4PJCGO56HYZBPQY\">Advocates frequently pointed to <a href=\"https:\/\/www.silive.com\/news\/2024\/04\/24-year-old-died-suffering-her-parents-want-new-yorkers-to-have-the-choice-of-life-ending-medication.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.silive.com\/news\/2024\/04\/24-year-old-died-suffering-her-parents-want-new-yorkers-to-have-the-choice-of-life-ending-medication.html\">Ayla Rain Eilert, a 24\u2011year\u2011old Manhattan resident who died from cancer in 2022 after excruciating pain<\/a>. (Courtesy of Robert Moffit)(Courtesy of Robert Moffit)Lifelong Staten Islander Robert Moffit wanted a choice<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"EPE3WS3NIJHTPC2HUYW5G4TXG4\">Robert Moffit, a lifelong Staten Island resident, was diagnosed with ALS in 2024.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"DXAXP4TZBRBM5IOZUIKZXXYJAA\">By summer of that year, his symptoms already included difficulty speaking, eating and swallowing.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"AW4QPWN4URCO7CNKUOSQK23TDA\"><a href=\"https:\/\/www.silive.com\/news\/2024\/07\/new-york-man-with-als-given-2-5-years-to-live-wants-right-to-die.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.silive.com\/news\/2024\/07\/new-york-man-with-als-given-2-5-years-to-live-wants-right-to-die.html\">He wrote an open letter calling for the law<\/a>, which reads in part: <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"JF5NGWAAERCJFJLAWPQRWSNAPU\">\u201cIt is plain to me that nothing will really help my set of conditions. All I have to look forward to is a steady decline into immobility; a full dependence on others for all of my bodily functions. I think I should be able to determine when enough is enough.\u201d<\/p>\n<p>What the law would allow (and what it wouldn\u2019t)<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"OTIWEOCKGNFBZM6EJQWAUKZRAU\">Once enacted, the revised Medical Aid in Dying Act will allow mentally competent New York residents diagnosed with a terminal illness and a prognosis of six months or less to request and self\u2011administer life\u2011ending medication. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"LDSJ3N7R4FAXHPVC3VEZF37FMA\">Participation by physicians and institutions is voluntary, and the process requires multiple steps, witnesses, and capacity checks to ensure decisions are free of coercion.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"MHK7DDT5J5HKXKL7VUOCN6WSE4\">The bill does not apply to people based solely on age or disability, and adds the five\u2011day waiting period plus the recorded oral request and mental\u2011health evaluation before any prescription can be filled.<\/p>\n","protected":false},"excerpt":{"rendered":"STATEN ISLAND, N.Y. \u2014 Gov.
