{"id":88199,"date":"2026-01-03T15:54:08","date_gmt":"2026-01-03T15:54:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/88199\/"},"modified":"2026-01-03T15:54:08","modified_gmt":"2026-01-03T15:54:08","slug":"citibank-ordered-to-pay-nyc-woman-3-5m-for-alleged-fraud","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/88199\/","title":{"rendered":"Citibank ordered to pay NYC woman $3.5M for alleged fraud"},"content":{"rendered":"<p>Citibank must pay nearly $3.5 million to a Queens stroke victim after missing blatant signs of fraud in her accounts \u2014 then allegedly hiding evidence in the court case that uncovered the theft.<\/p>\n<p>The possibly precedent-setting Dec. 19 decision from Queens Supreme Court Justice Bernice Siegal sanctioned the bank $10,000 for \u201cconcealing critical evidence for over 14 months in violation of court orders\u201d in the case of 80-year-old Leileth Faye Graham \u2014 who ironically was once a legal secretary for a firm that repped the banking behemoth.<\/p>\n<p>The bank\u2019s alleged feet-dragging in the ongoing 2023 proceeding \u2014 and apparent refusal to refund Graham the more than $772,000 stolen from her accounts \u2014 also prompted Siegal to slap Citibank with treble damages under the Electronic Funds Transfer Act.<\/p>\n<p>Leileth Graham\u2019s health began to deteriorate after a stroke, according to court papers.  Courtesy of the Graham family<\/p>\n<p><a href=\"https:\/\/nypost.com\/2025\/08\/20\/business\/citi-wealth-chief-andy-sieg-made-male-executive-cry-in-front-of-colleagues\/\" rel=\"nofollow noopener\" target=\"_blank\">Citibank has denied wrongdoing <\/a>and appealed the order \u2014 leaving Graham\u2019s family praying she eventually gets her money.<\/p>\n<p>\u201cMy hope is that something will come through, so that she gets to enjoy something out of it before she passes away,\u201d said Graham\u2019s niece, Ingrid Gayle, who now oversees her care.<\/p>\n<p>\u201cBecause that would really be sad, that we fight for her to get back her money, and that she doesn\u2019t even get to enjoy a thousand of it.\u201d<\/p>\n<p>The bank was ordered to pay the whopping sum \u201cfor failure to investigate or to return the funds removed from [her] account without consent or authority,\u201d court papers show.<\/p>\n<p>The 1978 law protects consumers in <a href=\"https:\/\/www.ftc.gov\/legal-library\/browse\/statutes\/electronic-fund-transfer-act\" target=\"_blank\" rel=\"noopener nofollow\">electronic transactions<\/a>, but Citibank allegedly sat on its hands while another niece, Joan Hope Bowden, allegedly made 211 withdrawals in Massachusetts where she lived \u2014 a state where the legally blind, bed-bound Graham didn\u2019t travel, according to court papers.<\/p>\n<p>About $135,000 was taken from those withdrawals, and 15 wire transfers bled another $638,000, court papers showed.  <\/p>\n<p>Ingrid Gayle said any money received would go to her aunt\u2019s comfort, including a special vehicle to help the bed-bound woman get out and a renovation of her apartment to help her get around easier. Courtesy of the Graham family<\/p>\n<p>\u201cOk Citibank <a href=\"https:\/\/nypost.com\/2024\/10\/15\/us-news\/nyc-citibank-personal-banker-swipes-150g-from-elderly-man-battling-dementia\/\" rel=\"nofollow noopener\" target=\"_blank\">you all didn\u2019t see this<\/a>?\u201d wondered Gayle. \u201cThis is not normal. You\u2019re calling her, you\u2019re not getting her, why continue the transaction?\u201d<\/p>\n<p>The accused thief used Graham\u2019s cash to pay for vacations in Jamaica, a Washington DC property for her daughter and son-in-law, and doled out money to her own sister and grandkids, a court-appointed evaluator determined.<\/p>\n<p>\u201cHad <a href=\"https:\/\/nypost.com\/2025\/02\/28\/business\/citi-bungle-briefly-credits-clients-account-with-81-trillion-instead-of-280\/\" rel=\"nofollow noopener\" target=\"_blank\">Citibank properly followed its own security procedures<\/a> on the Citibank accounts following the ATM withdrawals, the account would have been flagged, thereby preventing the subsequent wire transfers,\u201d the court found.<\/p>\n<p>Graham emigrated to the US from her native Jamaica in the 1970s, getting a business administration degree from Manhattan College in 1984 and in 1992, a bachelor\u2019s degree from Pace University.<\/p>\n<p>Leileth Faye Graham, seen here in an undated photo, came to the US from Jamaica in the 1970s, earned two degrees and worked for decades in the legal field. Courtesy of the Graham family<\/p>\n<p>She worked at Time Warner, Time Magazine, her niece said, and eventually as a legal secretary for the white shoe law firm Shearman &amp; Sterling \u2014 which<a href=\"https:\/\/dl.tufts.edu\/teiviewer\/parent\/js956r81j\/chapter\/c1\" target=\"_blank\" rel=\"noopener nofollow\"> repped Citibank for decades<\/a>.<\/p>\n<p>Graham, whom Gayle said loved to cook, and \u201cspent conservatively,\u201d never married or had kids, buying her Rego Park condo in the 1980s.<\/p>\n<p>Her health began to fail in February 2020 after a stroke, Gayle said.<\/p>\n<p>\u201cShe recovered. She would talk \u2014 she was a no nonsense person. She went to rehab, she came back.<\/p>\n<p>\u201cThen we started calling and we weren\u2019t getting her,\u201d Gayle recalled.<\/p>\n<p>\t\t\t\t\t\t\tStart your day with all you need to know\t\t\t\t\t\t<\/p>\n<p class=\"inline-module__cta\">\n\t\t\t\t\t\t\tMorning Report delivers the latest news, videos, photos and more.\t\t\t\t\t\t<\/p>\n<p>\t\t\t\t\t\tThanks for signing up!\n\t\t\t\t<\/p>\n<p>The Florida resident visited her \u201cAuntie Faye\u201d and found \u201cdeplorable conditions,\u201d according to court papers, including bedsores on the older woman and a filthy apartment.<\/p>\n<p>\u201cThere was spoiled food in the fridge,\u201d she claimed.<\/p>\n<p>Gayle sounded the alarm, triggering an Adult Protective Services probe and the appointment of legal guardian Abraham Mazloumi to oversee Graham\u2019s property. She now relies on Medicaid to survive, according to court docs. <\/p>\n<p>The bank not only ignored \u201cclear red flags\u201d during the theft, it allegedly failed to produce witnesses, recordings and other evidence in the case that could have led to an early settlement, the court found.  <\/p>\n<p>The case is a game changer for all financial institutions in New York, \u201cbecause it establishes clearly that the bank is liable for unauthorized transactions,\u201d said attorney Raymond Dowd, who represents Graham\u2019s legal guardian. \u201cThe bank bears the burden of proof not the consumer. This is huge.\u201d\u00a0<\/p>\n<p>Citibank has appealed the order and claims it doesn\u2019t have Graham\u2019s money.
