A 44-year-old Scranton man faces charges after police said he was driving a vehicle with a suspended license while under the influence of alcohol earlier this month.

Officers responded to the intersection of Farr Street and North Everett Avenue on Feb. 11 for a report of an unconscious male in a vehicle, according to a criminal complaint.

Once on scene, police noticed Rodolfo Simon appeared to be heavily under the influence of alcohol and took him into custody, officers said.

Police spotted two 40-ounce containers of alcohol in the center console of Simon’s Chevrolet Avalanche — a can of Wicked Hard Cider that was open and appeared to be half consumed, and an unopened can of Twisted Tea, according to the criminal complaint.

After Simon’s vehicle was towed from the scene, officers saw that he was unsteady on his feet while walking, and they could smell alcohol on his breath, police said.

Simon, observed by police to have puffy eyes, refused a blood test and was transported to the county’s processing center, officers said.

Police charged Simon, 518 Luzerne St., with DUI: highest rate of alcohol, driving while operating privilege is suspended or revoked–DUI related, operating a vehicle without required financial responsibility, driving an unregistered vehicle and operating a vehicle without a valid inspection.

A preliminary hearing is scheduled for March 19 at 10 a.m.
