A deputy who went to investigate smelled alcohol on Swartz\u2019s breath, according to the sheriff\u2019s office.<\/p>\n<p class=\"text | article-text\">His alleged blood alcohol content was .08 percent.<\/p>\n<p class=\"text | article-text\">The State Commission on Judicial Conduct recently announced that Swartz had agreed to step down from his judicial post early at the end of this year as he suffers from a condition interfering with his ability to perform his job.<\/p>\n<p class=\"copyright |\">Copyright 2025 WWNY.
