{"id":98037,"date":"2026-01-13T00:29:09","date_gmt":"2026-01-13T00:29:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/98037\/"},"modified":"2026-01-13T00:29:09","modified_gmt":"2026-01-13T00:29:09","slug":"teen-charged-in-fatal-nyc-stabbing-had-just-been-cut-loose-without-bail-da","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/98037\/","title":{"rendered":"Teen charged in fatal NYC stabbing had just been cut loose without bail: DA"},"content":{"rendered":"<p>One of the teens charged in the <a href=\"https:\/\/nypost.com\/2026\/01\/11\/us-news\/nyc-teen-arrested-after-17-year-old-stabbed-in-neck-killed-on-the-street\/\" rel=\"nofollow noopener\" target=\"_blank\">deadly stabbing of a 17-year-old boy <\/a>on a Queens street was out on \u201csupervised release\u201d in a separate gang assault case at the time of the fatal daytime ambush, The Post has learned.<\/p>\n<p>Derek Trejo, 18, was cut loose by Judge Jennifer Tubridy just two months before he and a 17-year-old accomplice allegedly got into the fatal dust-up with victim Josue Argudo, a complete stranger, on Friday afternoon in Woodhaven.<\/p>\n<p>Trejo had been busted as part of a crew of seven brutal perps accused of beating a 34-year-old stranger, pummeling him and hurling a traffic cone at him \u2014 before knifing him in the back \u2014 on 88th Avenue near Woodhaven Boulevard on July 22, 2025, cops and prosecutors said.<\/p>\n<p>He was busted on Nov. 12 \u2014 but didn\u2019t stay behind bars for long. Tubridy granted him supervised release despite the Queens District Attorney\u2019s Office requesting he be held on $40,000 cash bail or $80,000 bond, officials said.<\/p>\n<p>Derek Trejo, 18, who was just released two months ago in a brutal gang assault, now faces a murder charge in the Friday slaying of Josue Argudo, prosecutors said. Obtained by NY Post<\/p>\n<p>Less than two months after he was released without monetary bail, Trejo and his buddy allegedly got into an argument with Argudo \u2014 that ended with the 17-year-old accomplice plunging a knife into the victim\u2019s torso at Jamaica Avenue and 76th Street around 3:45 p.m., cops said.\u00a0<\/p>\n<p>Trejo was back behind bars Monday as he now faces a second-degree murder charge in the broad-daylight ambush, prosecutors said.<\/p>\n<p>Argudo\u2019s neighbors in Woodhaven were astonished at the judge\u2019s move to release Trejo in November.<\/p>\n<p>\u201cHow can she do this? Look in his face! He has no care for life,\u201d Maria Carmen, 27, a mother of three who lives on the same block as the slain teen, said of the judge.<\/p>\n<p>Trejo was involved in the dispute that ended with a 17-year-old boy fatally stabbing Argudo, the DA\u2019s office said. Obtained by NY Post<\/p>\n<p>\u201cIf [the judge] has to live here, live with him standing outside, she would not let him back out again,\u201d Carmen said.<\/p>\n<p>Another neighbor, who identified himself as Oscar, 19, said that gangbangers \u201cknow nothing is going to happen,\u201d even if they are arrested.<\/p>\n<p>\u201cThey\u2019re not crazy, they know,\u201d he said. \u201cOne of that crew got arrested like 20 times. He\u2019s still out. They know how it works here.\u201d<\/p>\n<p>Argudo had tried to flee from the dispute with the two other teens, but the assailants caught up with their target and roughed him up, authorities said.<\/p>\n<p>Argudo did not know either of the suspects in the deadly Friday clash, cops said. Obtained by NY Post<\/p>\n<p>The younger ruffian, who hasn\u2019t been publicly identified because he is a minor, then knifed Argudo at the corner of Jamaica Avenue and 76th Street, according to cops and prosecutors.<\/p>\n<p>Neighbors who saw the attack gave Argudo CPR before he was rushed to Jamaica Hospital in critical condition. He could not be saved.\u00a0<\/p>\n<p>\u201cHe was just a nice kid who just wanted to go to school,\u201d said Eddie Gamble, 61, an engineer who has lived in the neighborhood for 46 years, adding that Argudo lived nearby with his aunt and sister.<\/p>\n<p>\u201cYou could see if you just looked at him, you just talk to him, he was always just smiling. I mean if you watch the video he didn\u2019t even fight back,\u201d he said, apparently referring to footage of the incident.<\/p>\n<p>He said the suspects are part of a gang that hangs out at a local McDonald\u2019s.<\/p>\n<p>Both Trejo and the 17-year-old were ordered held without bail in the murder case. David Burns\/@FD4D<\/p>\n<p>\u201cThat\u2019s their turf. Everybody knows that,\u201d Gamble said. \u201cWe see this every day. These kids are savages. After they [killed him], they just walked across the street and watched.\u201d\u00a0\u00a0<\/p>\n<p>Trejo apparently lived several miles away, on the other side of Queens, according to cops, with his last known address being the Wyndham Garden Long Island City hotel, which the city had operated <a href=\"https:\/\/nypost.com\/2024\/09\/01\/us-news\/nyc-migrant-shelter-overrun-by-teen-fight-club-constant-shrieking-as-residents-rip-disturbance-becoming-unbearable\/\" rel=\"nofollow noopener\" target=\"_blank\">as a migrant shelter<\/a>.<\/p>\n<p>Both Trejo and the 17-year-old \u2014 who is charged with second-degree murder as an adolescent offender \u2014 were ordered held without bail during their arraignments Sunday night.<\/p>\n<p>\u201cAs alleged, the teenage perpetrator and co-defendant, Derek Trejo, engaged the 17-year-old victim in an argument on Jamaica Avenue that soon became physical,\u201d Queens District Attorney Melinda Katz said in a statement. <\/p>\n<p>\u201cThe teenage defendant produced a knife and stabbed Argudo in the torso.
